Article 2: This Decision shall take effect fifteen days from the date of signature and shall replace Decisions No. 15/1998/QĐ-BGD&ĐT dated April 1, 1998, No. 07/1999/QĐ-BGD&ĐT dated February 27, 1999, No. 03/2000/QĐ-BGD&ĐT dated February 28, 2000, and No. 07/2001/QĐ-BGD&ĐT issued by the Minister of Education and Training.

Article 3: The Chairmen of the People's Committees of provinces and centrally governed cities; Heads of the Office, Directors of the High School Department, and Heads of units related to the Ministry of Education and Training are responsible for implementing this Decision./.

REGULATIONS

REGULATIONS ON SECONDARY SCHOOL GRADUATION AND HIGH SCHOOL GRADUATION
(Issued together with Decision No. 17/2002/QĐ-BGD&ĐT dated April 5, 2002 of the Minister of Education and Training)

Chapter 1:

GENERAL PROVISIONS

Article 1. Scope and objects regulated

These regulations stipulate the organization, management, and content of graduation examinations; the organization and activities of examination committees and inspection teams; the delegation of management authority for examinations; and the work of rewarding and disciplining during examinations.

The provisions of these regulations apply to the secondary school graduation examination and the high school graduation examination.

Article 2. Purpose, Requirements, and Basis for Graduation Assessment

The purpose of the secondary school graduation and high school graduation examinations is:

To assess and confirm the level of education attained by students at the end of a grade level according to the curriculum issued by the Ministry of Education and Training.

Chapter 2:

Scores from the graduation examination subjects

EXAMINATION DATE, SUBJECTS, AND CONTENT

Article 3. Organization of the Examination and Examination Date

One graduation examination for secondary school and one graduation examination for high school are organized annually.

The examination date is specified in the annual academic calendar by the Ministry of Education and Training.

In special cases, the Minister of Education and Training may decide to organize two secondary school graduation examinations in one academic year and delegate the provincial People's Committee to determine the date of the second examination.

Article 4. Subjects

The subjects for the secondary school and high school graduation examinations are announced by the Ministry of Education and Training no later than March 31 each year.

Article 5. Examination Program and Content

Students who study according to a program will take the examination according to that program; the examination content is the entire final grade program.

Students belonging to the category specified in Clause 2, Article 6 of this Regulation must also take all subjects, examination content, and examination form as prescribed for the year organizing the examination.

Chapter 3:

ELIGIBILITY FOR EXAMINATION, EXAMINATION FILE

Article 6. Examination Candidates

Students who have completed the final grade program at various types of junior high schools and high schools during the year organizing the examination.

Students who have completed a level's program in previous years but did not meet the conditions for taking the examination or took the examination but did not graduate, and other special cases permitted by the Ministry of Education and Training to take the examination (hereinafter referred to collectively as self-study candidates).

Article 7. Eligibility for Examination

Students stipulated in Clause 1, Article 6 of this Regulation shall be recognized as meeting the eligibility conditions for examination if:

They are students of the specified grades in junior high school or high school (continuous or non-continuous study); they are evaluated and classified in terms of conduct and academic performance in each class; they are promoted according to current regulations.

Evaluation and classification in the final grade;

b.1) Conduct classified as average or higher.

b.2) Not classified as poor in academic performance.

b.3) Not absent from school more than 45 sessions (absences counted cumulatively whether in one instance or multiple instances).

Not in the period of temporary detention, arrest, or deprivation of civil rights.

Students specified in Clause 2, Article 6 of this Regulation shall be recognized as meeting the eligibility conditions for examination if:

Not in the period of temporary detention, arrest, or deprivation of civil rights; not in the period of disciplinary action prohibiting examination.

They are confirmed by the commune or ward (hereinafter collectively referred to as commune) where they reside and recommended to take the examination if they strictly comply with state policies and laws and local security regulations; participate in social activities organized by the locality; have good lifestyle and morality.

Specifically, students who do not meet the eligibility conditions for examination due to being classified as poor in academic performance in the final grade must register and take the end-of-year examination at their final-grade school for some subjects with an average score below 5.0 so that the examination score replaces the average subject score to recalculate the annual average score and meet the academic performance requirements as prescribed.

Age limit for examination (for students currently studying and self-study candidates): not exceeding 21 years old for the junior high school graduation examination, not exceeding 24 years old for the high school graduation examination.

At least ten days before the examination date, the School Principal must publicly announce those students who do not meet the eligibility conditions for examination as stipulated in Clauses 1, 2, and 3 of this Article.

Article 8. Examination File

For the category stipulated in Clause 1, Article 6 of this Regulation:

Academic record (original):

a.1) Junior high school academic record (for the junior high school examination)

a.2) High school academic record (for the high school examination)

A certified copy of the birth certificate

Graduation certificate (original):

c.1) Elementary school graduation certificate (for the junior high school graduation examination).

c.2) Junior high school graduation certificate or supplementary junior high school graduation certificate (for the high school graduation examination).

Application for examination with a 4cm x 6cm photograph affixed and stamped over the photograph issued by the school.

(d) Certificates to qualify for preferential treatment (if applicable) include:

d.1) Certificate for children of martyrs, wounded veterans, disabled veterans, and those entitled to benefits similar to wounded veterans issued by the Veterans Affairs Office of the district.

d.2) A certified copy of the household registration book belonging to the mountainous, remote, new economic zone, or extremely difficult commune, confirmed by the People's Committee of the commune or notarized by the state.

(e) Certificates to qualify for bonus points (if applicable) include:

e.1) General vocational training certificate.

e.2) Certificate for winning awards in examinations organized by the education sector or jointly organized with relevant sectors at provincial level or above, including: excellent student competitions in cultural subjects, experimental and practical examinations (Physics, Chemistry, Biology), arts, sports, drawing, international letter writing, and Casio calculator competitions.

Certificates for preferential treatment and bonus points must be submitted before the examination date to be valid.

