Guidelines for implementing functions, tasks, authorities, and organizational structure of Radio and Television Stations under
Provincial People's Committees, Radio and Television Stations under District People's Committees

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, authorities, and organizational structure of Ministries and ministerial-level agencies;
BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;
Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Home Affairs;
The Ministry of Information and Communications and the Ministry of Home Affairs issue guidelines for implementing the functions, tasks, authorities, and organizational structure of Radio and Television Stations under Provincial People's Committees, Radio and Television Stations, and Radio Stations under District People's Committees as follows:
PART I
RADIO AND TELEVISION STATIONS UNDER PROVINCIAL PEOPLE'S COMMITTEES
Article 1. Position and Functions
1. Radio and Television Stations under provincial people's committees (hereinafter referred to collectively as provincial-level Radio and Television Stations) are public service units under the provincial people's committee, performing the function of a press organ of the provincial Party Committee and government.
2. Provincial-level Radio and Television Stations are subject to state management in matters of press, transmission, and broadcasting by the Ministry of Information and Communications; the Department of Information and Communications implements state management within its jurisdiction according to the division of responsibilities assigned by the provincial people's committee.
3. Provincial-level Radio and Television Stations have legal personality, their own seals, and separate bank accounts.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Develop annual and long-term plans to fulfill assigned tasks; participate in building planning and development plans for radio, television, and broadcasting services, and organize the implementation of approved plans according to the division of responsibilities assigned by the provincial people's committee and competent authorities.
2. Produce and broadcast radio programs, television programs, and information content on electronic information websites in Vietnamese, ethnic languages, and foreign languages as prescribed by law.
3. Participate in developing radio and television services within the province.
4. Directly operate, manage, and exploit specialized technical systems to produce programs, transmit signals, and broadcast local and national radio and television programs in accordance with the provisions of law; coordinate with other agencies and organizations to ensure the safety of these technical systems.
5. Implement investment and construction projects; participate in appraising investment projects in the field of radio, television, and broadcasting according to the division of responsibilities assigned by the provincial people's committee and competent authorities as prescribed by law.
6. Coordinate with Vietnam Voice Radio and Vietnam Television to produce radio and television programs broadcast on national airwaves.
7. Provide professional guidance, technical training to district-level Radio and Television Stations or Radio Stations under district, city, and provincial-level people's committees according to the provisions of law.
8. Conduct scientific research and apply technological achievements in the fields of radio, television, and electronic information; organize training and professional development in radio and television technical specialties according to the provisions of law.
9. Participate in establishing economic and technical standards in the field of radio and television according to the division of responsibilities and levels; participate in establishing professional standards for the heads of district-level Radio and Television Stations and Radio Stations under district, city, and provincial-level people's committees for promulgation by the provincial people's committee.
10. Organize advertising, business, and service activities; accept sponsorship and support from domestic and foreign organizations and individuals according to the provisions of law.
11. Manage and utilize labor, materials, assets, and state budget funds, revenue from advertising, services, business operations, and sponsorships according to the provisions of law.
12. Implement salary policies, recruitment, incentives, rewards, disciplinary actions, and other regulations for civil servants and employees under their management according to the provisions of law.
13. Implement regular and extraordinary reporting requirements to supervising agencies, higher-level management agencies, and functional agencies regarding assigned work; organize competitive activities and awards according to the division of responsibilities and legal provisions.
14. Implement administrative reform, prevent corruption, waste, bureaucracy, arrogance, and other social evils within the unit; resolve complaints and denunciations within their authority and according to legal provisions.
15. Cooperate in inspections and checks on the implementation of policies and legal provisions; propose disciplinary measures against units and individuals violating regulations in radio, television, and broadcasting activities according to the division of responsibilities and legal provisions.
16. Implement information and archival duties according to legal provisions.
17. Perform other tasks assigned by the provincial people's committee according to legal provisions.
đ) Based on the regulations on the delegation of organizational and cadre management, the Director of the Department decides or submits to the competent authority for decisions regarding the appointment and dismissal of heads and deputy heads of units under the Department according to the position standards set by the provincial people's committee;
1. Organizational Structure.
a) Specialized departments of provincial-level Radio and Television Stations established uniformly include:
Department of Organization and Administration;
Department of News;
Department of Editing;
Department of Electronic Information;
Department of Arts and Entertainment;
Department of Technology and Engineering;
Department of Services and Advertising.
b) Additional departments may be established based on the characteristics of each locality, ensuring comprehensive coverage of all operational areas, clear functions, and non-overlapping responsibilities. The number and names of additional specialized departments shall be determined by the Director of provincial-level Radio and Television Stations in coordination with the Director of the Department of Home Affairs, subject to approval by the provincial people's committee according to legal provisions.
