Regarding the approval of the restructuring and modernization plan for state-owned enterprises with 100% state capital under the People's Committee of Tay Ninh Province for the period 2007-2010

PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on State-Owned Enterprises dated November 26, 2003;
Pursuant to Decision No. 38/2007/QD-TTg dated March 20, 2007 of the Prime Minister on issuing criteria and classification lists for state-owned enterprises with 100% state capital;
Considering the proposal of the People's Committee of Tay Ninh Province,
DECISION:
Article 1. Approves the restructuring and modernization plan for state-owned enterprises with 100% state capital directly under the People's Committee of Tay Ninh Province for the period 2007-2010 as follows:
1. Maintain as a limited liability company with one member:
- Tay Ninh Sugar Company.
- Tay Ninh Rubber Company 1/5.
- Tay Ninh Water Supply and Sewerage Company.
2. Convert to a limited liability company with one member (in 2008):
- Tay Ninh Irrigation Works Exploitation Company.
- Tay Ninh Motor Vehicle Inspection Center.
3. Privatize (in 2009):
Tay Ninh Urban Construction Company.
4. Implement dissolution (in 2008):
- Tay Ninh Vegetable Oil Company.
- Tay Ninh Import-Export Trading Company.
Article 2
1. Chairman of the People's Committee of Tay Ninh Province:
- Direct the implementation of the restructuring and modernization of state-owned enterprises with 100% state capital directly under the People's Committee of Tay Ninh Province in accordance with the approved content.
- Based on the provisions of Decision No. 38/2007/QD-TTg dated March 20, 2007 of the Prime Minister on issuing criteria and classification lists for state-owned enterprises with 100% state capital to decide the proportion of state shares to be held when privatizing the enterprises mentioned in this Decision.
- Continue to implement the privatization of Tay Ninh Mechanical Engineering Company; if privatization is not possible, then proceed to sell or transfer the Company according to current regulations.
2. Ministries: Finance, Planning and Investment, Home Affairs, Labor, War Invalids and Social Affairs, and related agencies shall cooperate with the People's Committee of Tay Ninh Province in implementing the aforementioned Plan.
The Steering Committee for Enterprise Reform and Development shall be responsible for supervising, guiding, and monitoring the implementation.
Article 3. This Decision takes effect from the date of issuance.
The Chairman of the People's Committee of Tay Ninh Province and heads of related agencies shall be responsible for enforcing this Decision.
