DECISION

Regarding the establishment of the National Monitoring and Environmental Warning Center,for marine environments

MINISTER OF AQUATIC RESOURCES

Pursuant to Decree No. 43/2003/NĐ-CP dated May 2, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Fisheries;

Pursuant to Decision No. 436/TS-QÐ dated August 19, 1983 of the Minister of Fisheries on the functions, tasks, powers, and organizational structure of the Institute of Marine Products Research;

Considering the proposal of the Director of the Institute of Marine Products Research at Proposal No. 281/VHS-TTr dated April 24, 2004 regarding the establishment of the National Monitoring and Environmental Warning Center for marine environments and aquatic diseases;

At the proposal of the Heads of the Personnel and Organization Department and the Science and Technology Department.

DECISION:

Article 1. Now establish the National Monitoring and Environmental Warning Center for marine environments based on the Marine Environment Research Room and the Marine Environment Monitoring and Analysis Station (hereinafter referred to as the Center) under the Institute of Marine Products Research.

The Center is a scientific public service unit with its own seal and separate account.

The Center's headquarters is located at 170 Le Lai Street, Ngo Quyen District, Hai Phong City.

Article 2. The Center has functions and tasks:

a. Functions:

Conducting research on marine environments, the relationship between the environment and resources, and the development of marine fisheries.

b. Tasks:

1. Proposing monitoring parameters and environmental warnings, disease control measures, pollution management solutions, and marine environmental protection.

2. Monitoring and providing information on quality indicators and current environmental conditions to serve the supervision, management, and protection of marine environments for the Institute and the Ministry.

3. Developing monitoring programs, networks, and environmental warning systems to promptly support sustainable aquaculture and resource development.

4. Cooperating with relevant agencies and centers within the industry in environmental protection and resource development activities.

5. Participating in providing data for the Vietnamese marine environment database. Collecting and providing environmental data for planning marine exploitation, cultivation, and establishing marine conservation areas.

6. Participating and cooperating with domestic and international organizations in marine science research and marine environmental protection according to the division of labor by the Institute and the Ministry, as stipulated by law.

7. Training and transferring technology related to environmental protection according to the requirements of central and local state management agencies.

Article 3. Organizational Structure of the Center

The Center has one Director, one to two Deputy Directors assisting, and specialized departments:

- Office (Comprehensive, Information, Administrative, Accounting).

- Fisheries Oceanography Research Department.

- Aquatic Life and Forecasting Research Department.

- Marine Environment and Forecasting Research Department.

- Several monitoring and warning stations.

The Center Director is appointed by the Minister of Fisheries upon the recommendation of the Director of the Institute of Marine Products Research. Deputy Directors and accounting staff are appointed by the Director of the Institute after obtaining the consent of the Ministry. The Center is permitted to employ contractual staff as required by its tasks. The Center's staffing and salary fund are included in the total staffing and salary fund allocated annually by the Ministry of Fisheries according to the plan.

The Center's operating funds are provided by the state budget, revenue from technical services within its assigned functions and tasks, and as prescribed by law.

Based on current regulations, the Director of the Institute of Marine Products Research shall develop operational regulations for the Center to be submitted to the Minister of Fisheries for approval.

Article 4. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

The Heads of the Office, the Director of the Institute of Marine Products Research, Heads of Departments, Bureaus, Inspectors, Heads of subordinate units of the Ministry, Directors of Fisheries Departments, Departments of Agriculture and Rural Development managing fisheries, and the Director of the Center are responsible for implementing this decision./.