For the category stipulated in Clause 2, Article 6 of this Regulation, in addition to the files prescribed in Points a, b, c, d, and đ of Clause 1, Article 8 of this Regulation, the following must be added:

Application for graduation examination (junior high school or high school)

Certificate from the People's Committee of the commune where they reside according to the provisions of Point b, Clause 2, Article 7 of this Regulation and confirming that they are not in the period of temporary detention, arrest, or deprivation of civil rights.

Certificate from the school where they studied the final grade regarding academic classification (for students classified as poor in academic performance) as stipulated in Point c, Clause 2, Article 7 and confirming that they are not in the period of disciplinary action prohibiting examination.

Chapter 4:

GRADUATION RANKING

Article 9. Bonus point levels

Students participating in the following competitions and activities will be awarded bonus points when graduating with the following point levels:

Winning individual awards in the final grade cultural subject competition:

a.1) Winning in the national competition or first prize at the provincial level: 2 points

a.2) Second prize at the provincial level: 1.5 points

a.3) Third prize at the provincial level: 1 point

Winning individual and team awards in arts, sports, drawing, international letter writing, Casio calculator, and experimental and practical subject (Physics, Chemistry, Biology) competitions organized by the education sector in collaboration with relevant sectors at provincial level or above:

b.1) Individual awards:

National award or first prize at the provincial level (Gold Medal): 2.0 points,

Second prize at the provincial level (Silver Medal): 1.5 points

Third prize at the provincial level (Bronze Medal): 1.0 point

b.2) Team awards (soccer, volleyball, six-person volleyball, table tennis, badminton, shuttlecock, track and field, choir, duet) are as follows:

Only national awards are eligible for bonus points.

The number of players, athletes, performers on the team ranges from 2 to 22 according to the specific rules of each competition's organizing committee.

The bonus points for individuals in team awards are calculated similarly to individual awards under Point b.1, Clause b, Article 9 of this Regulation.

b.3) Students who win different awards in various competitions at one educational level shall only be entitled to the bonus points corresponding to the highest award.

Students who obtain a vocational certificate in a test organized by the Department of Education and Training shall be granted bonus points based on the classification recorded in the certificate as follows:

Excellent: 2 points; Good: 1.5 points; Average: 1 point.

If students simultaneously possess multiple certificates entitling them to bonus points according to Points a, b, c Clause 1 Article 9 of this Regulation, they shall only be entitled to the highest bonus point level as follows:

For junior high school: 3 points

For senior high school: 4 points

The bonus points stipulated in Points a, b, c Clause 1 Article 9 of this Regulation shall be maintained throughout the entire educational level. Independent candidates shall not be entitled to bonus points.

Article 10. Examination scores, graduation assessment scores, graduation classification scores

Examination scores:

Grading on a scale of 10 and rounding off to 0.5 as prescribed:

From 0.25 to under 0.75 rounds off to 0.5

From 0.75 to under 1.0 rounds off to 1.0

Graduation assessment score:

Graduation assessment scores, graduation classification scores shall be taken to two decimal places without rounding off.

Article 11. Recognition of Graduation

Students meeting the examination conditions, not subject to disciplinary action from cancellation of exam results upwards, with no subject receiving zero points, and having the graduation assessment score specified for each category below shall be recognized as graduates:

Category 1: 5.0 points or higher for ordinary students

Category 2: 4.75 points or higher for students belonging to one of the following categories:

Children of war invalids or disease invalids with a disability rate of less than 81%, children of those enjoying benefits equivalent to war invalids or disease invalids with a disability rate of less than 81%; children of heroes of armed forces, children of heroes of labor.

Having a parent who is a member of a minority ethnic group, residing and studying in economically, culturally, and socially developed areas.

Han students with permanent residence registration and having studied for three years or more in mountainous, remote, island, new economic zones, or particularly difficult communes.

Category 3: 4.5 points or higher for students belonging to one of the following categories:

Having a parent who is a member of a minority ethnic group, residing and studying in mountainous, remote, island, new economic zones, or particularly difficult communes, or currently studying at boarding schools for ethnic minorities from district level upwards.

Children of martyrs, children of war invalids with a disability rate of 81% or higher, children of those enjoying benefits equivalent to war invalids with a disability rate of 81% or higher.

Students meeting multiple preferential criteria shall only enjoy the highest criterion.

Article 12. Graduation Classification

Graduates shall be classified into three categories: excellent, good, average, according to the following criteria:

Excellent:

Annual classification for the final grade: conduct rating excellent, academic performance excellent.

Graduation classification score (GCS) of 8.0 points or higher

No subject has a score below 7.0

Good:

Annual classification for the final grade in both conduct and academic performance is good or higher.

Average score of 6.5 points or higher. Graduation classification score (GCS)

No subject receives a score below 6.0

Average: remaining cases of graduation

The above graduation classification criteria apply to all candidates specified in Article 9 of this Regulation.

Article 13. Exemption from Graduation Examination

Recipients:

Grade 12 students summoned by the Ministry of Education and Training to participate in recruitment or international competition training for certain subjects.

Final-grade students selected by a central agency to participate in international sports, cultural, and artistic competitions.

Conditions:

In addition to the number of days off stipulated in Section b.3 Point b Clause 1 Article 7 of this Regulation, there are the following conditions:

Being summoned at the end of the second semester of the final grade class.

The annual classification in the final grade class must be good conduct and academic performance from good or higher (for the subjects specified in Point a Clause 1 Article 13) or average or higher (for the subjects specified in Point b Clause 1 Article 13).

Being listed in the exemption examination list according to the circular of the Ministry of Education and Training or having a circular requesting exemption from examination and confirmation of participation in training and competition in accordance with regulations sent by the selection authority to the Department of Education and Training before the graduation examination date.

