Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Labor Law dated November 16, 2013;

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to Decree No.28/2015/ND-CP March 12, 2015 Government Decree detailing the implementation of certain provisions of the Labor Law on unemployment insurance;

Pursuant to Decree No.61/2020/ND-CP May 29, 2020 Government Decree amending and supplementing certain articles of the Government Decree number28/2015/ND-CP March 12, 2015 providing detailed regulations on the implementation of certain provisions of the Labor Law on unemployment insurance;

Decree No. 07/2021/NĐ-CP

The Prime Minister issues this Decision to provide the level of vocational training support for workers participating in unemployment insurance.

Article 1. Scope of Regulation

This Decision provides the level of vocational training support for workers participating in unemployment insurance.

Article 2. Applicability

1. Workers receiving vocational training support as stipulated in Article 55 of the Labor Law (hereinafter referred to collectively as workers).

2. Vocational education institutions, higher education institutions registered to conduct vocational education at the college level for enterprises, agencies, organizations that carry out vocational education activities participate in vocational training for workers (hereinafter referred to collectively as vocational training institutions).

Provincial Departments of Labor, Invalids and Social Affairs, central city departments; social insurance agencies; employment service centers established by state management agencies for employment and other relevant agencies involved in supporting vocational training for workers participating in unemployment insurance.

Article 3. Level of vocational training support

1. Level of vocational training support

a) For those participating in vocational training courses up to three months: The support level is calculated based on the tuition fee of the vocational training institution and the actual duration of vocational training, but not exceeding VND 4,500,000 per person per training course.

b) For those participating in vocational training courses over three months: The support level is calculated monthly based on the tuition fee and the actual duration of vocational training, but not exceeding VND 1,500,000 per person per month. In cases where workers participate in vocational training courses with odd days not meeting the full month requirement set by the vocational training institution, the odd days are calculated according to the principle: From 14 days or less counted as half a month and from 15 days or more counted as one month.

2. Application procedures for vocational training and resolution of vocational training support are carried out in accordance with the provisions of Articles 24 and 25 of the Government Decree No. 28/2015/ND-CP dated March 12, 2015 detailing the implementation of certain provisions of the Labor Law on unemployment insurance (amended and supplemented by Government Decree No. 61/2020/ND-CP dated May 29, 2020).

3. Monthly, vocational training institutions implement procedures for settlement and finalization of vocational training support funds in accordance with the provisions of Article 25 of the Government Decree No. 28/2015/ND-CP dated March 12, 2015 detailing the implementation of certain provisions of the Labor Law on unemployment insurance (amended and supplemented by Government Decree No. 61/2020/ND-CP dated May 29, 2020).

Article 4. Implementation funds

The source of funds for implementing vocational training support is paid by the social insurance agency from the Unemployment Insurance Fund.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from May 15, 2021.

For workers who have submitted applications for vocational training support before the effective date of this Decision but have not yet received a decision on vocational training support, they will be subject to the vocational training support levels as provided in this Decision.

2. Decision No. 77/2014/QĐ-TTg dated December 24, 2014 of the Prime Minister providing the level of vocational training support for workers participating in unemployment insurance shall cease to be effective from the date this Decision comes into force. 

3. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairmen of provincial People's Committees, and chairmen of municipal people's committees directly under the central government are responsible for enforcing this Decision.
