Pursuant to the Law on Competition and Reward;No. Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward 2013;

Article 1. Amend and supplement some articles of Circular No. 40/2014/TT-BCA as follows:i tiết thực hiện một sNo. 1. Amend Clause 1, Point b Clause 2 Article 6 as follows:, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPPursuant to the Law on Public Investment dated November 29, 2024;No. Article 2. Commemorative Medal "For the Cause of Inspection"i Clause 2. The Commemorative Medal has an emblem, shape, size, and color that reflect the characteristics of the Inspection sector in Vietnam, consistent with the general regulations of the State, accompanied by the Commemorative Medal is a Certificate of Award for the Commemorative Medal "For the Cause of Inspection".

Pursuant to Decree No. 106/2014/NĐ-CP dated November 17, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Political General Department of the People's Public Security;

The Minister of Public Security promulgates this Circular amending and supplementing some articles of concerning the classification and determination of state management authority in the field of crop production and plant protectionNo. “1. The General Political Department of the Public Security is the Permanent Agency assisting the Party Central Committee for Public Security, the Minister of Public Security, and the Board of Competition and Reward of the Ministry of Public Security in performing state management functions regarding competition and reward work in the People's Police, People's Security Ward, Civil Defense and the All-People Security Protection Movement.i 2. The Department of Building the All-People Security Protection Movement:For power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.5. SUPPORT MONITORING TOOLS:FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSb) Coordinate with the General Political Department of the Public Security to propose rewards for People's Security Wards, Civil Defense and the All-People Security Protection Movement.”i 2. Amend Article 17 as follows:

“Article 17. The Title "Flag of Excellence of the General Political Department of the Public Security"

1. The Title "Flag of Excellence of the General Political Department of the Public Security" shall be awarded to grassroots units under the Public Security, Fire Prevention and Fighting Force of provinces and centrally-administered cities and grassroots units under direct subordinate units of the Ministry that meet the following criteria:

a) Being a model unit among grassroots units that have achieved the standard for the title "Victory Unit" or "Outstanding Labor Collective";

b) Exceeding productivity and quality standards set out in the annual competition plan;

c) Effectively implementing competition movements, practicing thrift, preventing corruption and waste;

d) Receiving a trust vote from the Competition and Reward Council at the Bureau level or local public security agency of 80% or more.

2. The number of grassroots units eligible for the award of the "Flag of Excellence of the General Political Department of the Public Security" is specified as follows:

a) Each province-level public security agency is divided into four groups (group of departments under the force of Security, group of departments under the force of Police, group of departments under the force of Staff, Construction, Logistics, and Technical Services, and group of police stations in districts, counties, towns, and cities), each group is eligible for two flags, groups with over ten grassroots units are eligible for three flags, groups with over fifteen grassroots units are eligible for four flags, and groups with over twenty grassroots units are eligible for five flags;

b) Each provincial-level Fire Prevention and Fighting Force agency is divided into two groups (group of departments under the force of Staff, Construction, Logistics, and Technical Services, and group of combat units), each group is eligible for two flags, groups with over ten grassroots units are eligible for three flags, and groups with over fifteen grassroots units are eligible for four flags;

c) Direct subordinate units of the Ministry are eligible for two flags, units with over ten grassroots units are eligible for three flags, and units with over fifteen grassroots units are eligible for four flags.”

“3. Number of "Flag of Excellence of the Government":

a) Each competition cluster directly under the Ministry selects one Bureau-level or local public security agency unit with outstanding achievements leading among units meeting the standard for the title "Flag of Excellence of the Ministry of Public Security" to recommend for the award of the "Flag of Excellence of the Government";

b) Each General Department, Command, direct subordinate unit of the Ministry, provincial-level Fire Prevention and Fighting Force agency selects one outstanding grassroots unit leading among units meeting the standard for the title "Flag of Excellence of the Ministry of Public Security" to recommend for the award of the "Flag of Excellence of the Government";

c) The General Political Department of the Public Security is responsible for reviewing achievements, advising, and reporting to the Board of Competition and Reward of the Ministry of Public Security to select and recommend the award of the "Flag of Excellence of the Government" to outstanding and exemplary units, ensuring that the number of units receiving the "Flag of Excellence of the Government" does not exceed 20% of the total number of units receiving the "Flag of Excellence of the Ministry of Public Security."