Students exempted from examination are recognized as graduates and classified according to the following standards:

Excellent:

The final grade class year is classified as excellent academic performance and good conduct, equivalent to graduating with excellent classification with a graduation classification score of 9.0 points.

Good classification;

The final grade class year is classified as good or better academic performance and conduct, equivalent to graduating with good classification with a graduation classification score of 7.0 points.

Average classification: All other cases.

Students exempted from examination who wish to have a higher graduation classification to enjoy incentives in professional secondary school, college, and university entrance examinations as prescribed by the Ministry of Education and Training must take the graduation examination.

Article 14. Special graduation

Students belonging to the categories specified in Clauses 1 and 2 Article 6 of this Regulation, if they meet the examination conditions, may be considered for special graduation in the following cases:

Being sick or having a sudden special event before the examination day (including not taking the first examination session) and unable to take the examination and not more than 10 days before the examination organization date.

Conditions:

Annual classification in the final grade class in terms of academic performance and conduct must be good or better.

Documents:

b.1) Hospital admission and discharge records issued by hospitals at district level or higher (if sick) or confirmation from the People's Committee of the commune where the student resides (if having a sudden special event).

b.2) School's proposal record for special graduation consideration where the student registered to take the examination.

Being sick or having a sudden special event after taking at least one subject and being unable to continue taking the examination or after being sick or having a sudden special event voluntarily taking the remaining subjects.

Conditions:

a.1) Scores of all taken subjects must reach 5.0 or higher.

a.2) Final grade class classification: academic performance from average or higher, conduct from good or higher.

Documents:

b.1) Confirmation record of the Examination Board.

b.2) Hospital admission and discharge records from hospitals at district level or higher (if sick) or confirmation from the People's Committee of the commune where the student resides (if having a sudden special event).

Students graduating through special graduation are all classified as average.

Article 15: Re-examination:

1. The re-examination object is the subjects specified in Clauses 1 and 2 Article 6 of this Regulation.

2. Conditions: The test score is lower than the annual average score of that subject by 2 points or more.

3. The re-examination score of the test will be recognized if it is higher than the initial marking score by 1.0 point or more and replaces the initial marking score for calculating the graduation examination score or the graduation classification score.

4. Implementation procedures:

a) Students must submit a re-examination application form according to the model prescribed by the Ministry of Education and Training to the school where they registered for the graduation examination.

b) Based on the re-examination conditions, the school reviews and compiles a list of re-examination requests (indicating the test scores and the annual average scores of the subjects to be re-examined) and sends it to the District Education and Training Office (for junior high schools) or the Department of Education and Training (for high schools).

c) The District Education and Training Office, the Department of Education and Training is responsible for receiving and transferring the entire list and re-examination application forms to the Re-examination Board.

5. Timeframe:

a) Application receipt: Five days after the temporary graduation list announcement.

b) The re-examination process must be completed within 15 days from the date of application receipt.

6. Re-examination of test scores can only be conducted once per annual graduation examination period.

Chapter 5:

EXAMINATION AND EXAMINATION BOARD FOR GRADUATION

Article 16: Examination.

1. The junior high school graduation examination and the high school graduation examination must meet the following requirements:

a) Testing basic knowledge, ability to apply knowledge, practical understanding of students according to the final grade curriculum and textbooks issued by the Ministry of Education and Training.

b) The examination content must ensure scientific accuracy, rigor, and legality. The wording and sentences in the examination must be clear, coherent, and free of errors.

c) Distinguishing the level of students.

d) Suitable for the time allocated for each subject.

2. In one examination period, each subject has a main examination and a backup examination with similar requirements and content. Each examination includes marking guidelines and grading scales.

3. Examinations and marking guidelines are classified as confidential documents under Clause 3 Article 2 of Decision No. 81/TTg dated March 2, 1994, of the Prime Minister.

Article 17: Members of the Examination Question Setting Council.

1. Each province shall establish one Examination Question Setting Council for junior high school graduation. Nationwide, one Examination Question Setting Council for senior high school graduation shall be established.

2. Composition of the Examination Question Setting Council for junior high school graduation.

a) Chairperson: Director or Deputy Director of the Department of Education and Training. In special cases, this may be replaced by the Head of the Secondary Education Division or the Head of the Testing Division (if available).

b) Vice-Chairpersons: Heads or Deputy Heads of the Secondary Education Division and Testing Division (if available).

c) Secretary and members appointed by the Director of the Department of Education and Training shall be selected from specialists in the Secondary Education Division, Testing Division (if available), departments under the Department, excellent teachers currently teaching subjects at junior high schools.

d) For each subject, there must be at least two people jointly setting examination questions.

3. Composition of the Examination Question Setting Council for senior high school graduation.

a) Chairperson: Deputy Minister of Education and Training.

b) Vice-Chairpersons: Directors, Deputy Directors of the Secondary Education Division and leaders of units designated by the Ministry of Education and Training.

c) Secretary and members of the Council shall be appointed by the Minister of Education and Training from specialists in units under the Ministry, lecturers of universities, researchers of educational research institutes, editors of educational publishing houses, excellent specialists in Secondary Education Divisions under Departments of Education and Training, and excellent teachers currently teaching at senior high schools.

d) For each subject, there must be at least two people jointly setting examination questions.

Article 18: Duties and powers of the Examination Question Setting Council.

1. Tasks of the Council:

a) Organize the drafting of examination questions, marking guidelines, and grading scales.

b) Organize the distribution of examination questions, marking guidelines, and grading scales.

c) Resolve issues related to the printing of examination questions, their content, and marking guidelines during the period of printing, examination supervision, and marking.

2. Duties of the question drafters:

a) Draft examination questions, marking guidelines, and grading scales for the official and backup examinations, submit them for approval by the Chairperson of the Examination Question Setting Council.

b) Print the approved examination questions, marking guidelines, and grading scales for the subjects they are responsible for; package, seal, and deliver the examination questions, marking guidelines, and grading scales; bear personal responsibility for the requirements of the examination content as stipulated in Point b, Clause 1, Article 16.

c) Other members' duties: As assigned by the leadership of the Council.

