CIRCULAR

Providing for material infrastructure, equipment, and training of specialized staff for water motor sports

on the sea

Pursuant to the Law on Physical Culture and Sports dated November 29, 2006;

Pursuant to Decree No. 106/2016/NĐ-CP dated July 1, 2016 of the Government stipulating conditions for operating sports activities;

Pursuant to Decree No. 79/2017/NĐ-CP dated July 17, 2017 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director-General of the General Department of Physical Training and Sport;

The Minister of Culture, Sports and Tourism promulgates this Circular providing for material infrastructure, equipment, and training of specialized staff for water motor sports on the sea.

Article 1. Scope of Regulation

Article 1. This Circular provides for material infrastructure, equipment, and training of specialized staff to meet requirements for practicing, competing, and performing water motor sports on the sea.

Article 2. Standards for material infrastructure and equipment for high-performance sports training and competition in water motor sports on the sea shall be implemented in accordance with Article 43 of the Law on Physical Education and Sports.

Article 2. Applicability

This Circular applies to organizations and individuals organizing training, competition, performance, and training of specialized staff for water motor sports on the sea in Vietnam.

Article 3. Infrastructure

Clause 1. The area for water motor sports must satisfy the following requirements:

a) Defined by a system of mooring buoys and positioning flags;

b) Mooring buoys and positioning flags have contrasting colors with the water and surrounding environment for easy observation; the distance between mooring buoys and positioning flags is at most 50 meters. Mooring buoys are spherical; diameter is at least 30 centimeters; materials used for mooring buoys must not cause environmental pollution. Positioning flags are rectangular, with dimensions of 25 centimeters x 30 centimeters;

c) Depth is at least 2 meters, without underwater rocks, coral reefs, marine structures, bathing areas, or other obstacles;

d) Distance from the shoreline to the outer limit of the activity area is at most 650 meters and to the inner limit of the activity area is at least 60 meters.

Clause 2. The distance between the entrance and exit of each mooring area is at least 250 meters. The entrance and exit of the mooring area must have a width of at least six meters.

Clause 3. There must be a sanitation area, changing room, and storage space for personal items for participants; first aid kits and other initial rescue equipment suitable for training, performance, and competition in water motor sports on the sea.

Clause 4. A set of rules must be placed in easily visible locations within the starting area, entrance, and exit of the mooring area.

The set of rules must include the following main contents: Training hours; individuals who are not allowed to participate in training, competition, and performance; training, competition, and performance attire; safety measures during training, performance, and competition; prohibition of operating vehicles outside the defined activity area marked by mooring buoys and positioning flags; and other regulations.

Article 4. Equipment

Clause 1. The engine of the water motor must have horsepower capacity appropriate to the technical design of the vehicle.

Clause 2. Water motors put into operation must meet quality, technical safety, and environmental protection standards as prescribed by law.

Clause 3. Communication and rescue systems

a) A communication system ensuring requirements for communication from the control and rescue team to the water motor sports activity area;

b) An observation station ensuring full coverage of the water motor sports activity area;

c) Rescue boats; at least five life jackets on each rescue boat;

d) Ensuring that each person has at least one life jacket.

Article 5. Ratio of Training Guidance

Each instructor may guide no more than one person at a time during training.

Article 6. Training of Specialized Staff

Article 1. The General Department of Physical Education and Sports, national-level social-professional organizations for water motor sports on the sea, or provincial Departments of Culture, Sports and Tourism, or provincial Departments of Culture and Sports organize specialized training for instructors and rescue personnel in water motor sports on the sea.

Article 2. The General Department of Physical Education and Sports is responsible for developing the content and program for specialized training for instructors and rescue personnel in water motor sports on the sea, to be decided by the Minister of Culture, Sports and Tourism.

Article 3. Certificates of specialized training for instructors and rescue personnel in water motor sports on the sea are issued by the training organization. The format of the certificate of specialized training for instructors in water motor sports on the sea is specified in Appendix 01 attached hereto. The format of the certificate of specialized training for rescue personnel in water motor sports on the sea is specified in Appendix 02 attached hereto.

Article 7. Implementation Organization

1. The General Department of Physical Education and Sports shall be responsible for guiding and inspecting the implementation of this Circular.

Clause 2. Cultural, Sports and Tourism Inspection Agencies shall conduct inspections and handle violations of this Circular within their authority.

3. Provincial Departments of Culture, Sports and Tourism, Provincial Departments of Culture and Sports under the central government shall be responsible for implementing this Circular.

Article 8. Effective Date

Article 1. This Circular takes effect from April 29, 2018.

Article 2. Circular No. 17/2010/TT-BVHTTDL dated December 31, 2010 of the Minister of Culture, Sports and Tourism stipulating conditions for operating sports facilities for water motor sports on the sea and Article 2 of Circular No. 19/2014/TT-BVHTTDL dated December 8, 2014 of the Minister of Culture, Sports and Tourism amending and supplementing certain provisions of Circulars No. 88/2008/TT-BVHTTDL, No. 17/2010/TT-BVHTTDL, and No. 03/2013/TT-BVHTTDL shall cease to be effective from the date this Circular takes effect.

During implementation, if any difficulties arise, organizations and individuals are requested to promptly report to the Ministry of Culture, Sports and Tourism for research and resolution./.
