Pursuant to the Law on Customs dated June 29, 2001;
Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 96/2002/NĐ-CP dated November 19, 2002 of the Government on the functions, tasks, powers, and organizational structure of the General Department of Customs;
At the proposal of the Director of the General Department of Customs, the Head of the Cadre and Training Department,
DECISION:
Article 1. The Anti-Smuggling Investigation Department is a unit under the General Department of Customs, with the function of assisting the Director of the General Department of Customs (hereinafter referred to as the Director) in managing, directing, guiding, and inspecting units within the customs sector to implement anti-smuggling and illegal cross-border transportation work; directly organizing the implementation of anti-smuggling and illegal cross-border transportation work according to the provisions of the law within the scope of assigned tasks.
Article 2. The Anti-Smuggling Investigation Department has the following tasks and powers:
1. To take the lead in researching and drafting or participating in drafting normative legal documents, management measures, and operational procedures for anti-smuggling work to be submitted to competent authorities for promulgation.
2. To direct, guide, and inspect customs units under provincial and municipal customs departments in implementing anti-smuggling and illegal cross-border transportation work as prescribed.
3. 4. Organize the storage of files and documents related to anti-smuggling and illegal cross-border transportation of goods in accordance with the provisions of the law and the General Department.
5. Propose and recommend to the Director-General of the General Department issues that need revision and supplementation regarding policies, systems, management measures, and operational procedures for anti-smuggling and illegal cross-border transportation of goods; propose the provision of necessary equipment and facilities to serve anti-smuggling work throughout the sector and inspect units in their management and use of such equipment, facilities, and techniques.
6. Implement international cooperation on anti-smuggling according to the division of labor by the Director-General of the General Department.
7. Summarize, evaluate, and statistically assess the situation and results of anti-smuggling work of the Customs sector as prescribed.
8. Organize research and application of scientific and technological progress in anti-smuggling work; participate in building programs, contents, and teaching vocational courses on anti-smuggling at vocational training institutions.
9. Directly transact with organizations and individuals both domestically and internationally; carry out operational measures to grasp situations, collect information, and receive reports and accusations about smuggling and commercial fraud to serve the assigned tasks.
10. Request units within the Customs sector to report and provide necessary information and documents related to anti-smuggling and illegal cross-border transportation of goods.
11. Sign directive, guidance, and explanatory documents related to the implementation of anti-smuggling and illegal cross-border transportation of goods tasks as prescribed by the Director-General of the General Department.
12. Manage staff, civil servants, and assets of the Bureau in accordance with regulations.
13. Perform other tasks assigned.
Article 3. The Anti-Smuggling Investigation Bureau has a Director and several Deputy Directors.
The Director is responsible to the Director-General of the General Department for all activities of the Bureau.
Deputy Directors are responsible to the Director for the tasks assigned by the Director.
Article 4The organizational structure of the Anti-Smuggling Investigation Bureau includes:
(1) Planning and Coordination Office
(2) Operational Office I (managing anti-smuggling investigation work at sea and through international seaport customs checkpoints)
(3) Operational Office II (managing anti-smuggling investigation work through international air and postal customs checkpoints)
(4) Operational Office III (managing anti-smuggling investigation work through international land, river, and railway customs checkpoints)
(5) Operational Office IV (managing anti-smuggling and drug trafficking investigation work across borders)
Specific tasks, staffing, and working relationships of these Offices are defined by the Director-General of the General Department.
In cases of necessity, the Director-General may establish surveillance, investigation teams, or special cases to perform anti-smuggling tasks assigned by the Director-General. These teams are directly managed and directed by the Director of the Anti-Smuggling Investigation Bureau during the execution of tasks and dissolved upon completion of the tasks.
Article 5. The Anti-Smuggling Investigation Bureau has legal personality, its own seal, and is allowed to open accounts at the state treasury in accordance with the law.
The operating budget of the Anti-Smuggling Investigation Bureau is provided from the budget of the General Department of Customs. The Anti-Smuggling Investigation Bureau is responsible for preparing the budget estimate and submitting it to the Director-General of the General Department for consolidation into the overall budget estimate of the General Department.
Article 6. The Director-General of the General Department of Customs specifies in detail the tasks, coordination mechanisms of the Anti-Smuggling Investigation Bureau with organizations and units both within and outside the Customs sector.
Article 7. This Decision shall take effect from the date of signing.
Repeal Decision No. 160/TCHQ-TCCB dated August 4, 1994, of the Director-General of the General Department of Customs on the functions, tasks, authorities, organizational structure, and working relationships of the Anti-Smuggling Investigation Bureau; Decision No. 618/QĐ-TCCB dated December 12, 2000, of the Director-General of the General Department of Customs on the organizational structure of the Anti-Smuggling Investigation Bureau; Decision No. 1469/QĐ-TCCB dated May 24, 2002, of the Director-General of the General Department of Customs on adjusting the anti-smuggling control offices in the northern and southern regions under the Anti-Smuggling Investigation Bureau.
Article 8. The Director-General of the General Department of Customs, the Director of the Anti-Smuggling Investigation Bureau, the Heads of the Cadre Organization and Training Department, the Financial Management and Administration Department, and the Director of the Ministry of Finance's Office are responsible for implementing this decision./.