3. Authorities:

a) Select and decide on the official and backup examination questions, marking guidelines, and grading scales for each subject.

b) Assign specific tasks to members; implement rewards and propose rewards for outstanding leaders and members; impose disciplinary actions and propose disciplinary measures for those who violate regulations or fail to complete their tasks.

c) Manage the budget and implement financial regulations currently in effect.

d) The Chairperson of the Council is responsible for managing and organizing the implementation of the Council's assigned tasks and those of its members.

Chapter 6:

THE PRINTING COUNCIL FOR SENIOR HIGH SCHOOL GRADUATION EXAMINATION QUESTIONS

Article 19: Composition.

Each province or city shall establish one or two (if necessary) Printing Councils for senior high schools, operating under strict isolation principles and ensuring confidentiality throughout the examination period.

Composition of the Printing Council for Examination Questions:

1. Chairperson: Director or Deputy Director of the Department of Education and Training. In special cases, this may be replaced by the Head of the Secondary Education Division or the Head of the Testing Division (if available).

2. Vice-Chairpersons: Heads or Deputy Heads of the Secondary Education Division and Testing Division (if available).

3. Secretary and members appointed by the Director of the Department of Education and Training from specialists in the Secondary Education Division, Testing Division (if available), and relevant departments under the Department.

Article 20: Tasks.

1. Duties of the Director of the Department:

a) Be fully responsible for receiving sealed examination questions, organizing their distribution to examination councils; ensure the safety and confidentiality of the examination questions during transportation.

b) Specify the deadline for printing examination questions and marking guidelines.

2. Responsibilities of the Board:

a) Receive and store examination questions and marking guidelines.

b) Print sample examination questions before mass printing and send them to examination rooms; request technical clarifications about printing and examination content during the printing process according to the Ministry's specific guidance.

c) Print examination questions for each subject according to the quantity specified by the Chairperson.

d) Package, seal, and deliver the examination questions to the designated dispatching department according to the Chairperson's regulations.

Article 21: Powers.

a) Implement the Council's tasks, assign specific tasks to Vice-Chairpersons and members.

b) Implement rewards and disciplinary actions for Council members according to the Regulations. Manage the budget and implement expenditures according to current financial regulations.

c) The Chairperson of the Council is responsible for managing and organizing the implementation of assigned tasks within the Council.

Chapter 7:

THE EXAMINATION SUPERVISION COUNCIL FOR GRADUATION EXAMINATIONS

Article 22: General Provisions.

1. The Graduation Examination Board shall be established to carry out all preparatory work and organize the graduation examination at a location selected by the Department of Education and Training (for secondary schools) or the District Education and Training Office (for junior high schools).

2. The number of leaders (Chairperson and Deputy Chairpersons), secretaries, and invigilators of the board shall be determined by the competent authority establishing the board based on the number of candidates taking the exam. At each examination board, there must be a minimum of 20% reserve invigilators compared to the total number of invigilators specified for each examination room.

3. Within each Board, the Chairperson and all invigilators must be mobilized from schools without students participating in the examination at that board. At most, only half of the Deputy Chairpersons and Secretaries can be from the local school.

4. All members of the Examination Board and those serving in the Examination Board shall not have children, siblings, brothers-in-law, sisters-in-law, wards, or foster children participating in the examination.

5. Each examination room shall accommodate no more than 25 candidates; there shall be two invigilators inside the examination room; external invigilators shall be assigned by the Chairperson of the Examination Board according to the specific conditions of the examination venue, but there must be at least one external invigilator for every two examination rooms.

6. Examination Boards may be established across multiple schools depending on the specific conditions of each locality and each examination period.

Article 23: Composition of the Examination Board.

1. Chairperson and Deputy Chairpersons: Principals or Vice Principals (if necessary, the Secretary of the Educational Board may be appointed) of junior high schools (for junior high examinations) or secondary schools (for secondary examinations).

2. Secretary: Principals, Vice Principals, Secretaries of the Educational Board, or Heads of specialized departments of junior high schools (for junior high examinations) or secondary schools (for secondary examinations).

3. Invigilators: Teachers currently teaching at junior high schools and secondary schools within the locality.

"d) Within no more than one working day from the date of receiving the dossier submitted for administrative procedures by the specialized agency assigned by the Provincial People's Committee, the Chairman of the Provincial People's Committee shall issue a notification of the result of the inspection of plant-based food exports or a certificate at the request of the importing country.": Duties and Authorities.

1. Duties:

a) Examine and verify all application files and related examination files, review the examination eligibility of candidates, and confirm their status at least one day before the examination date.

b) Inspect all physical facilities, necessary procedures, security conditions, and quality to ensure the examination proceeds safely and strictly.

c) Receive and securely store examination papers until the start time of each subject, organize the examination, and implement tasks to ensure its smooth conduct.

d) Collect examination papers, secure them, prepare records and files as required; hand over all examination papers, records, and files to the District Education and Training Office (for junior high examinations) or the Department of Education and Training (for secondary examinations).

đ) Supervise and urge members of the board and candidates to comply with the Examination Regulations.

2. Authorities:

a) Refuse to accept the examination venue if it does not meet the material conditions and safety requirements for the examination board, and report to the County Steering Committee and Inspection Team (for junior high schools) or the Provincial Steering Committee and Inspection Team (for secondary schools) for consideration and resolution.

b) Refuse to accept examination papers if signs of confidentiality breaches or difficulty in ensuring paper security are detected, and report to the higher-level Examination Inspection Steering Committee for instructions on handling.

c) Implement disciplinary measures ranging from reprimand to preparing a record recommending invalidation of the candidate's examination papers, disqualification from continuing the examination, or recommending a ban from examination for one to two years based on the severity of the violation of the Examination Regulations.

d) Implement disciplinary measures ranging from reprimand to suspension of duties for invigilators and other staff involved in the examination based on the severity of the violation of the Examination Regulations.