The Director of provincial-level Radio and Television Stations shall define the tasks, authorities of departments, and responsibilities of department heads according to legal provisions.
c) Public service units under provincial-level Radio and Television Stations (if any) include:
Television Film Production Center;
Other public service units;
The aforementioned public service units shall be decided upon by the Provincial People's Committee in accordance with the provisions of the law.
d) Leadership of the provincial Radio and Television Station:
The provincial Radio and Television Station shall have a Director and not more than three (3) Deputy Directors. The Director and Deputy Directors shall be appointed and relieved from their positions by the Provincial People's Committee after reaching a written agreement with the Ministry of Information and Communications.
The Director of the provincial Radio and Television Station shall be responsible to the Provincial People's Committee and the law for all activities of the agency. The Deputy Directors shall assist the Director and be responsible to the Director and the law for the areas of work assigned to them.
2. Quota
The staffing of the provincial Radio and Television Station shall be public service staffing, decided upon by the Provincial People's Committee in accordance with the provisions of the law.
The Director of the provincial Radio and Television Station shall arrange and utilize officials in accordance with their titles and qualifications as prescribed by law.
Chapter II
RADIO AND TELEVISION STATION UNDER THE PROVINCE PEOPLE'S COMMITTEE
1. The position and functions of the Social and Cultural Department shall be carried out in accordance with Article 11 of Decree No. 150/2025/NĐ-CP.
1. The Radio and Television Station or the County Radio Station, town radio station, city radio station under province (hereinafter referred to collectively as the county-level Radio and Television Station) is a unit directly under the County People's Committee, performing the function of being the propaganda organ of the Party Committee and local government at the county level.
2. The county-level Radio and Television Station shall be directly managed by the County People's Committee, subject to state management by the Department of Information and Communications, and technical guidance by the provincial Radio and Television Station.
3. The County People's Committee shall stipulate the functions, tasks, and organizational structure of the county-level Radio and Television Station in accordance with the provisions of the law.
Article 5. Tasks and Powers
1. Producing and broadcasting programs in Vietnamese and ethnic languages on the loudspeaker system and radio transmission equipment provided to disseminate the Party's policies, State laws, focusing on local administrative directives, grassroots activities, popularizing scientific and technological knowledge, economic, cultural, social information, security and public order, exemplary good deeds and advanced models to the people in accordance with the provisions of the law.
2. Receiving and broadcasting programs of the Voice of Vietnam Radio, Vietnam Television, and provincial Radio and Television Station to meet the information reception needs of the people in accordance with the provisions of the law.
3. Directly managing the specialized technical systems to implement the receiving and broadcasting of radio and television programs in accordance with the provisions of the law.
4. Cooperating with the provincial Radio and Television Station to produce radio and television programs to be broadcast on the provincial Radio and Television Station.
5. Managing and operating relay television stations and radio broadcasting stations within the area as assigned. Providing professional and technical guidance to village, ward, and town radio stations within the area.
6. Managing and utilizing labor, assets, budget, and revenue from services; implementing policies for officials and workers under its jurisdiction in accordance with the provisions of the law.
7. Implementing regular and ad hoc reporting systems as required by supervisory authorities. Participating in professional activities organized by higher-level agencies. Organizing commendation and reward activities in accordance with the law.
8. Participating in opinions with the County People's Committee and competent agencies to consolidate and expand the radio and television industry within the area.
9. Performing other tasks assigned by the County People's Committee in accordance with the provisions of the law.
Article 6. Organization and Staffing
1. The county-level Radio and Television Station shall have a Station Chief, Deputy Chiefs, and an assisting staff. The Station Chief and Deputy Chiefs shall be appointed and relieved from their positions by the County People's Committee in accordance with the provisions of the law.
2. The Station Chief shall be responsible to the County People's Committee and the law for all activities of the station. The Deputy Chiefs shall assist the Station Chief and be responsible to the Station Chief for the tasks assigned to them.
3. The staffing of the county-level Radio and Television Station shall be public service staffing, ensuring the fulfillment of assigned tasks. The number of staff members of the county-level Radio and Television Station shall be decided by the County People's Committee within the total annual public service staffing quota allocated by the Provincial People's Committee in accordance with the provisions of the law.
Chapter III
IMPLEMENTATION
Article 7. Effective Date
This Circular shall take effect from September 15, 2010.
Article 8. Implementation organization
1. The Provincial People's Committee shall base this Circular:
a) To specify the tasks, powers, and organizational structure of the provincial Radio and Television Station. To guide the County People's Committees to specify the tasks, powers, and organizational structure of the county-level Radio and Television Stations.
b) The Chairman of the Provincial People's Committee shall be responsible for organizing and implementing this Circular.
2. In the course of implementation, if there are arising issues or difficulties, the provincial and centrally-administered municipal People's Committees shall promptly report to the Ministry of Information and Communications and the Ministry of Home Affairs for examination and resolution within their respective jurisdictions./.
