CIRCULAR

Regulations on standards and conditions for promotion to higher ranks of professional titles for sports instructors traffic transport professionals

Pursuant to the Law Professionals as of November 15, 2010;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Public Service Staff Law dated November 25, 2019;

Based on the proposal of the Director of the Cadre and Civil Servant Department;

Decree No. Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government amending and supplementing certain articles of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of professionals;

Decree No. 56/2022/Decree-CP dated February 24 the 8 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;22 of the Government stipulating functions, tasks, powers, and organizational structureof the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsu t, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP function of the Ministry Ministry of Transport;

Pursuant to the proposal of the Director Department of Organization and Cadres;

Minister of theinMinistry Ministry of Transport issues this Circular stipulating criteria and conditions for promotion examination of professional titles of traffic transport professionals.

 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates criteria and conditions for promotion examination of professional titles of traffic transport professionals, including:

1. Criteria and conditions for promotion examination to Class II for traffic transport technical ferry station professionals.

2. Criteria and conditions for promotion examination to Class I and Class II for professionals in the following fields:

a) Maritime project management;

b) Inland waterway project management;

c) Road project management;

d) Railway project management;

đ) Road engineering;

e) Marine search and rescue;

g) Maritime security information;

h) Inland waterway transport inspection;

i) Maritime transport inspection;

k) Civil aviation transport inspection;

l) Inspection.

Article 2. Applicability

This Circular applies to traffic transport professionals working in public service units, administrative organizations applying the financial mechanism of public service units, and related organizations and individuals.

Chapter II

CRITERIA AND CONDITIONS FOR PROMOTION OF TRAFFIC TRANSPORT PROFESSIONALS

Article 3. General criteria and conditions

1. Meeting the criteria and conditions prescribed in Clause 1, Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of professionals (amended and supplemented by Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government amending and supplementing certain articles of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of professionals).

2. Having vacant positions corresponding to the professional title grade being considered for promotion.

3. Being nominated by the head of the competent authority managing professionals to participate in the promotion examination of professional titles.

4. Meeting the minimum time requirement in holding the lower professional title grade immediately below, specifically as follows:

a) Professionals being considered for promotion to Class I traffic transport professional title must have held the Class II traffic transport professional title and equivalent for at least six years up to the deadline for submitting application forms for the promotion examination;

b) Professionals being considered for promotion to Class II traffic transport professional title must have held the Class III traffic transport professional title and equivalent for at least nine years (excluding probationary and trial periods) up to the deadline for submitting application forms for the promotion examination.

Article 4. Criteria and conditions for promotion examination of traffic transport professionals to Class I

Traffic transport professionals being promoted from Class II to Class I must meet the general criteria and conditions stipulated in Article 3 of this Circular and the specific criteria and conditions as follows:

1. For professionals in maritime project management, inland waterway project management, road project management, railway project management, road engineering, during the period of holding the Class II professional title and equivalent, achieving one of the following criteria and conditions:

a) Leading the development of at least one (1) scientific and technological research topic, plan, project, program at the ministry or provincial level or higher, which has been approved by the competent authority;

b) Leading the development of at least two (2) scientific and technological research topics, plans, projects, programs at the grassroots level, which have been approved by the competent authority;

c) Serving as the head of survey for at least one (1) Class A project or two (2) Class B projects that have been approved or serving as the project manager for at least one (1) Class A project or two (2) Class B projects that have been approved and put into use;

d) Serving as the head of survey, leading the inspection, leading the design, leading the review, or leading the verification of at least one (1) Class I construction project or two (2) Class II construction projects that have been approved or serving as the site supervisor for at least one (1) Class I construction project or two (2) Class II construction projects that have been approved and put into use;

đ) Leading the preparation of investment cost estimates for at least one (1) Class A project or two (2) Class B projects or one (1) Class I construction project or two (2) Class II construction projects that have been approved;

e) Participating in the management of at least one (1) Class A project or two (2) Class B projects that have been approved and put into use and having one of the four professional certificates: Class I project management, Class I construction design, Class I construction supervision, or Class I construction valuation.

2. For professionals in marine search and rescue, maritime security information, inland waterway transport inspection, maritime transport inspection, civil aviation transport inspection, during the period of holding the Class II professional title and equivalent, achieving one of the following criteria and conditions:

a) Participating in the development of at least two (2) regulatory documents, which have been issued by the competent authority;

b) Leading the development of at least two (2) national, ministerial, sectoral, or provincial-level scientific research topics, plans, projects, programs, which have been approved by the competent authority;

c) Participating in the development of at least one (1) regulatory document and leading the development of at least one (1) national, ministerial, sectoral, or provincial-level scientific research topic, plan, project, program, which have been issued or approved by the competent authority.

3. For professional staff in inspection fields, during the period of holding the second-level occupational title and equivalent, they must meet one of the following criteria and conditions:

a) Participating in the development of at least two (2) regulatory documents, which have been issued by the competent authority;

b) Participate in building at least two research topics, projects, programs at the national level, ministry level, sector level, field level, or provincial level and above, which have been accepted by the competent authority, assigned to the unit employing the staff for construction;

c) Participate in building at least one regulatory document and at least one research topic, project, program at the national level, ministry level, sector level, field level, or provincial level and above, which have been issued or accepted by the competent authority, assigned to the unit employing the staff for construction;

Article 5. Criteria and Conditions for Promoting to the Second-Level Occupational Title for Professional Staff in the Transport Sector

Professional staff in the transport sector who are promoted from the third-level occupational title to the second-level occupational title must meet the general criteria and conditions stipulated in Article 3 of this Circular and the specific criteria and conditions as follows:

