Detailed regulations on the organization of urban administration in Da Nang City

||| Pursuant to the Law on Organization of the Government dated June 19, 2015;

Pursuant to the Law on Organization of Local Administration dated June 19, 2015;

Pursuant to the Law Amending and Supplementing Several Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to Resolution No. 136/2024/QH15 dated June 26, 2024 of the National Assembly on the organization of urban administration and pilot implementation of certain special mechanisms and policies for the development of Da Nang City;

||| Based on the proposal of the Minister of Home Affairs;

The Government promulgates this Decree detailing the organization of urban administration in Da Nang City.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree specifies the organization and operation of the People's Committee of the district and the responsibility system of the Chairman of the People's Committee of the district; the organization and operation of the People's Committee of the ward and the responsibility system of the Chairman of the People's Committee of the ward; election, recruitment, management, and utilization of civil servants working at the People's Committee of the district and cadres and civil servants working at the ward and commune; budget preparation, execution, and settlement of the district and ward budgets within Da Nang City (hereinafter referred to as the city).

Article 2. Applicability

This Decree applies to:

1. The People's Committee of the district, the People's Committee of the ward; civil servants working at the People's Committee of the district; cadres and civil servants working at the ward and commune of the city.

2. Other relevant agencies, organizations, and individuals.

Chapter II
ORGANIZATION OF ACTIVITIES OF THE PEOPLE'S COMMITTEE OF THE DISTRICT,
RESPONSIBILITY REGIME OF THE CHAIRMAN OF THE PEOPLE'S COMMITTEE OF THE DISTRICT

Article 3. Organizational structure of the People's Committee of the district

The organizational structure of the People's Committee of the district shall be implemented in accordance with Clause 1, Article 7 of Resolution No. 136/2024/QH15.

Article 4. Principles of operation of the People's Committee of the district

1. The People's Committee of the district operates under the head system; ensuring the principle of centralized democracy. The Chairman of the People's Committee of the district decides matters within the tasks and powers of the People's Committee of the district, the Chairman of the People's Committee of the district, and bears responsibility for his decisions.

2. In case of vacancy of the Chairman of the People's Committee of the district, the Chairman of the People's Committee of the city shall decide to delegate the authority of the Chairman of the People's Committee of the district until a decision on the appointment of the Chairman of the People's Committee of the district is made.

3. Tasks and powers of the People's Committee of the district specified in Points b, c, d, e, g, l, m of Clause 3, Article 7 of Resolution No. 136/2024/QH15 (excluding the task of suspending the enforcement, partially or wholly revoking a part or all of the legal documents issued by specialized agencies under the People's Committee of the district and legal documents issued by the People's Committee of the ward) must be discussed collectively before the Chairman of the People's Committee of the district makes a decision. Civil servants of the district work according to the Working Regulations of the People's Committee of the district, ensuring compliance with legal provisions.

The collective referred to in this clause includes: the Chairman of the People's Committee of the district, Deputy Chairmen of the People's Committee of the district, Commander-in-Chief of the Military Command of the district, Chief of Public Security of the district, and heads of specialized agencies under the People's Committee of the district. Based on the content of the meeting, the Chairman of the People's Committee of the district may invite other relevant parties.

4. Activities of the People's Committee of the district must meet the satisfaction of the people, comply with procedures and formalities, within the assigned authority, in accordance with the law and the Working Regulations of the People's Committee of the district. Promote administrative reform, apply online public services in handling administrative procedures for individuals and organizations in the district, in accordance with the law, ensuring that activities of the People's Committee of the district are democratic, transparent, consistent, smooth, effective, and efficient.

5. The Commander-in-Chief of the Military Command of the district, the Chief of Public Security of the district advise and are subject to the direction and management of the Chairman of the People's Committee of the district in implementing tasks related to national defense, security, measures to ensure social order and safety, crime prevention and suppression, and other violations of the law on the territory in accordance with the law; participate in discussions on the contents stipulated in Clause 3 of this Article.

Article 5. Responsibilities of the Chairman of the People's Committee of the District

1. The Chairman of the People's Committee of the District shall be responsible for implementing the provisions of the Civil Servants Law, Resolution No. 136/2024/QH15, other relevant laws, the Working Regulations of the People's Committee of the District, and the following responsibilities:

a) Issuing the Working Regulations of the People's Committee of the District;

b) Leading and directing the activities of the People's Committee of the District, specialized agencies, and public service units under the People's Committee of the District;

c) Managing civil servants and officials working at the district and ward levels in accordance with the legal provisions on the management of civil servants and officials and according to the delegation of authority from the People's Committee of the City and the Chairman of the People's Committee of the City;

d) Signing documents of the People's Committee of the District in his capacity as Chairman of the People's Committee of the District, head of the administrative state agency at the district level, and being responsible for the documents of the People's Committee of the District;

đ) Suspending the implementation, revoking partially or entirely documents issued by specialized agencies under the People's Committee of the District and documents issued by the People's Committee of the Ward that violate the law;

2. If the Chairman of the People's Committee of the District violates the responsibilities stipulated in this Article, he shall be subject to examination and handling in accordance with the Civil Servants Law and other relevant legal provisions.

