JOINT CIRCULAR
GUIDELINES FOR IMPLEMENTING THE REHABILITATION REGIME FOR PERSONS WITH MERIT IN THE REVOLUTIONARY STRUGGLE
Persons with Merit in the Revolutionary Struggle
- BASED ON Decree No. 28/ND-CP dated April 29, 1995 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Persons with Merit in the Revolutionary Struggle.
- TO IMPLEMENT Circular No. 6014/KGVX dated November 29, 1997 of the Prime Minister regarding the supplementation of policies for the rehabilitation of persons with merit in the revolutionary struggle.
The Ministry of Labour, Invalids and Social Affairs and the Ministry of Finance jointly issue guidelines for implementing the rehabilitation regime for persons with merit in the revolutionary struggle as follows:
I. ELIGIBLE PERSONS FOR REHABILITATION:
1. Persons eligible for annual rehabilitation:
1.1. Persons who were engaged in revolutionary activities before 1945.
1.2. Persons who were engaged in revolutionary activities before the August Revolution in 1945.
1.3. Mothers of Vietnam's Heroic Soldiers currently receiving monthly preferential allowances.
1.4. War invalids, persons treated like war invalids (including those war invalids classified as type B recognized before December 31, 1993), and sick soldiers with a disability rate due to injury or illness of 81% or more currently being cared for at home.
1.5. Persons who helped the revolution before the August Revolution in 1945 and have been awarded the Certificate of Merit for the Country, currently receiving monthly preferential allowances.
2. Persons eligible for rotational rehabilitation:
2.1. Relatives of martyrs (including relatives of two martyrs) currently receiving monthly maintenance allowances.
2.2. National Heroes of Armed Forces and National Labor Heroes currently receiving monthly preferential allowances.
2.3. Persons who were engaged in revolutionary activities or anti-French resistance and were captured and imprisoned by the enemy for many years, resulting in poor health, or persons who were sentenced to death by the enemy.
2.4. Persons who helped the revolution during the resistance and are now elderly, weak, lonely, without support, currently receiving monthly maintenance allowances.
II. METHODS, DURATION, AND EXPENSE LEVELS:
1. Method: Annually, based on the quota assigned by the Ministry of Labour, Invalids and Social Affairs, localities organize centralized rehabilitation or home-based rehabilitation for eligible persons.
2. Duration of centralized rehabilitation: Ten days (excluding travel time).
3. Rehabilitation expense levels:
3.1 Expense level for centralized rehabilitation: 800,000 VND per person for ten days, including:
- Breakfast and two main meals: 500,000 VND
- Nutritional supplements and common medications: 50,000 VND
- Gifts for the person upon return home: 50,000 VND
- Electricity and water costs for accommodation: 80,000 VND
- Other expenses (including: face towels, soap, toothbrushes, toothpaste, toilet paper, news broadcasts, cultural performances, sightseeing, photography, newspapers, sports, functional recovery...): 120,000 VND
During centralized rehabilitation, if sudden illness occurs, the person will be referred for examination and treatment at the nearest hospital under the current medical insurance regulations.
3.2 Expense level for home-based rehabilitation: 600,000 VND per person. The expense level specified in this point shall be implemented from 2005.
III. SOURCES OF FUNDS FOR REHABILITATION:
1. Funds allocated according to the rehabilitation standards stipulated in Point 3 of Part II of this Circular shall be guaranteed by the State Budget according to the annual plan announced.
2. Funds for transportation and other expenses (if any) for persons undergoing centralized rehabilitation shall be provided by the local budget from the social security funds allocated annually.
3. Rehabilitation funds shall be issued, used, and settled according to the current regulations of the State.
IV. IMPLEMENTATION ORGANIZATION:
1. Annually, based on the total rehabilitation funds announced by the State and the actual number of eligible persons for rehabilitation in each locality, the Ministry of Labour, Invalids and Social Affairs shall coordinate with the Ministry of Finance to allocate funds and notify localities to implement them.
It is strictly prohibited to use rehabilitation funds for purposes contrary to the provisions of this Circular.
2. Based on the rehabilitation funds announced by the Ministry of Labour, Invalids and Social Affairs and the needs of eligible persons, the Department of Labour, Invalids and Social Affairs shall submit to the People's Committee of the province or centrally-administered city for decisions on persons eligible for rehabilitation as stipulated in Point 2 of Part I of this Circular.
Centralized rehabilitation for persons with merit in the revolutionary struggle shall primarily be carried out at the Rehabilitation Centers for Persons with Merit under the Labour, Invalids and Social Affairs sector. Localities that cannot regularly transport eligible persons to Rehabilitation Centers due to special circumstances may organize several rehabilitation sessions at healthcare facilities or trade union centers in their locality according to the decision of the provincial People's Committee.
3. In addition to the centralized rehabilitation method, to suit the injuries, illnesses, and health conditions of eligible persons, localities may use part of the funds for home-based rehabilitation at a cost of 600,000 VND per person. The Department of Labour, Invalids and Social Affairs shall coordinate with the Department of Finance to submit to the provincial People's Committee for decisions and organization of home visits, provision of medication, and guidance on appropriate diets to improve the health of persons undergoing home-based rehabilitation.
4. This Circular takes effect 15 days after its publication in the Official Gazette, replacing Circular No. 141/1999/TT-BTC dated December 7, 1999 of the Ministry of Finance on Guidelines for Implementing Rehabilitation Expense Levels for Persons with Merit in the Revolutionary Struggle.
Any difficulties encountered during implementation should be promptly reported to the Ministry of Labour, Invalids and Social Affairs and the Ministry of Finance for consideration and resolution.
