Pursuant to the Law on Organization of the Government dated December 25, 2001;
BASED ON THE LAW ON STATE ENTERPRISES OF NOVEMBER 26, 2003;
Pursuant to the Enterprise Law dated November 29, 2005;
BASED ON DECISION NO. 38/2007/QD-TTg OF MARCH 20, 2007 ISSUED BY THE PRIME MINISTER REGARDING CRITERIA AND THE LIST OF CLASSIFICATION OF STATE CAPITAL ENTERPRISES 100% OWNED BY THE STATE;
CONSIDERING THE PROPOSAL SUBMITTED BY THE PROVINCIAL PEOPLE'S COMMITTEE OF BAC NINH,
DECISION:
Article 1. APPROVES THE RESTRUCTURING AND MODERNIZATION PLAN FOR STATE CAPITAL ENTERPRISES 100% OWNED BY THE PROVINCIAL PEOPLE'S COMMITTEE OF BAC NINH FOR THE PERIOD 2007-2010 AS FOLLOWS:
TRANSFORM THE FOLLOWING ENTERPRISES INTO JOINT STOCK COMPANIES WITH A SOLE SHAREHOLDER IN 2008: - BAC NINH LOTTERY COMPANY. - SOUTH DUONG WATERWORKS EXPLOITATION COMPANY. - NORTH DUONG WATERWORKS EXPLOITATION COMPANY.
Article 2. THE CHAIRMAN OF THE PROVINCIAL PEOPLE'S COMMITTEE OF BAC NINH IS RESPONSIBLE FOR DIRECTING THE IMPLEMENTATION OF THE RESTRUCTURING AND MODERNIZATION OF STATE CAPITAL ENTERPRISES 100% OWNED BY THE PROVINCIAL PEOPLE'S COMMITTEE IN ACCORDANCE WITH THE CONTENT AND SCHEDULE APPROVED.
THE MINISTRIES OF FINANCE, PLANNING AND INVESTMENT, HOME AFFAIRS, LABOR, INVALIDS AND SOCIAL AFFAIRS AND RELATED AUTHORITIES ARE RESPONSIBLE FOR COOPERATING WITH THE PROVINCIAL PEOPLE'S COMMITTEE OF BAC NINH IN THE IMPLEMENTATION OF THIS DECISION. THE COMMITTEE FOR ENTERPRISE MODERNIZATION AND DEVELOPMENT IS RESPONSIBLE FOR DIRECTING, URGING, GUIDING AND MONITORING THE IMPLEMENTATION.
Article 3. This Decision shall take effect from the date of signing.
THE CHAIRMAN OF THE PROVINCIAL PEOPLE'S COMMITTEE OF BAC NINH AND THE HEADS OF RELATED AUTHORITIES ARE RESPONSIBLE FOR ENFORCING THIS DECISION./.