đ) Propose commendations to the competent authorities for staff, teachers, and candidates who have made contributions during the examination period.

e) Manage funds and organize examinations according to current financial regulations.

g) The Chairperson of the Board is responsible for managing and organizing the implementation of assigned tasks within the board.

Chapter 8:

GRADING BOARD FOR GRADUATION EXAMINATION

Article 25: General Provisions

1. Each provincial level may establish one or two Examination Boards for junior high school and high school graduation examinations depending on the number of candidates, management conditions, and material facilities.

2. The Examination Board shall have an independent sealing section responsible for assisting the Chairman in sealing, unsealing examination papers, transferring unsealed examination papers to marking teams, and other specific tasks assigned by the Chairman.

3. Each Examination Board may have a computer section with the following specific duties:

a) Encoding the seals of examination papers.

b) Entering scores after each day of marking for each subject.

c) Entering scores of subjects in the name and score recording sheet, making copies to be sent to marking teams for verification.

d) Compiling lists of graduates and ranking graduation results.

đ) Preparing tables, charts, minutes, and reports as prescribed by the Chairman and as required by higher authorities.

4. The number of leaders, secretaries, examiners, sealing sections, computer sections, and service staff of each Examination Board shall be determined by the competent authority establishing the board based on requirements, tasks, and the specific number of examination papers.

5. All members and those performing service functions in the Examination Board must not have children, siblings, spouses, or wards who are participating in the examination.

Article 26: Composition of the Examination Board.

1. Examination Board for junior high school graduation:

a) Chairman:

a.1) If the provincial level establishes one board: Director or Deputy Director of the High School Department, or the Testing Department (if any).

a.2) If each district establishes one board: Director or Deputy Director of the Education and Training Department.

b) Vice Chairmen shall be selected from among the leadership and specialists of the High School Department, Testing Department (if any), Principals, and Deputy Principals of junior high schools. Each Vice Chairman shall be responsible for one subject or a group of related subjects.

c) Secretary shall be selected from among the specialists of the High School Department, Testing Department (if any), Education and Training Department, Principals, and Deputy Principals of junior high schools.

d) Examiners: Teachers from districts, counties, towns, cities under the province (hereinafter referred to as county level), currently teaching final-year subjects.

đ) If the results of the junior high school graduation examination are used as a basis for admission to grade 10 of high school, some high school teachers who teach the same subjects can be mobilized to join the Examination Board.

2. Examination Board for high school graduation:

a) Chairman: Deputy Director of the Department of Education and Training, in special cases, the Director or Deputy Director of the High School Department or Testing Department (if any) may replace the Director.

b) Vice Chairmen: Directors or Deputy Directors of the High School Department, Testing Department (if any), Principals, and Deputy Principals of high schools. Each Vice Chairman shall be responsible for one subject or a group of related subjects.

c) Secretary: Specialists of the High School Department, Testing Department (if any), Principals, and Deputy Principals of high schools.

d) Examiners: Teachers from high schools under the jurisdiction of the Department, currently teaching final-year subjects.

3. The number of leaders, secretaries, examiners, sealing sections, computer sections, and service staff of each Examination Board shall be determined by the competent authority establishing the board based on requirements, tasks, and the specific number of examination papers.

4. All members and those performing service functions in the Examination Board must not have children, siblings, spouses, or wards who are participating in the examination.

Article 27: Duties and Authorities of the Examination Board.

1. Duties of the Examination Board:

a) Receiving examination papers and examination files transferred by the Department of Education and Training (for high school examinations) or the Education and Training Department (for junior high school examinations).

b) Organizing the sealing process.

c) Organizing the marking of unsealed examination papers.

d) Organizing the unsealing process, scoring.

đ) Organizing the graduation assessment and ranking, compiling graduation lists.

e) Implementing quick reports and comprehensive marking result reports.

g) Summarizing the marking process and graduation assessment; completing minutes, statistics, reports, and examination files; transferring all examination papers and examination files to the Education and Training Department (for junior high school examinations) or the Department of Education and Training (for high school examinations).

2. Duties of the marking teams:

c) Check and review daily marking scores and scores of examination papers sent by the computerized department according to the Chairman of the Examination Marking Board's instructions.

b) Organizing joint marking of at least ten examination papers before individual marking and joint marking of special cases decided by the Chairman of the Examination Board.

c) Organizing the marking of examination papers according to the principle that two examiners independently mark one paper, as stipulated in Clause 1 of Article 10 of this Regulation.

d) Checking and reviewing daily marking scores and scores in the score recording sheet sent by the computer section as prescribed by the Chairman of the Examination Board.

đ) Preparing disciplinary recommendation minutes (if any) and reports on the marking results of the marking team.

3. Authorities of the Examination Board:

a) Reviewing and deciding to invalidate examination papers based on minutes of the Examination Supervision Board or through the discovery of student violations of the Regulations during the marking process as recorded by the marking team.

b) Disciplining members of the Board who violate the Regulations according to the severity of the violation and current regulations. Immediate suspension of the duty of a member who seriously violates the Regulations during marking may be proposed to the competent authority for consideration and decision.

c) Managing finances and implementing rewards or recommending rewards for those who excellently complete their tasks according to achievements.

d) The Chairman of the Board is responsible for managing and organizing the implementation of assigned tasks within the Board.

Chapter 9:

APPEAL BOARD

Article 28: General Provisions.

1. If there are appeals regarding examination scores, each provincial level shall establish an Appeal Board to review and resolve appeals regarding examination scores for both junior high school and high school examinations.

2. In necessary cases, the Ministry of Education and Training will establish a National Appeal Board:

a) The composition and number of members of the National Appeal Board shall be prescribed by the Minister of Education and Training.

b) The National Review Board is tasked with regrading examination papers and deciding to review the grading of regraded examination papers. The score of the examination paper is the regrading score of the National Board.

