CIRCULAR

Regulations on standards for positions working at

weigh-in-motion stations on roads

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Personnel Organization Department and the Director General of the Vietnam Highway Administration,

The Minister of Transport issues this Circular to stipulate the standards for positions working at weigh-in-motion stations on roads (hereinafter referred to as Stations).

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the standards for positions working at weigh-in-motion stations on roads (hereinafter referred to as Stations).

Article 2. Applicability

This Circular applies to positions working at Stations and agencies, organizations, and individuals related to the organization and operation of Stations.

Article 3. Positions Working at Stations

1. Station Director.

2. Deputy Station Director.

3. Shift Leader.

4. Technical Staff.

5. Other Staff.

Chapter II

STANDARDS FOR EACH POSITION

Article 4. General Standards

Positions working at Stations must meet the standards prescribed by laws on civil servants and public officials.

Article 5. Standards for the Station Director Position

1. Leadership, management, and organizational skills to direct the operations of the Station.

2. Professional qualifications:

a) Graduated from university or higher in one of the following majors: Transportation, construction, architecture, mechanical engineering, information technology, telecommunications, electricity, electronics, automation, law;

b) Meet the professional qualification standards of the specialist rank or equivalent and above;

c) Computer proficiency: Level B or higher;

d) Foreign language proficiency: Level B or higher in one of the five languages English, French, Russian, German, Chinese, or Lao, Khmer (for Stations located in border provinces adjacent to the Lao People's Democratic Republic and the Kingdom of Cambodia);

e) Proficient in technical standards, regulations, procedures, and operational practices related to weight inspection, handling violations, station operation and maintenance procedures, and able to skillfully operate equipment at the Station according to standards set by state agencies.

3. Work experience: At least five years of work experience in the transportation sector (at the specialist rank and equivalent or higher).

Article 6. Standards for the Deputy Station Director Position

1. Ability to lead, manage, and organize the operations of the Station to assume responsibilities when authorized by the Station Director.

2. Professional qualifications:

a) Graduated from university or higher in one of the following majors: Transportation, construction, architecture, mechanical engineering, information technology, telecommunications, electricity, electronics, automation, law;

b) Meet the professional qualification standards of the specialist rank or equivalent and above;

c) Computer proficiency: Level A or higher;

d) Foreign language proficiency: Level A or higher in one of the five languages English, French, Russian, German, Chinese, or Lao, Khmer (for Stations located in border provinces adjacent to the Lao People's Democratic Republic and the Kingdom of Cambodia);

e) Proficient in technical standards, regulations, procedures, and operational practices related to weight inspection, handling violations, station operation and maintenance procedures, and able to skillfully operate equipment at the Station according to standards set by state agencies.

3. Work experience: At least three years of work experience in the transportation sector (at the specialist rank and equivalent or higher).

Article 7. Standards for the Shift Leader Position

1. Professional qualifications:

a) Graduated from college or higher in one of the following majors: Transportation, construction, architecture, mechanical engineering, information technology, telecommunications, electricity, electronics, automation, law;

b) Computer proficiency: Level A or higher;

c) Foreign language proficiency: Level A or higher in one of the five languages English, French, Russian, German, Chinese, or Lao, Khmer (for Stations located in border provinces adjacent to the Lao People's Democratic Republic and the Kingdom of Cambodia);

d) Knowledge of technical standards, regulations, procedures, and operational practices related to weight inspection, handling violations, station operation and maintenance procedures, and able to skillfully operate equipment at the Station according to standards set by state agencies.

2. Work experience: At least two years of work experience in the transportation sector.

Article 8. Qualification Standards for Technical Staff Positions

1. Graduated from a vocational college or higher in one of the following majors: Transportation, Construction, Architecture, Mechanical Engineering, Information Technology, Telecommunications, Electrical Engineering, Electronics, Automation, Law.

2. Understanding technical standards, regulations, procedures, and relevant business practices related to vehicle weight inspection, handling of violations, operational and maintenance procedures at the Station; proficiently using equipment at the Station according to standards set by state agencies.

3. Computer proficiency: Achieving level B or higher for staff operating the control system at the Station.

Article 9. Other Staff Members

Other staff members working at the Station must have professional qualifications and skills appropriate to their job positions and work requirements.

Chapter III

IMPLEMENTING PROVISIONS

Article 10. Transitional Provisions

1. From the date this Circular takes effect, recruitment and appointment to positions at the Station must comply with the qualification standards stipulated in this Circular.

2. For those recruited or appointed to positions at the Station before the effective date of this Circular, they may continue to work at the Station and must meet all the qualification standards specified in this Circular:

a) Meeting the qualification standards set out in point a, Clause 2, Article 5; point a, Clause 2, Article 6; point a, Clause 1, Article 7 and Clause 1, Article 8 of this Circular before August 1, 2017;

b) Meeting the qualification standards set out in points c and d, Clause 2, Article 5; points c and d, Clause 2, Article 6; points b and c, Clause 1, Article 7 of this Circular before August 1, 2015.

Article 11. Effective Date

This Circular takes effect from August 1, 2014.

Article 12. Responsibility for Implementation

The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Highway Administration, Directors of Provincial Departments of Transport under central cities, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
