DECISION OF THE PRIME MINISTER

Regarding the issuance of regulations on the responsibilities of ministries and levels of government

in creating conditions for the effective operation of levels of the Vietnam Farmers' Association

 PRIME MINISTER

Based on Articles 9, 87, 111, 112, and 125 of the Constitution of the Socialist Republic of Vietnam in 1992;

Based on Articles 7, 8, and 39 of the Government Organization Law in 1992;

Pursuant to the proposal of the Central Executive Committee of the Vietnam Farmers' Association,

 DECISION:

Article 1. Issued with this Decision is the "Regulations on the Responsibilities of Ministries and Levels of Government in Creating Conditions for the Effective Operation of Levels of the Vietnam Farmers' Association".

Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, Chairpersons of People's Councils, and Chairpersons of People's Committees at provincial and centrally governed city levels shall be responsible for implementing this Decision.

REGULATIONS

ON THE RESPONSIBILITIES OF MINISTRIES AND LEVELS OF GOVERNMENT
IN CREATING CONDITIONS FOR THE EFFECTIVE OPERATION OF LEVELS OF THE VIETNAM FARMERS' ASSOCIATION
(Issued together with Decision No. 17/1998/QĐ-TTg dated January 24, 1998)

Ministries, ministerial-level agencies, and governmental agencies (hereinafter collectively referred to as Ministries), People's Councils and People's Committees at all levels (hereinafter collectively referred to as local levels of government) when formulating policies, laws, state plans, or addressing economic and social issues related to farmers' rights and obligations, and the tasks of the Vietnam Farmers' Association must notify and create conditions for levels of the Vietnam Farmers' Association to participate from the outset.

Article 1. During the process of drafting documents, if there are disagreements, the agency primarily responsible for drafting the document must present clearly the differing opinions for the competent authority to consider and decide.

In the course of organizing and implementing political, economic, social, national defense, and security tasks in rural areas and within the agricultural sector, Ministries and local levels of government must coordinate with the corresponding level of the Vietnam Farmers' Association to organize guidance and create conditions for the development of farmers' movements.

Article 2. Ministries and local levels of government regularly provide information about new state policies and programs; promptly adjust and supplement mechanisms and policies to align with practical realities to mobilize all potential resources of farmers for the cause of industrialization and modernization of the country.

Ministries and local levels of government invite representatives of the corresponding level of the Vietnam Farmers' Association to participate in meetings discussing matters related to farmers and to join as official members in advisory bodies (Committees, Councils) whose functions and activities are linked to farmers' rights and obligations.

Article 3. To enable the Vietnam Farmers' Association to effectively perform its supervisory and inspection functions regarding the implementation of Party guidelines and state policies and laws, Ministries and local levels of government have the responsibility to create favorable conditions during the inspection process; promptly examine, resolve, and respond to the association's recommendations in accordance with legal provisions.

Article 4. When establishing inspection teams to monitor the enforcement of laws and the implementation of policies directly affecting farmers' rights and interests, Ministries and local levels of government should invite representatives of the Vietnam Farmers' Association to participate.

Ministries and local levels of government have the responsibility to create favorable conditions regarding coordination mechanisms, operational funding, and working tools for levels of the Vietnam Farmers' Association according to current regulations to enable the association to effectively carry out its functions and tasks.

Article 5. Local levels of government have a plan to meet regularly (every six months) with the corresponding level of the Vietnam Farmers' Association to discuss cooperative activity programs and address urgent issues raised by farmers' movements. In case of emergencies, local governments and the corresponding level of the Vietnam Farmers' Association will promptly cooperate to handle them.

Article 6. Ministers of Ministries, Heads of ministerial-level agencies, Heads of governmental agencies under the Government, Chairpersons of People's Councils, and Chairpersons of People's Committees at all levels shall work with the corresponding level of the Vietnam Farmers' Association to concretize cooperation programs to achieve tangible results.

Article 7. The Office of the Government shall be responsible for monitoring, summarizing, and periodically reporting to the Prime Minister on the results of implementing these regulations./.
