Amending and supplementing certain articles of Circular No. 33/2013/TT-NHNN dated December 26
2013 issued by the Governor of the State Bank of Vietnam guiding procedures for approval of foreign currency cash export and import activities
of permitted banks

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

On the basis of the Law on Credit Institutions dated June 16, 2010, and the Law Amending and Supplementing Some Provisions of the Law on Credit Institutions dated November 20, 2017;

Pursuant to the Foreign Exchange Decree dated December 13, 2005 and the Decree Amending and Supplementing Certain Articles of the Foreign Exchange Decree dated March 18, 2013;

on Investment2019 of the Government on implementing administrative procedures under the National Single Window mechanism, ASEAN Single Window mechanism, and specialized inspection of goods for export and import; Pursuant to Decree No. 16/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;

The Governor of the State Bank of Vietnam hereby promulgates this Circular amending and supplementing certain articles of Circular No. 33/2013/TT-NHNN dated December 26, 2013 of the Governor of the State Bank of Vietnam guiding procedures for approval of foreign currency cash export and import activities of permitted banks (referred to as Circular No. 33/2013/TT-NHNN).

At the proposal of the Director of the Department of Foreign Exchange Management;

Article 1. Amending and supplementing certain articles of Circular No. 33/2013/TT-NHNN

Article 3. Is amended and supplemented as follows:

"Article 3. Procedures for requesting approval of foreign currency cash export and import activities of permitted banks

1. Principles for declaration, submission, receipt, issuance of results, exchange, and feedback of information regarding the request for approval of foreign currency cash export and import activities of permitted banks:
a) Electronic files shall be submitted using digital signatures through the National Single Window Portal. Declaration, submission, receipt, issuance of results, exchange, and feedback of information, and use of digital signatures on the National Single Window Portal and the specialized processing system of the State Bank of Vietnam shall be carried out in accordance with the provisions of Decree No. 85/2019/NĐ-CP dated November 14, 2019 of the Government on implementing administrative procedures under the National Single Window mechanism, ASEAN Single Window mechanism, and specialized inspection of goods for export and import, and any subsequent amendments, supplements, or replacements thereof (if any);
b) In case the National Single Window Portal or the specialized processing system of the State Bank of Vietnam encounters technical issues or errors preventing the receipt or exchange of electronic information, declaration, submission, receipt, issuance of results, exchange, and feedback of information shall be conducted via postal services or directly at the Service Reception and Result Issuance Unit of the State Bank of Vietnam branch in Hanoi City or Ho Chi Minh City;
c) Documents in the electronic file are scanned copies of original documents (in PDF format), except for the application for approval of foreign currency cash export and import which is filled out on the National Single Window Portal. Documents in the paper file are originals or certified copies by the authorized representative of the permitted bank.
a) Application for approval of foreign currency cash export and import according to Form 01 attached hereto;
2. The documents include:
b) Export and/or import contracts for foreign currency cash signed between the permitted bank and foreign banks or financial organizations, accompanied by a Vietnamese translation certified by the authorized representative of the permitted bank (to be submitted only once and updated when changes occur);
c) Internal regulations of the permitted bank concerning foreign currency cash export and import activities, including provisions on delegation of authority within the organization for such activities, and management, supervision, and security measures for the handover, storage, and transportation of foreign currency cash, ensuring compliance with the State Bank of Vietnam's regulations (to be submitted only once and updated when changes occur);
d) Power of attorney in cases where the person signing the application for approval is the authorized representative of the permitted bank (to be submitted only once and updated when changes occur).
3. Procedure and process for approving foreign currency cash export and import activities:
a) When there is a need to carry out foreign currency cash export and import activities, the permitted bank shall prepare and submit one set of documents to the State Bank of Vietnam branch in Hanoi City or Ho Chi Minh City in accordance with Clause 1 and Clause 2 of this Article;
b) Within two working days from the date of receiving complete and valid documents as stipulated in Clause 2 of this Article, the State Bank of Vietnam branch in Hanoi City or Ho Chi Minh City shall examine and approve the foreign currency cash export and import activities of the permitted bank according to Form 02 attached hereto and send it to the permitted bank in accordance with Point a and Point b of Clause 1 of this Article.
If the documents are incomplete or invalid, the State Bank of Vietnam branch in Hanoi City or Ho Chi Minh City shall notify the permitted bank through the National Single Window Portal or by written notice (as stipulated in Point b of Clause 1 of this Article) and specify the reasons.
Within three working days from the date of receiving all relevant documents related to foreign currency cash export and import (payment orders and customs declarations), the permitted bank shall submit copies of payment orders and customs declarations (certified by the authorized representative of the permitted bank) to the State Bank of Vietnam branch in Hanoi City or Ho Chi Minh City."
Replacing Appendices 01, 02, and 03 issued together with Circular No. 33/2013/TT-NHNN with Appendices 01, 02, and 03 issued together with this Circular.

Article 2.

The Director of the Office, Heads of the Foreign Exchange Management Department, Chief Inspector and Supervisor of Banks, Heads of units under the State Bank of Vietnam, Directors of the State Bank of Vietnam branches in Hanoi City and Ho Chi Minh City, commercial banks, and foreign bank branches permitted to conduct foreign exchange operations are responsible for organizing the implementation of this Circular.

This Circular takes effect from December 25, 2025/.

This Circular takes effect from February 1, 2021.
