Amending and supplementing certain provisions of the Service Regulations for Non-Commissioned Officers and Soldiers of the Vietnam People's Army issued pursuant to Decree No. 54/CP dated August 7, 1995 of the Government

THE GOVERNMENT

On the basis of the Law on Government Organization dated December 25, 2001;

On the basis of the Law on Military Service dated December 30, 1981; the Law Amending and Supplementing Certain Provisions of the Law on Military Service dated December 21, 1990;

The Law Amending and Supplementing Certain Provisions of the Law on Military Service dated June 22, 1994 and the Law Amending and Supplementing Certain Provisions of the Law on Military Service dated June 14, 2005;

Considering the proposal of the Minister of National Defense.

DECREE:

Article 1. Amending and supplementing certain provisions of the Service Regulations for Non-Commissioned Officers and Soldiers of the Vietnam People's Army (issued pursuant to Decree No. 54/CP dated August 7, 1995 of the Government) as follows:

1. Amend and supplement Clause 2 of Article 2 as follows:

"2. Reserve non-commissioned officers and soldiers are divided into first-class reserve personnel and second-class reserve personnel:

a) First-class reserve personnel include:

Non-commissioned officers and soldiers who have served the required term or longer; non-commissioned officers and soldiers discharged before the required term but having served at least six months; non-commissioned officers and soldiers who have participated in combat; male second-class reserve personnel who have completed centralized training for at least six months.

b) Second-class reserve personnel include:

Non-commissioned officers and soldiers discharged before the required term but having served less than six months; male citizens aged 26 or older who have been transferred to the reserve status; female citizens who have registered for military service as prescribed in Article 4 of the Law on Military Service".

2. Amending and supplementing Clause 3, Article 2 as follows:

"3. Reserve non-commissioned officers and soldiers in each class are divided into two groups: Group A includes male citizens up to 35 years old and female citizens up to 30 years old; Group B includes male citizens from 36 to 45 years old and female citizens from 31 to 40 years old".

3. Amend and supplement Article 6 as follows:

"Article 6:
1. The ranks and positions of non-commissioned officers and soldiers are defined as follows:
a) Private Second Class, Private First Class: Soldier;
b) Corporal: Deputy Squad Leader;
c) Sergeant: Squad Leader;
d) Staff Sergeant: Deputy Company Commander.
2. The ranks and positions equivalent to those specified in Clause 1 of this Article shall be prescribed by the Minister of National Defense".

"Article 8. Liquidity ratio, in case microfinance organizations have a risk of losing the ability to pay, losing the ability to pay

"Article 8. Non-commissioned officers and soldiers who violate military discipline or national laws shall be punished according to the Rules of Military Unit Management of the Vietnam People's Army and national laws".

''Article 16. Non-commissioned officers and soldiers on active duty enjoy benefits as prescribed in the Law on Military Service dated December 30, 1981; the Law Amending and Supplementing Certain Provisions of the Law on Military Service dated December 21, 1990; the Law Amending and Supplementing Certain Provisions of the Law on Military Service dated June 22, 1994; the Law Amending and Supplementing Certain Provisions of the Law on Military Service dated June 14, 2005 and policies stipulated in Government Decrees. Specifically as follows:

1. Ensuring timely provision of material standards as prescribed in Decree No. 123/2003/NĐ-CP dated October 22, 2003 of the Government.

2. From the second year onwards, they are entitled to leave.

3. Additional allowances from the 19th month and the 25th month onwards shall be implemented as prescribed in Clause 1, Clause 2, and Clause 3 of Article 2 of Decree No. 122/2006/NĐ-CP dated October 26, 2006 of the Government.

4. They are counted as members of their family when the family is allocated or adjusted housing area, land for building houses, and agricultural land.

5. The time served on active duty by non-commissioned officers and soldiers counts towards social insurance contributions.

6. They are given priority in purchasing tickets for travel by means of transport belonging to various economic sectors.

7. They are granted postal fee discounts as prescribed by the Prime Minister".

"Article 17. Non-commissioned officers and soldiers upon discharge are entitled to benefits as prescribed in Article 4 of Decree No. 122/2006/NĐ-CP dated October 26, 2006 of the Government".

"Article 18. Non-commissioned officers and soldiers with a two-year active service term upon discharge are entitled to benefits as prescribed in Clause 4 of Article 4 of Decree No. 122/2006/NĐ-CP dated October 26, 2006 of the Government".

8. Amend Article 19 as follows:

"Abolishing Article 19 which provides for public work obligations".

9. Amending and supplementing Article 20 as follows:

"Article 20. Reserve personnel during concentrated training, combat readiness inspection, their families are subsidized as follows:

1. For first-class reserve personnel:

a) Families of first-class reserve personnel receiving salary or wages are entitled to daily subsidies equal to 0.05 times the minimum wage level;

b) Families of first-class reserve personnel not receiving salary or wages are entitled to daily subsidies equal to 0.1 times the minimum wage level;

2. For second-class reserve personnel:

a) Families of second-class reserve personnel receiving salary or wages are entitled to daily subsidies equal to 0.025 times the minimum wage level;

b) Families of second-class reserve personnel not receiving salary or wages are entitled to daily subsidies equal to 0.05 times the minimum wage level".

12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentThis Decree takes effect 15 days after its publication in the Official Gazette, all previous regulations contrary to this Decree are abolished.

Article 3. The Minister of National Defense shall guide the implementation of this Decree.

Article 4. The Ministers, Heads of ministerial-level agencies, Heads of government-attached agencies, Chairpersons of provincial People's Committees under the central city shall be responsible for implementing this Decree./.
