CIRCULAR

OF THE MINISTRY OF FINANCE

Guidelines for transferring construction investment capital from the budget to the Investment and Development Bank system for disbursement to projects recorded by the bank in the state plan.
According to the State Plan

Pursuant to Decree No. 385/HĐBT dated November 7, 1990 of the Council of Ministers on amending and supplementing the management charter for construction investment No. 232/CP.

The Ministry of Finance guides the transfer of construction investment capital from financial agencies to the Investment and Development Bank system as follows:

Individuals who have registered as the principal investigator of a Research Project or Pilot Production Project and those participating in its implementation shall not participate in the Evaluation and Selection Council for that Research Project or Pilot Production Project (hereinafter referred to as the Council). In necessary cases, members of the Council may be staff members of the organization registering as the principal investigator of the Research Project or Pilot Production Project, but not more than one person and they cannot serve as Chairperson, Vice-Chairperson, or reviewing member.

Concentrate the disbursement and payment of construction investment capital uniformly into the Investment and Development Bank system, implement unified management over the payment phase of construction investment capital when the project has completed work volume.

Ensure that central and local financial agencies promptly grasp the implementation of investment plans, construction progress, and the disbursement of funds for completed construction works meeting the payment criteria stipulated in the state plan for each project, ministry, sector, and locality.

For projects funded by the state budget recorded in the annual state plan managed by ministries, sectors, and the central government, the Ministry of Finance transfers capital to the Central Investment and Development Bank; for projects funded by the state budget recorded in the annual state plan managed by localities, the Provincial Department of Finance transfers capital to provincial and city Investment and Development Banks for them to disburse funds for completed construction works according to regulations.

Financial agencies (Ministry of Finance, Provincial Departments of Finance) transfer capital to the Investment and Development Bank system based on the following principles:

Transfer capital according to the progress of implementing the state's construction investment plan. Each time transferring capital, the Ministry of Finance transfers according to the total amount of capital for each ministry and the list of projects (for projects managed centrally); the Provincial Department of Finance transfers capital according to each project (for projects managed locally).

Based on the registration of disbursement and payment plans by the Central Investment and Development Bank with the Ministry of Finance and branches of the Investment and Development Bank with the Provincial Departments of Finance, financial agencies transfer capital in installments according to the availability of budget funds.

 

II. CONTENT

Construction investment capital for projects in the state plan transferred from the budget to the Investment and Development Bank for disbursement and payment of completed construction products includes:

Capital for purchasing equipment (domestic and foreign).

Construction and installation capital.

Other basic knowledge capital.

Capital for investment preparation.

Design and planning capital.

The basis for transferring construction investment capital (from the budget) to the Investment and Development Bank system includes the following documents:

Annual construction investment plan of the state for each ministry, sector, locality, and each project approved by the competent authority.

Disbursement plan announced by the financial agency.

Quarterly capital transfer plan (according to form No. 1A KH/ĐT) for each project prepared and submitted to the financial agency by the project's main investor on the 25th day of the last month of each quarter.

(For centrally-managed projects, the main ministry sends it to the Ministry of Finance; for locally-managed projects, the investors send it to the Provincial Department of Finance).

Monthly report on the implementation of the construction investment plan.

According to the budget plan, every 15 days, the financial agency implements the transfer of capital to the Investment and Development Bank while notifying the main investor (for centrally-managed projects) or informing the investor (for locally-managed projects).

Based on the capital amount notified by the financial agency, the main investor (for centrally-managed projects) or the investor (for locally-managed projects) specifically works with the financial agency and the Investment and Development Bank to arrange funds for payment for each project. Priority should be given to key and important projects requiring accelerated construction progress according to the state plan objectives.

Based on the transferred capital amount, the Investment and Development Bank organizes inspections and procedures for disbursing funds for completed construction products to units according to regulations.

 

II. RESPONSIBILITIES

The main investor is responsible for directing and monitoring the progress of construction investment according to the state plan, the situation of fund disbursement and payment by the Investment and Development Bank, and reporting regularly monthly by the 5th day of the following month to the financial agency (for centrally-managed projects, the main ministry consolidates and reports to the Ministry of Finance; for locally-managed projects, the investors directly report to the Provincial Department of Finance) according to form 1B-BC/ĐT.

After the end of the plan year, the investor settles accounts for the use of construction investment capital allocated during the year:

For centrally-managed projects, the investor submits the settlement to the main ministry and the Investment and Development Bank branch where the project's capital was disbursed. The main ministry is responsible for reviewing the settlement of capital use in the year for each project, simultaneously consolidating the settlements of subordinate units and submitting them to the Ministry of Finance and the Central Investment and Development Bank.

For locally-managed projects, the investor submits the settlement to the Provincial Department of Finance and the Investment and Development Bank branch. The Provincial Department of Finance is responsible for reviewing the settlement of capital use in the year for each project, simultaneously consolidating the settlements of units under provincial management and submitting them to the Ministry of Finance.

The Central Investment and Development Bank and local branches are responsible for receiving construction investment capital from the state budget transferred by financial agencies to disburse and pay for projects funded by the state budget recorded in the state plan according to the capital disbursement and payment regulations stipulated by the Ministry of Finance.

The Investment and Development Bank is authorized to allocate capital among projects for which the Ministry of Finance has transferred capital, in cases where projects have not yet reached a certain volume or have not completed all necessary procedures for payment disbursement, to allocate capital for disbursement to other projects that meet the conditions for payment within the scope of the capital received from the Investment and Development Bank's budget and immediately notify the Ministry of Finance and the project management authority.

Monthly and quarterly, the Investment and Development Bank is responsible for reporting on the situation of investment capital disbursement for each project to the financial agency on the 10th day of the following month according to form number 2B-BC/ĐT (the Central Investment and Development Bank reports to the Ministry of Finance, the local Investment and Development Bank reports to the Provincial Department of Finance).

Monthly and quarterly, the Department of Finance is responsible for summarizing the implementation of the investment plan and the disbursement of capital for completed construction works under its management and report to the Ministry of Finance (according to form number 1B-BC/ĐT).

After the end of the planning year, no later than March 31 of the following year, the Investment and Development Bank must settle all situations regarding the receipt and use of capital for disbursement for each project according to each sector's management with the financial agency (the Central Investment and Development Bank settles with the Ministry of Finance, the local Investment and Development Bank settles with the Provincial Department of Finance).

The financial agency (the Ministry of Finance for central projects, the Provincial Department of Finance for local projects) is responsible for timely transferring capital according to the progress of the plan and budget capacity to the Investment and Development Bank for disbursement of capital for completed construction works to the unit. During the process of transferring capital, if it is found that the project owner units are using capital contrary to the plan, the actual work volume does not follow the design and approved estimate, violating the State's management regulations for investment capital, the financial agency has the right to suspend the transfer of capital for disbursement for that project and inform the banking agency and the project management authority.

Annually, the financial agency is responsible for reviewing and settling accounts for the Investment and Development Bank regarding the situation of receiving and using budget capital (the Ministry of Finance reviews and settles accounts for the Central Investment and Development Bank, the Provincial Department of Finance reviews and settles accounts for the provincial Investment and Development Bank). After the review, the Ministry of Finance will notify the State Bank and the Planning and Investment Commission.

This Circular takes effect from April 1, 1991. It is requested that ministries, sectors, and localities organize and direct subordinate units to implement this Circular. Any issues encountered during implementation should be promptly reported to the Ministry of Finance for resolution.