3. Other complaints about examinations (other than examination scores and examination records) shall be resolved by the Education Inspectorate.

Article 29: Composition of the provincial review board.

1. Chairman of the board: Director or Deputy Director of the Department of Education and Training.

2. Vice chairmen of the board:

- Head or Deputy Head of the High School Examination Department (if any).

- Chief or Deputy Chief of the Education Inspectorate of the Department.

3. Secretary: Specialist of the High School Department, Examination Department (if any), Inspectorate of the Department of Education and Training.

4. Examiners: Specialists with capability from the High School Department, Examination Department (if any), experienced teachers from secondary schools (for lower secondary schools), high schools (for upper secondary schools) who have taught or are currently teaching subjects in the final grade. Each subject must have at least one pair of regraders.

5. Individuals whose children, siblings, brothers-in-law, sisters-in-law, wards, or foster children have requested a review of their examination papers by the examination board shall not participate in the review board.

Article 30.: Tasks and Powers

1. Duties:

a) Reviewing complaint forms and examination records transferred by the Department of Education and Training, the Education and Training Sub-department.

b) Retrieving examination papers, creating new seals, organizing the regrading of examination papers according to the marking guidelines and scoring criteria stipulated for two examiners to mark independently on one examination paper.

c) Concluding the new score of the examination paper.

d) Preparing minutes, lists of students graduating or having their graduation classification changed due to score changes, dialogue minutes between the initial marking pairs and the regrading pairs (if any) to form the review file submitted to the Department of Education and Training.

4. In cases where the new score of the examination paper differs from the initial score by two points or more, the review board must organize a dialogue between the initial marking pair and the regrading pair. If there is no agreement between the two pairs regarding the score and no conclusion can be made about which pair has the error, the initial score shall remain unchanged.

5. Examination papers (and accompanying seals) that have been re-scored must be sealed and stored separately.

6. Lists and results of reviews shall be publicly announced and posted at each secondary school after being approved by the Department of Education and Training (for lower secondary schools) or the Ministry of Education and Training (for upper secondary schools).

7. The chairman of the board is responsible for managing and organizing the work of the board.

Chapter 10:

APPROVAL OF GRADUATION RESULTS AND ISSUANCE OF GRADUATION CERTIFICATES

RECORD KEEPING

Article 31: Approval of Graduation Results.

1. Preliminary Graduation Approval:

a) For lower secondary schools: The Education and Training Sub-department

b) For upper secondary schools: The Department of Education and Training

c) After preliminary approval results are obtained, lower secondary schools and upper secondary schools are permitted to publish temporary graduation lists for students. Temporary graduation certificates are signed by the principals of lower secondary schools and upper secondary schools and are valid until the issuance of the official certificate.

2. Official Approval:

a) For lower secondary schools: The Department of Education and Training

b) For upper secondary schools: The Ministry of Education and Training

c) The time for official examination approval follows the specific schedule of the Ministry of Education and Training and the Department of Education and Training.

Article 32: Issuance of Graduation Certificates.

1. The issuance of graduation certificates is carried out in accordance with regulations and guidelines issued by the Ministry of Education and Training.

2. The Director of the Department of Education and Training is responsible for managing and directing the issuance of lower secondary school graduation certificates, upper secondary school graduation certificates, copies of graduation certificates, and related certificates concerning bonus point awards and priority placement in graduation exams as stipulated and guided by the Ministry of Education and Training.

Article 33: Documents and Record Keeping.

1. The graduation examination documents for junior high school and high school include:

a) Name and Score Sheet

b) List of Students Recognized as Graduates

c) List and Files of Students Granted Special Graduation Status, Exempted from Examination, Allowed to Graduate, or Adjusted Graduation Classification After Re-examination or Resolution of Appeals Regarding Examination Records.

2. Graduation examination documents shall be kept long-term at the Education and Training Departments, Provincial Departments of Education and Training, and the Ministry of Education and Training according to regulations on分级管理。

3. Student files will be returned after the temporary list of graduates is announced.

4. Regulations on other types of documents shall be guided annually by the Ministry of Education and Training.

Article 34. Principles and Procedures of the Examination Board.

1. The Chairperson, Vice-Chairpersons, and the marking team must be present at the examination marking location beforehand to perform tasks reserved for the Board's leadership and marking. Specific times are determined by the Director of the Provincial Department of Education and Training based on the number of papers the Board needs to mark.

2. The marking team must be arranged in a separate workspace isolated from the examination marking teams' workspaces.

The marking team can only hand over marked papers and collect papers for re-marking through the Chairperson or a Vice-Chairperson authorized by the Chairperson.

During the marking process, apart from the leaders of the provincial education and training departments, the Chairperson, members of the steering committee and examination supervision team at higher levels, no one else may enter the marking team's workspace.

3. The team leader must control and direct the research group to strictly follow the examination marking guidelines. If there are unresolved questions or errors found in the text within the team, they must request guidance from the steering committee and examination supervision team, and absolutely must not independently change the marking guidelines or scoring criteria.

4. Before distributing papers to examiners, the team must jointly mark ten papers to ensure all team members thoroughly understand the marking guidelines. When scoring these joint-marked papers, "jointly marked" must be clearly noted along with the signatures of the team leader and an examiner.

5. Except for the jointly marked papers, each paper must be independently marked by two examiners who record scores separately according to the marking number. Only after both examiners have completed marking a paper can the team leader instruct them to agree on the final score to be recorded on the paper and the score sheet, using both letters and numbers, and sign together. The score on the paper must be written in red ink. If the two examiners wish to change the score, they must cross out the original score, write the new score in both letters and numbers, and sign to confirm the score change.

6. The total score of each paper is the sum of the scores of each section. The minimum score for each section is 0.25. The overall score is an integer or decimal number ranging from 0 to 10, with the decimal part being either 0 or 5.

