AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 17/2012/TT-BTTTT DATED OCTOBER 5, 2012 ISSUED BY THE MINISTER OF INFORMATION AND COMMUNICATIONS ON THE ORGANIZATION AND ENSURING OF INFORMATION AND COMMUNICATION SERVICES FOR THE PURPOSE OF SERVING DIRECTIVE AND MANAGEMENT WORK IN NATURAL DISASTER PREVENTION AND CONTROL

Pursuant to the Law on Telecommunications dated November 23, 2009;
Pursuant to Decree No. 88/2020/NĐ-CP dated July 28, 2020 of the Government detailing and guiding the implementation of some provisions of the Labor Safety and Health Law on mandatory work injury and occupational disease insurance;natural disaster day June 19, 2013;

"2. Guaranteed electricity consumption (hereinafter referred to as guaranteed consumption) includes:
"2. A dedicated telecommunications network for serving directive and management work in natural disaster prevention and control is a telecommunications network established by the State to serve the Government, the Central Steering Committee for Natural Disaster Prevention and Control, and local authorities in organizing and ensuring information and communication services for the purpose of serving directive and management work in natural disaster prevention and control. The dedicated telecommunications network for serving directive and management work in natural disaster prevention and control includes:
The network includes:
a) Fixed satellite telecommunications system;
b) Mobile satellite telecommunications system;
c) Radio telecommunications system;
is a telecommunications network established by the State to serve the Government, the Central Steering Committee for Disaster Prevention and Control, local authorities in organizing and ensuring telecommunications to implement the work of directing and managing disaster prevention and control. The dedicated telecommunications network serving the work of directing and managing disaster prevention and control includes:
d) Special-purpose vehicles for communication services;
The specialized telecommunications network for natural disaster prevention and control managed and operated by Vietnam Post and Telecommunications Group is a component of the dedicated telecommunications network for serving directive and management work in natural disaster prevention and control.”
2. Amend Clause 1 of Article 4 as follows:
"1. Ensure information and communication services for natural disaster prevention and control with the highest priority, safety, reliability, and speed. Prioritize the use of local networks to implement directive and management activities in natural disaster prevention and control.”
a) Form 03a: Decision to Establish the Assessment Board;
"3. Exploit and utilize the dedicated telecommunications network for serving directive and management work in natural disaster prevention and control for its intended purposes and effectively.”
4. Supplement Clause 4 of Article 4 as follows:
"4. The funding for the operation and exploitation of the dedicated telecommunications network for serving directive and management work in natural disaster prevention and control shall be implemented in accordance with current regulations.”
5. Amend Clause 1 of Article 5 as follows:
"1. Information and communication services from the Government Office, the Central Steering Committee for Natural Disaster Prevention and Control to the Provincial Steering Committees for Natural Disaster Prevention and Control and Search and Rescue at ministries, agencies equivalent to ministries, provinces, and centrally-administered cities under the central government are mainly ensured through the use of mobile and fixed public telecommunications services (voice, fax, internet, video conferencing, etc.), postal services for Party and State agencies, and public postal services.”
6. Amend Clause 2 of Article 6 as follows:
“2. In areas affected directly by natural disasters causing disruption to public telecommunications networks, the organization of information and communication services for directive and management work in natural disaster prevention and control shall be carried out as follows:
a) Information and communication services from the Government Office, the Central Steering Committee for Natural Disaster Prevention and Control to the offices of the Provincial Steering Committees for Natural Disaster Prevention and Control and counties affected by natural disasters are mainly ensured through the use of satellite mobile telecommunications systems, fixed satellite telecommunications systems, and terrestrial wireless telecommunications systems.
Article 6, Point c. Communication information for government working groups and the Chairman of the National Steering Committee for Natural Disaster Prevention and Control shall be ensured through the use of satellite mobile telecommunications systems and radio telecommunications systems on dedicated vehicles for communication purposes.
c) Information and communication services for government working groups and the head of the Central Steering Committee for Natural Disaster Prevention and Control are ensured through the use of satellite mobile telecommunications systems and wireless telecommunications systems on dedicated vehicles for information services.”
7. Amend Clause 2 of Article 7 as follows:
"2. In areas affected directly by natural disasters causing disruption to public telecommunications networks, the organization of information and communication services shall be carried out in accordance with Clause 2 of Article 6 of this Circular.”
8. Amend Clause 1 of Article 8 as follows:
"1. Implement state management functions over the organization and ensuring of information and communication services for directive and management work in natural disaster prevention and control and the operation of the dedicated telecommunications network for serving directive and management work in natural disaster prevention and control.”
9. Amend Clause 4 of Article 8 as follows:
"4. The Steering Committee for Natural Disaster Prevention and Control of the Ministry of Information and Communications shall urge, guide, inspect, and direct the organization and implementation of activities of the dedicated telecommunications network for serving directive and management work in natural disaster prevention and control; duty roster, report handling, situation compilation, and directive and management of information organization for natural disaster prevention and control and aftermath relief.”
10. Supplement Article 8a as follows:
"8a. Responsibilities of the Telecommunications Department
1. Advise the leadership of the Ministry to direct telecommunications enterprises and relevant agencies and units to develop and implement annual plans and schemes to ensure information services for directive and management work in natural disaster prevention and rescue operations.
2. Direct telecommunications enterprises to enhance the capacity of public telecommunications networks and the quality of telecommunications services to ensure information and communication services for directive and management work in natural disaster prevention and control.”
11. Supplement Article 8b as follows:
"8b. Responsibilities of the Central Postal Department
