THE MINISTER OF CONSTRUCTION
Pursuant to Decree No. 17/2008/NĐ-CP dated February 4, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
Considering the proposal of the Director of the Construction Economy Department,
Amending and supplementing certain contents of the Framework Training Program for Construction Cost Estimation Business Skills issued together with Decision No. 01/2008/QD-BXD dated February 1, 2008 of the Minister of Construction as follows:
DECISION:
Article 1. 1. Amend and supplement Point a, Clause 3, Part I as follows: "Have a Business Registration Certificate or Establishment Decision for entities without a Business Registration Certificate as prescribed by law. Among which, have functions and tasks related to training and enhancing business skills in fields of expertise related to the management of construction project investment costs."
2. Amend and supplement Point c, Clause 3, Part I as follows: "Have a teaching staff with professional qualifications and teaching experience that meet the requirements of the Framework Program issued by the Ministry of Construction. The teachers are lecturers, experts, and managers with at least seven years of experience in the field of managing construction project investment costs."
3. Amend and supplement Clause 4, Part I as follows: "Before conducting training and enhancing business skills in construction cost estimation, training institutions must submit one set of documents to the Ministry of Construction for inspection and review. If they meet the conditions, the Ministry of Construction will issue a permit for training and post it on the Ministry's website. The documents include the following:
a) Legal documents: A notarized copy (certified copy) of the Business Registration Certificate or Establishment Decision for entities without a Business Registration Certificate as stipulated in Clause 1, Article 1 of this Decision;
b) List of teaching staff prepared according to Model 2 attached to Decision No. 01/2008/QD-BXD and individual teaching contracts for each teacher (for civil servants, public officials, and state employees, the contract must be approved by the leadership of the agency); Notarized copies (certified copies) of the diplomas of the teachers;
c) Detailed training and teaching materials consistent with the Framework Program and the basic content of the training and enhancement programs for construction cost estimation business skills issued by the Ministry of Construction;
d) Information provision form related to the training institution such as: Legal representative, contact address, phone number, email, website."
4. Amend and supplement Point a, Clause 5, Part I as follows: "Ten days before organizing each training course, notify in writing the following contents: location, time, number of trainees, teachers (with attached contracts) to the Department of Construction, the place where the training is organized, and the Ministry of Construction."
5. Amend and supplement Point e, Clause 5, Part I as follows: "Report the results of training every six months including the following contents: Training course; Number and list of trainees participating in each training course, summary list (Name, date of birth, place of origin, ...); Number of trainees who have been issued a completion certificate for the training course to the Ministry of Construction and the Department of Construction where the main office is located and where the training is organized."
Amend and supplement Clause 3, Article 2, Chapter I of the Regulation on Issuing Certificates for Construction Cost Estimation Engineers issued together with Decision No. 06/2008/QD-BXD dated April 18, 2008 of the Minister of Construction as follows: "Individuals who are civil servants working in administrative agencies related to the management of construction project investment costs, sent by their agencies to study and meeting the conditions stipulated in Article 7 of the Regulation issued together with Decision No. 06/2008/QD-BXD, shall be issued a certificate for construction cost estimation engineers under this Regulation; The practice of consulting services by civil servants must comply with the laws on civil servants."

Article 3. Ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally governed cities, heads of training and enhancement institutions for construction cost estimation business skills, and relevant organizations and individuals are responsible for implementing this Decision./.