7. Apart from the Re-examination Board, no one has the authority to alter the score of a paper that has been agreed upon by two examiners.

8. It is strictly prohibited for the marking board to re-mark and change the scores of papers that have already been re-marked.

9. Recording scores on the name and score sheet in each examination room must be done by a marking team consisting of one reader, one recorder, and one checker. If there is a mistake, the scorer must cross out the incorrect score and write the correct score next to it. In the annotation section, the reason for changing the score must be noted. At the end of each score recording sheet, the names of the reader, recorder, and checker, along with the total number of score changes, must be clearly noted, and all three must sign.

In cases where the name and score sheets are created using computers, there must also be one reader, one floppy disk inserter, and one checker. At the end of the name and score sheet, the names of all three individuals must be clearly noted, and all three must sign.

Chapter 11:

APPEAL BOARD

Article 35. Examination Review.

1. Candidates have the right to request a review of their examination when their score is two points or more below the average score of the subject in their final class.

2. The application for review must be submitted to the Department of Education and Training within ten days from the date of announcement of the examination results.

3. The Review Board shall be established in one of the following cases:

a) There is an application for review as stipulated in Clause 2 of this Article.

b) The Director of the Department of Education and Training finds that there is an incorrect marking process not in accordance with the marking guidelines of the Examination Selection and Question Setting Committee.

c) The Steering and Inspection Committee of the Ministry requests it.

Article 36. The Review Board.

1. The Review Board is an organization established to re-evaluate the results of reviewed examinations according to Clause 3 of Article 35.

2. Composition of the Review Board:

a) The Chairman of the Board is the Director or Deputy Director of the Department of Education and Training.

b) The Vice-Chairman of the Board is the Head of the Continuous Education Division or the Head of the relevant department of the Department of Education and Training.

c) The Secretary of the Board is the specialist responsible for supplementary education examination work at the Department of Education and Training.

d) Examiners are teachers who are well-versed in the subject matter and consistently demonstrate fairness and accuracy during the marking process.

Individuals accused of violating the Regulations shall not participate in the Review Board.

Article 37. Duties, powers, principles, and working procedures of the Review Board.

The duties, powers, principles, and working procedures of the Review Board are the same as those prescribed for the Examination Marking Board.

The Chairman of the Board is responsible for re-numbering the examination papers to maintain the confidentiality of the candidates' names.

The Review Board will adjust the scores of the examination only if the re-marked score differs from the previous marked score by one point or more.

Article 38. Time limit for review.

The review process must be completed before the fifteenth day from the date of announcement of the examination results and must be finished within ten days. The review results must be publicly announced after being approved by the Ministry of Education and Training.

Chapter 12:

REVIEW AND RECOGNITION OF EXAMINATION RESULTS.

Article 39. Review and Recognition of Examination Results.

The Director of the Department of Education and Training is responsible for reviewing and recognizing the examination results of the Supplementary Secondary School Graduation Examination Board. Preliminary review of the examination results of the Supplementary High School Graduation Examination Board.

The results of the Supplementary High School Graduation Examination are officially announced after being approved by the Ministry of Education and Training.

Examination results must be publicly announced at the District, County, City Education and Training Office or the Continuous Education Center or the Supplementary Cultural Education School.

Article 40. Responsibilities and powers of the Director of the Department of Education and Training in preliminary review and recognition of examination results.

1. Responsibilities:

- Check the list of graduates proposed by the Examination Board.

- Sign off on the list of graduates and issue graduation certificates to candidates after receiving approval from the Ministry.

2. Authorities:

- Cancel the results of the Supplementary Secondary School Graduation Examination.

- Cancel the examination results of candidates or examination rooms in the Supplementary High School Graduation Examination.

- Propose the Ministry of Education and Training to cancel the results of a Supplementary High School Graduation Examination Board.

Article 41. Examination Files.

Examination report files sent by the Department of Education and Training to the Ministry include:

1. For the Supplementary High School Graduation Examination:

- Report on the supervision of the examination period by the Department of Education and Training, accompanied by various statistical data;

- List of candidate names and examination scores;

- List of graduates;

- Decisions establishing the steering and inspection committee, question printing board, invigilation and marking boards;

- Minutes of the invigilation and marking boards;

- Other minutes related to the Supplementary High School Graduation Examination;

- Review file (if any) including: Decision to establish the review board, summary minutes, list of graduates after review and other related minutes.

2. For the Supplementary Secondary School Graduation Examination:

- Report on the organization of the examination and examination results;

- Decision to establish the Examination Question Setting Board;

- A set of examination questions and marking guidelines;

3. Deadline for submission:

- All files above must be available at the Ministry (Department of Continuous Education) no later than twenty-five days from the last examination date.

- All review files (if any) must be available at the Ministry (Department of Continuous Education) no later than fifty days from the last examination date.

Article 42. Storage of Examination Files.

1. The Department of Education and Training, the Military School Administration Bureau of the Ministry of National Defense store:

a) Indefinitely:

- List of candidate names and examination scores;

- List of graduates;

- Graduation certificate issuance book.

b) For three years:

- Decisions establishing Supplementary High School Graduation Examination Boards;

- Candidate appeal files;

- Disciplinary files.

c) For one year:

- Decisions establishing Supplementary Secondary School Graduation Examination Question Setting Boards;

- Examination questions and marking guidelines (including envelopes containing examination questions);

- Various types of minutes;

- Candidates' examination papers;

- Other types of files.

2. Storage time limit: Calculated from the last examination date of each examination period.

3. Examination application files of candidates are returned to the District Education and Training Offices, Continuous Education Centers, or Supplementary Schools for return to candidates after completing all examination tasks.

Chapter 13:

DIRECTING AND INSPECTING COMMITTEE FOR THE EXAMINATION

1. The "Labor Medal" second class shall be awarded or posthumously awarded to individuals meeting one of the following criteria:. The Directing and Inspecting Committee for Examinations of the Ministry of Education and Training.