4. Amend Clause 2, Clause 3, and Point b Clause 5 Article 20 as follows:

“2. Competition clusters of General Departments and equivalent units:

"3. Based on the budget allocation document from the competent authority (allocated at the beginning of the year or supplemented during the year), VCCI allocates funds to its subordinate units according to the regulations and approves detailed budgets for implementation, ensuring timely execution, compliance with approved procedures and plans, and the following specific provisions:

a) The General Political Department of the Public Security, the General Intelligence Department, the General Department of Criminal Enforcement and Judicial Support, the Mobile Police Command, each unit is a separate competition cluster.

b) The General Security Department is divided into two competition clusters.

c) The General Logistics and Technical Department is divided into two competition clusters: Cluster 1 includes units with functions of staff, management of logistics and technical affairs in the Public Security; Cluster 2 includes units of research, science, health, project management in the Public Security.

d) The General Police Department is divided into two competition clusters: Cluster 1 includes units serving combat and administrative management; Cluster 2 includes units directly engaged in combat.

3. Units directly under the Minister are divided into two competition clusters:

a) Cluster 1 includes seven units: the Office of the Ministry, the Foreign Affairs Department, the Legal and Administrative Reform Department, the Institute of Strategy and Science of Public Security, the Financial Department, the Inspectorate of the Ministry of Public Security, the Department of Building the All-People Security Protection Movement;

b) Cluster 2 includes six units: the Security Guard Command, the Cybersecurity Department, the Fire Prevention and Fighting Department, the Traffic Police Department, the Planning and Investment Department, the Cryptographic Department.

5. Organization of activities of the Competition Clusters:

b) The results of the election at the competition cluster are one of the bases for the General Political Department of the Public Security to propose and report to the Board of Competition and Reward of the Ministry of Public Security for review and approval of rewards for the annual competition movement summary.”

5. Amend Point c Clause 2 Article 24 as follows:

“c) Having been awarded a Certificate of Merit at the ministry or sector level, province level, central mass organizations, and continuously achieving the title "Victory Unit" for five consecutive years, including at least one time being awarded the "Flag of Excellence of the Ministry of Public Security."

6. Amend Point c Clause 2 Article 39 as follows:

b) Cluster 2 consists of six units: The Command of Security Guard, The Cybersecurity Bureau, The Fire Prevention, Firefighting and Rescue Bureau, The Traffic Police Bureau, The Planning and Investment Bureau, The Cryptographic Bureau.

5. Organization of activities of the Cluster Competition:

b) The results of the cluster competition are one of the bases for the Political Bureau of the People's Public Security to propose and report to the Ministry of Public Security's Awards Council for review and approval of annual commendation of the competition movement.

5. Amend point c, Clause 2, Article 24 as follows:

“c) Has been awarded a Certificate of Merit at the ministry, sector, provincial, or central mass organization level, and continuously achieved the title "Victory Unit" for the next five years, including at least one time being awarded the "Ministry of Public Security Flag of Excellence."

6. Amend point c, Clause 2, Article 39 as follows:

"c) For central agencies and enterprises under the responsibility of the General Bureau of Security for supervision: not exceeding the total number of ministries, ministerial-level agencies, and agencies under the Government."

7. Amend Point c Clause 2 and Clause 3 Article 42 as follows:

"2. The members of the Council include:"

"c) Members of the Council consist of: Deputy Ministers, the Director of the Political General Department of the People's Public Security, the Deputy Director of the Political General Department of the People's Public Security responsible for political and ideological work, and the Director of the Political Work Department."

"3. The Standing Office of the Council is the Political General Department of the People's Public Security."

8. Amend Point c Clause 2 Article 49 as follows:

"c) The Director of the Political General Department of the People's Public Security decides to confer the title of 'Advanced Soldier' and 'Model Soldier at the grassroots level' on the Directors and Deputy Directors of Provincial Public Security and Fire Prevention and Control Services; the Heads and Deputy Heads of Units under the Ministry at the Bureau level; and decides to confer the 'Flag of Excellence of the Political General Department of the People's Public Security' on grassroots units under Provincial Public Security and Fire Prevention and Control Services and Units under the Ministry."

9. Amend Clause 4 and Clause 5 Article 51 as follows:

"4. Public Security units and localities when proposing to confer commendations and awards within the authority of the Minister or national-level awards must report to the Political General Department of the People's Public Security for review and submit to the leadership of the Ministry for decision."

"5. Foreign rewards:"

"a) The Foreign Affairs Department reports and seeks opinions from the Ministry's leadership on reward policies and submits to the Ministry's leadership for signature of exchange documents with the Ministry of Foreign Affairs before coordinating with the Political General Department of the People's Public Security to handle procedures for awarding forms."

