Circular No. 17/2010/TT-BKHCN amends Article 5 of the Interim Regulations on the establishment and management of Science and Technology Projects, providing clearer criteria for determining the leading organization to implement Science and Technology Projects. Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
The Ministry of Science and Technology amends and supplements Article 5 of the Interim Provisions on the establishment and management of science and technology projects (hereinafter referred to as the Provisions) issued together with Decision No. 11/2005/QĐ-BKHCN dated May 28, 2005 of the Minister of Science and Technology as follows:
Article 1. Amending and supplementing Article 5 of the Provisions as follows:
"Article 5. Criteria for determining the leading organization to implement the Science and Technology Project The leading organization of the Science and Technology Project shall be a business entity or a scientific and technological organization having functions suitable for research or management and production of key products, and must meet the following conditions:
1. It has been assigned research tasks or implementation of investment projects for the production of products mentioned in Article 4 of these Provisions by the competent authority;
2. It has legal personality, sufficient capacity (material facilities, finance, human resources, ability to apply results to production...), sufficient capability to organize collaboration with other organizations to successfully implement the Science and Technology Project;
Article 2. 3. It bears responsibility for transferring and applying the results of the Science and Technology Project to production."
Article 3. This Circular takes effect from January 16, 2011.
Heads of units under the Ministry of Science and Technology; heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular.