Annually, the Ministry of Education and Training establishes the Directing and Inspecting Committee for final examinations.

1. Composition:

a) The Chairperson shall be held by a Deputy Minister of the Ministry of Education and Training.

b) The Vice-Chairpersons shall be held by Heads or Deputy Heads of the Department of Continuing Education, the Department of Secondary General Education, and some leaders of relevant agencies under the Ministry.

c) Members shall be officials from the Department of Continuing Education, the Department of Secondary General Education, and some officials from relevant agencies under the Ministry.

2. Duties and powers of the Directing and Inspecting Committee of the Ministry with respect to the final examination for secondary general education and basic secondary education supplementary courses:

- Direct, inspect, and supervise the organization of the examination by localities and in the military.

- Suspend the examination and invalidate the results at places where there is a violation of the Examination Regulations and other guiding documents on organizing the examination issued by the Ministry.

- Suspend the participation of members of the Examination Board, security personnel, and service staff in the examination, and members of lower-level Directing and Inspecting Committees when they violate the Examination Regulations and other guiding documents on organizing the examination or lack the capacity to perform their duties.

- Request the Department of Education and Training to establish a Re-examination Board when the marking of the Examination Board is found to be inaccurate.

- Propose the Minister to commend units and individuals with outstanding achievements or to impose disciplinary actions on units and individuals who violate the Examination Regulations.

The directing, inspecting, and supervising of examinations in localities or in the military may be carried out by a member or a team consisting of multiple members of the Directing and Inspecting Committee.

Chapter 14:

REWARD AND DISCIPLINE

Article 44 |||. Awards

Recipients: cadres, teachers, students, and service staff who have achieved notable results in organizing the examination.

Forms of commendation:

Commendation before the Examination Board and notification to the school.

The Director of the Department of Education and Training issues a certificate of merit.

The Director of the Department of Education and Training of the province issues a certificate of merit.

The Chairman of the People's Committee of the district issues a certificate of merit.

(d) The Chairman of the People's Committee of the province issues a certificate of merit.

(e) The Minister of Education and Training issues a certificate of merit.

Responsibilities in commendation:

The Examination and Marking Board is responsible for reviewing, deciding on commendations within its authority, and preparing lists to propose commendations to competent authorities for cadres, teachers, and students with outstanding achievements.

The Department of Education and Training (for junior high schools), the Department of Education and Training (for senior high schools) is responsible for establishing files and implementing commendations according to current regulations on competition based on the proposals of the Examination Board and the Marking Board.

Article 45. Disciplinary Actions

For Cadres, Teachers, and Service Staff

The implementation of disciplinary actions against civil servants who are leaders, teachers, and service staff in organizing final examinations shall be carried out in accordance with the provisions of Decree No. 97/1998/ND-CP dated November 17, 1998 of the Government on disciplinary measures and material responsibility for civil servants and Circular No. 05/1999/TT-TCCP dated March 27, 1999 of the Civil Service Organization and Cadre Management Council guiding the implementation of this Decree.

For those who are not civil servants participating in final examinations, penalties shall be implemented in accordance with the provisions of labor contracts and current laws.

For cadres, teachers, and service staff involved in examination work if they violate regulations while performing their duties at examination boards and their actions directly affect the examination, they must be recorded in a report and immediately suspended from their duties.

Authority to suspend:

The authority that decides to establish an examination board has the right to decide to suspend the work of the leadership of that board.

For Students:

Warning before the Examination Board if violating any of the following provisions:

a.1) Using any form to copy another student's answers, having been reminded twice but still continuing to violate.

a.2) Allowing another student to see their answers or passing notes to them, having been reminded twice.

Not allowing them to continue the remaining subjects or invalidating their test papers if committing any of the following deficiencies:

b.1) Bringing materials related to the examination content into the examination room during the time from the start of reading the questions until the end of the examination period (whether used or not).

b.2) Receiving pre-prepared answers from outside through any means.

b.3) Using another person's examination paper (or scratch paper) to submit as their own answer or submitting similar answers due to copying each other, discovered by the examiner during marking.

Prohibiting them from taking the examination for one to two years if committing any of the following deficiencies:

c.1) Assaulting invigilators, examiners, or service staff of examination boards.

c.2) Causing disturbances leading to serious disruption of order in the examination area, seriously affecting the examination.

Any violations not specified in points a, b, c, and d of this article will be handled by the Educational Inspectorate together with the Secondary Education Department and the Examination Department (if any) upon discovering such violations, reporting to the Director of the Department of Education and Training to decide on disciplinary measures according to Clause 2 of Article 45 (including the revocation of the graduation certificate already issued).

Files and procedures for handling disciplinary actions against students taking the examination.

Files.

a.1) At Examination Boards:

Report at the time of violation, signed by the offending student, and signatures of two invigilators in the examination room.

Examination Board's report on disciplinary action (specifying the level of disciplinary action).

Evidence and physical evidence collected.

a.2) At Marking Boards:

Report of the marking team.

Examination Board's report on disciplinary action (specifying the level of disciplinary action).

Examination papers of the offending student.

Procedures.

b.1) Examination Board:

Review, decide, and announce warning and reprimand disciplinary actions before the Examination Board.

Prepare reports on other disciplinary actions not within the Board's authority to report to the competent authority.

b.2) Marking Board:

Review the disciplinary reports of Examination Boards transferred by the Department of Education and Training, Provincial Departments of Education and Training, and marking teams.

Decide on disciplinary actions and prepare reports proposing the level of disciplinary action.

b.3) The entire disciplinary file of students sent to the Department of Education and Training (for junior high school examinations), to the Provincial Department of Education and Training (for senior high school examinations).

The forms of disciplinary action against students participating in the examination must be announced to the examination board, secondary schools in the locality, notified to the parents of the students, and the locality where the students reside.