"b) Public Security units and localities proposing rewards report to the Ministry (through the Foreign Affairs Department) to coordinate with the Political General Department of the People's Public Security to handle procedures for awarding."

10. Amend Clause 2 Article 55 as follows:

"2. Public Security units and localities establish files to propose the conferment of the titles of 'Excellence Soldier throughout the National Public Security Force' and 'Excellence Soldier nationwide', submitting them to the Ministry's Commendation and Reward Council (through the Political General Department of the People's Public Security) for examination and decision or for examination and submission to the Prime Minister for decision."

11. Amend Clause 3 Article 56 as follows:

"3. Files proposing the conferment of the 'Flag of Excellence of the Political General Department of the People's Public Security' for grassroots units are submitted to the Political General Department of the People's Public Security's Commendation and Reward Council (through the Political Work Department) for examination and decision."

12. Amend Clause 3 Article 57 as follows:

"3. Public Security units and localities establish files to propose the conferment of the 'Flag of Excellence of the Ministry of Public Security', submitting them to the Ministry's Commendation and Reward Council (through the Political General Department of the People's Public Security) for examination and decision."

13. Amend Clause 2 Article 58 as follows:

"2. Public Security units and localities establish files to propose the conferment of the 'Flag of Excellence of the Government', submitting them to the Ministry's Commendation and Reward Council (through the Political General Department of the People's Public Security) for examination and submission to the Prime Minister for decision."

14. Amend Clause 2 Article 59 as follows:

"2. Public Security units and localities establish files to propose the conferment of state-level rewards, submitting them to the Ministry's Commendation and Reward Council (through the Political General Department of the People's Public Security) for examination and submission to the competent authority for decision."

15. Amend Clause 2 Article 60 as follows:

"2. Public Security units and localities cooperate with the Foreign Affairs Department to seek approval for rewards from the Ministry of Public Security and the Ministry of Foreign Affairs before establishing files to submit to the Ministry's Commendation and Reward Council (through the Political General Department of the People's Public Security) for examination and submission to the competent authority for decision."

16. Amend Clause 2 Article 61 as follows:

"2. Public Security units and localities establish files to propose the conferment of the 'National Security Merit Medal' and 'Brave Soldier Medal', submitting them to the Ministry's Commendation and Reward Council (through the Political General Department of the People's Public Security) once before August 30 each year."

17. Amend Clause 2 Article 62 as follows:

"2. Public Security units and localities establish files to propose the conferment of the 'Minister of Public Security Commendation', submitting them to the Minister (through the Political General Department of the People's Public Security) for examination and decision."

18. Amend Clause 2 Article 64 as follows:

"2. Public Security units and localities establish files to propose the conferment of the titles of 'Hero of the People's Armed Forces' and 'Hero of Labor', submitting them to the Ministry's Commendation and Reward Council (through the Political General Department of the People's Public Security) for examination and submission to the competent authority for decision."

19. Amend Clause 1 Article 66 as follows:

"1. For state-level commendations and awards (Medals, Medallions, State Honorary Titles, 'Excellence Soldier nationwide', 'Prime Minister's Commendation'): Public Security units and localities establish files to propose rewards, submitting them to the Minister of Public Security (through the Political General Department of the People's Public Security) for review, reporting to the Minister for examination and decision, and submission to the Prime Minister."

20. Amend Article 72 as follows:

"Article 72. Implementation"

"1. The Political General Department of the People's Public Security is responsible for inspecting and urging the implementation of this Circular."

"2. The Finance Department is responsible for guiding the implementation of the system of fund establishment, management, and use of commendation and reward funds in the People's Public Security, Village Public Security, and Civil Defense and the mass movement for national security protection in accordance with current laws."

"3. The Directors of the General Departments, heads of units under the Ministry, Directors of Provincial Public Security and Fire Prevention and Control Services are responsible for organizing the implementation of this Circular."

"During the implementation process, if there are difficulties or obstacles, Public Security units and localities, organizations, and individuals concerned should reflect to the Ministry of Public Security (through the Political General Department of the People's Public Security) for timely guidance."

Article 2. Effective date: January 02, 2017.ệnto effecsignature on paper vouchers in accordance with the law on electronic transactions; 1. This Circular takes effect from February 15, 2026; Circular No. 24/2013/TT-BKHCN dated September 30, 2013 of the Minister of Science and Technology on activities related to calibration, verification, testing of measuring instruments, and measurement standards shall cease to be effective from the date this Circular takes effect.

This Circular takes effect from June 20, 2015.
