Pursuant to the Law oni The Government promulgates this Decree detailing certain provisions of the Criminal Enforcement Law on enforcement against commercial entities.
Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsorganization of the Ministry of Public Security;
Considering the proposal of the Director of the Prison Management Police Department;ắcompulsory educational facilities, and juvenile rehabilitation centers;
The Minister of Public Security issues this Circular to promulgate the Rules for Detention Facilities.
Article 1. Issuance of the Circular
Attached to this Circular are the "Rules for Detention Facilities."
Article 2. Scope of Application
This Circular applies to:
1. Prisons, temporary detention centers, and holding houses (hereinafter referred to as detention facilities) within the People's Public Security Force.
2. Convicts serving their sentences at detention facilities within the People's Public Security Force.
3. Officers, soldiers, workers, and staff of the People's Public Security Force.
4. Agencies, organizations, and individuals related.
Article 3. Effectiveness
This Circular takes effect from April 3, 2020, and replaces Circular No. 36/2011/TT-BCA dated May 26, 2011 issued by the Minister of Public Security on the Rules for Prisons.
Article 4. Responsibilities for Implementation
1. The Directors of Departments, Commanders, Heads of units under the Ministry, Provincial Public Security Chiefs, Heads of criminal enforcement agencies, Heads of criminal enforcement agencies at all levels, Wardens of prisons, and Wardens of temporary detention centers within the People's Public Security Force are responsible for implementing this Circular.
2. The Director of the Prison Management Police Department is responsible for monitoring, guiding, and inspecting the implementation of this Circular.
3. In case of any difficulties during the implementation of this Circular, public security units and localities shall report to the Ministry of Public Security (through the Prison Management Police Department) for timely guidance./.