1. For professional staff in maritime project management, inland waterway project management, road project management, railway project management, road engineering, during the period of holding the third-level occupational title and equivalent, they must meet one of the following criteria and conditions:

a) Participate in building at least one scientific and technological topic, project, program at the ministry level, provincial level and above, which have been accepted by the competent authority, assigned to the unit employing the staff for construction;

b) Participate in building at least two scientific and technological topics, projects, programs at the basic level, which have been accepted by the competent authority, assigned to the unit employing the staff for construction;

c) Serve as the head of surveying for at least one Class B project or two Class C projects that have been accepted or serve as the project manager for at least one Class B project or two Class C projects that have been accepted and put into use;

d) Serve as the head of surveying, inspection, design, review, or supervision of at least one Class II project or two Class III projects that have been accepted and put into use;

e) Serve as the head of implementing investment cost estimation for at least one Class B project or two Class C projects or one Class II project or two Class III projects that have been accepted;

f) Manage at least one Class B project or two Class C projects that have been accepted and put into use and hold one of the four professional certificates: Project Management Level II, Construction Design Level II, Construction Supervision Level II, or Construction Valuation Level II;

2. For professional staff in maritime search and rescue, maritime security information, inland waterway port administration, maritime port administration, aviation port administration, during the period of holding the third-level occupational title and equivalent, they must meet one of the following criteria and conditions:

a) Participate in building at least one regulatory document that has been issued by the competent authority, assigned to the unit employing the staff for construction;

b) Serve as the head or participate in building at least one scientific research topic, project, program at the basic level and above, which have been accepted by the competent authority, assigned to the unit employing the staff for construction;

c) Serve as the head of building at least one technical innovation in the industry, field, agency, or unit where the staff work, which has been recognized by the competent authority;

3. For professional staff in inspection fields, during the period of holding the third-level occupational title and equivalent, they must meet one of the following criteria and conditions:

a) Participate in building at least one regulatory document that has been issued by the competent authority, assigned to the unit employing the staff for construction;

b) Participate in building at least one research topic, project, program at the national level, ministry level, sector level, field level, or provincial level and above, which have been accepted by the competent authority, assigned to the unit employing the staff for construction;

4. For professional staff in ferry terminal engineering, during the period of holding the third-level occupational title and equivalent, they must participate in building at least one scientific and technological topic, project, program at the basic level and above, which have been accepted by the competent authority, assigned to the unit employing the staff for construction;

Chapter III

IMPLEMENTATION

Article 6. Effectiveness

1. This Circular shall take effect from July 15, 2024.

2. In cases where the regulatory documents referred to for application in this Circular are amended, supplemented, or replaced by new documents, implementation shall be carried out according to the provisions of the amended, supplemented, or replacing documents;

3. This Circular abolishes the following provisions:

a) Clause 4, Article 4, Clause 4, Article 5, Clause 4, Article 7, Clause 4, Article 8 of Circular No. 38/2022/TT-BGTVT dated December 30, 2022 of the Minister of Transport on code numbers, occupational title standards, and salary grading for professional staff in maritime search and rescue and maritime security information;

b) Clause 4, Article 4, Clause 4, Article 5, Clause 4, Article 6 of Circular No. 39/2022/TT-BGTVT dated December 30, 2022 of the Minister of Transport on code numbers, occupational title standards, and salary grading for professional staff in inland waterway port administration;

c) Clause 4, Article 4, Clause 4, Article 5, Clause 4, Article 6, Clause 4, Article 8 of Circular No. 40/2022/TT-BGTVT dated December 30, 2022 of the Minister of Transport on code numbers, occupational title standards, and salary grading for professional staff in maritime port administration;

d) Clause 4, Article 4, Clause 4, Article 5, Clause 4, Article 6 of Circular No. 41/2022/TT-BGTVT dated December 30, 2022 of the Minister of Transport on code numbers, occupational title standards, and salary grading for professional staff in maritime project management;

đ) Clause 4, Article 4, Clause 4, Article 5, Clause 4, Article 6 of Circular No. 43/2022/TT-BGTVT dated December 30, 2022 of the Minister of Transport on code numbers, occupational title standards, and salary grading for professional staff in inland waterway project management;

e) Point c Clause 2 Article 1, Point c Clause 3 Article 1, Point c Clause 4 Article 1, Point c Clause 5 Article 1 Circular No. 44/2022/TT-BGTVT dated December 30, 2022 of the Minister of Transport amending and supplementing certain provisions of Circular No. 11/2020/TT-BGTVT dated May 21, 2020 of the Minister of Transport on job title codes, occupational standards, and salary grades for civil servants in the air port service profession;

Clause 4 Article 4, Clause 4 Article 5, Clause 4 Article 6, Clause 4 Article 7 Circular No. 45/2022/TT-BGTVT dated December 30, 2022 of the Minister of Transport on job title codes, occupational standards, and salary grades for civil servants in the vehicle inspection profession;

Clause 4 Article 4, Clause 4 Article 5, Clause 4 Article 6 Circular No. 46/2022/TT-BGTVT dated December 30, 2022 of the Minister of Transport on job title codes, occupational standards, and salary grades for civil servants in the road project management profession;

Clause 4 Article 4, Clause 4 Article 5, Clause 4 Article 6, Clause 4 Article 8 Circular No. 47/2022/TT-BGTVT dated December 30, 2022 of the Minister of Transport on job title codes, occupational standards, and salary grades for civil servants in the road engineering profession and ferry terminal engineering profession;

Clause 4 Article 4, Clause 4 Article 5, Clause 4 Article 6 Circular No. 49/2022/TT-BGTVT dated December 30, 2022 of the Minister of Transport on job title codes, occupational standards, and salary grades for civil servants in the railway project management profession.

Article 7. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Heads of agencies, units, organizations, and individuals concerned shall be responsible for implementing this Circular./.