1. Operate and manage the terrestrial wireless telecommunications system; manage and operate dedicated vehicles for information services ready to ensure information and communication services for directive and management work in natural disaster prevention and control for government working groups and the Central Steering Committee for Natural Disaster Prevention and Control upon request of the Government Office, the Central Steering Committee for Natural Disaster Prevention and Control, and the Ministry of Information and Communications.
2. Coordinate and organize the provision of online television services to serve the Government and the Central Steering Committee for Natural Disaster Prevention and Control when requested to organize online meetings to direct natural disaster prevention and control work to provinces and centrally-administered cities.
3. Coordinate enterprises designated to maintain management of public postal networks, postal networks serving Party and State agencies to ensure communication services for government guidance and control in disaster prevention and response, search and rescue operations.
4. In cases of necessity, the Central Post Office Directorate shall propose the Ministry of Information and Communications to direct the mobilization of infrastructure from postal and telecommunications enterprises to connect communication services for government guidance and control in disaster prevention and response.
5. Coordinate with relevant units to develop regulations on cooperation in receiving information and organizing service provision for guidance and control communications in disaster prevention and response and search and rescue operations.
12. Amend Clause 1 of Article 9 as follows:
"1. Direct and guide postal and telecommunications enterprises within their jurisdiction to build and implement plans and schemes ensuring communication services for guidance and control in disaster prevention and response and search and rescue operations by provincial People's Committees, Provincial Steering Committees for Disaster Prevention and Control annually:
a) Take the lead in directing and coordinating postal and telecommunications enterprises within their jurisdiction to ensure communication services for government guidance and control in disaster prevention and response for all levels of government and government working groups when disasters occur.
b) Advise provincial People's Committees and Provincial Steering Committees for Disaster Prevention and Control to equip communication means sufficient to meet local needs for guidance and control in disaster prevention and response.
c) Create favorable conditions and support telecommunications enterprises within their jurisdiction to construct communication facilities serving guidance and control in disaster prevention and response."
13. Amend Article 11 as follows:
"1. Ensure communication services for government guidance and control in disaster prevention and response for the Government, National Steering Committee for Disaster Prevention and Response, and all levels of government safely, reliably, and promptly through public telecommunications networks, dedicated disaster prevention and response information networks:
2. Develop, approve, and implement operational regulations for dedicated disaster prevention and control information networks.
b) Coordinate with the Central Post Office Directorate to be ready to organize mobile communication services for government working groups and the National Steering Committee for Disaster Prevention and Response according to requirements of the Government Office, the National Steering Committee for Disaster Prevention and Response, and the Ministry of Information and Communications.
c) Closely coordinate with telecommunications enterprises and other private telecommunications network owners to effectively exploit dedicated disaster prevention and response information networks and ensure the highest level of safety for communication services for guidance and control in disaster prevention and response.
2. Establish, approve, and implement operational regulations for specialized communication networks for disaster prevention and control.
3. Direct and control subordinate units at localities to organize communication services for guidance and control in disaster prevention and response and search and rescue operations according to requirements of the Provincial Steering Committee for Disaster Prevention and Control and the Provincial Department of Information and Communications.
4. Report to the Ministry of Information and Communications on the operation of dedicated disaster prevention and response information networks annually and as required."
14. Amend Clause 3 of Article 12 as follows:
"3. Fulfill tasks to ensure the safety of communication services for guidance and control in disaster prevention and response according to requirements of the Government, the National Steering Committee for Disaster Prevention and Response, and local governments at all levels."
15. Supplement Article 12b as follows:
"Article 12b. Responsibilities of Vietnam Post Corporation In addition to the general responsibilities stipulated in Article 10 of this Circular, Vietnam Post Corporation also has the following responsibilities:
1. Ensure postal communication services for government guidance and control in disaster prevention and response, search and rescue operations through postal networks serving Party and State agencies; public postal networks according to requirements of the Government Office, the National Steering Committee for Disaster Prevention and Response, the National Committee for Disaster Response and Search and Rescue, and the Ministry of Information and Communications.
2. Coordinate with the Central Post Office Directorate to operate and exploit postal networks serving Party and State agencies to ensure postal communication services for government guidance and control in disaster prevention and response and search and rescue operations.
3. Direct and control subordinate units at localities to organize communication services for guidance and control in disaster prevention and response and search and rescue operations according to requirements of the Provincial Steering Committee for Disaster Prevention and Control and the Provincial Department of Information and Communications."

Article 3. Implementation Provisions
1. This Circular takes effect from January 28, 2020.
2. Within sixty days from the date this Circular takes effect, organizations and individuals participating in the management, operation, and exploitation of dedicated telecommunications networks serving natural disaster prevention and control work shall develop plans to implement this Circular.
3. The Director of the Office, the Director of the Telecommunications Department, the Director of the Central Post Department, the Heads of agencies and units under the Ministry, the Directors of Provincial Information and Communications Departments under centrally governed cities, the General Directors of Vietnam Posts and Telecommunications Group, the General Directors of Vietnam Military Industry and Telecommunications Corporation, the General Directors of Vietnam Post Corporation, the General Directors and Directors of postal and telecommunications enterprises, and other related organizations and individuals shall be responsible for implementing this Circular.
4. In the course of implementation, if any difficulties arise, organizations and enterprises are requested to promptly report to the Ministry of Information and Communications (Central Post Department) for guidance or review and amendment./.