Article 6. Organization of Meetings of the People's Committee of the District

1. The organization of meetings of the People's Committee of the District shall be carried out in accordance with the Working Regulations of the People's Committee of the District.

2. The Chairman of the People's Committee of the District shall invite the Secretary of the District Party Committee, the Chairman of the Vietnam Fatherland Front Committee of the District, heads of political and social organizations at the district level, National Assembly deputies, and People's Council deputies elected in the district to attend meetings of the People's Committee of the District when the meeting agenda involves related issues.

3. Conclusions of meetings concerning citizens must be published on the website of the People's Committee of the District (except for information classified as State secrets) in accordance with the law and the Working Regulations of the People's Committee of the District to inform the public and relevant agencies and organizations promptly.

Article 7. Organization of Dialogue Meetings between the Chairman of the People's Committee of the District and Citizens

1. Annually, before 45 days from the date of the regular session of the People's Council of the City, the Chairman of the People's Committee of the District shall be responsible for organizing dialogue meetings with citizens in the district regarding the operation of the People's Committee of the District and Ward, and issues related to the rights and aspirations of citizens in the district.

Based on the population size, the Chairman of the People's Committee of the District may organize dialogues with citizens at the ward level. The People's Committee of the District must announce on mass media and the People's Committee of the Ward so that the Ward People's Committee can notify the Heads of Ward People's Representative Groups about the time, place, and content of the dialogue meeting with citizens at least seven days before the meeting.

2. The results of the dialogue meeting between the Chairman of the People's Committee of the District and citizens must be sent to the Standing Body of the People's Council, the People's Committee, the Chairman of the People's Committee of the City, the Heads of the People's Council Delegation Groups in the district, and the Vietnam Fatherland Front Committee of the District at least seven days before the opening of the nearest regular session of the People's Council of the City.

3. The organization of dialogue meetings with citizens shall be carried out in accordance with the Working Regulations of the People's Committee of the District.

Chapter III
ORGANIZATION AND ACTIVITIES OF THE PEOPLE'S COMMITTEE OF THE WARD,
RESPONSIBILITY REGIME OF THE CHAIRMAN OF THE PEOPLE'S COMMITTEE OF THE WARD

Article 8. Organizational structure of the People's Committee of the Ward

1. The organizational structure of the People's Committee of the Ward shall be implemented in accordance with Clause 1 of Article 8 of Resolution No. 136/2024/QH15.

2. Other civil servants of the People's Committee of the Ward include:

a) Office - Statistics;

b) Land Administration - Construction - Urban and Environment;

c) Finance - Accounting;

d) Justice - Civil Status;

e) Culture - Social Affairs.

Article 9. Principles of Operation of the People's Committee of the Ward

1. The People's Committee of the Ward operates under the head system, ensuring the principle of democratic centralism. The Chairman of the People's Committee of the Ward decides on matters within the tasks and powers of the People's Committee of the Ward, and bears responsibility for his decisions.

2. In case of absence of the Chairman of the People's Committee of the Ward, the Chairman of the People's Committee of the District shall decide to delegate the Chairmanship of the People's Committee of the Ward until a decision on appointing the Chairman of the People's Committee of the Ward is made.

3. Specific tasks and powers of the People's Committee of the Ward as stipulated in Points b, c, and g of Clause 3 of Article 8 of Resolution No. 136/2024/QH15 must be discussed collectively before the Chairman of the People's Committee of the Ward makes a decision and bears responsibility for it.

The collective referred to in this clause includes: the Chairman of the People's Committee of the Ward, Deputy Chairmen of the People's Committee of the Ward, Chief of the Military Command Post of the Ward, Head of the Police Station of the Ward, and other relevant civil servants. Based on the content of the meeting, the Chairman of the People's Committee of the Ward may invite additional relevant parties.

4. Activities of the People's Committee of the Ward must meet the satisfaction of the people, comply with procedures and formalities, within the assigned authority, in accordance with the law and the Rules of Procedure of the People's Committee of the Ward. Administrative reform should be promoted, online public services applied to handle administrative procedures for individuals and organizations in the ward according to the law, ensuring that activities of the People's Committee of the Ward are democratic, transparent, consistent, smooth, effective, and efficient.

5. The Head of the Police Station of the Ward advises and is subject to the leadership and management of the Chairman of the People's Committee of the Ward in performing tasks related to security, measures to ensure social order and safety, crime prevention and suppression, and other violations of the law on the territory according to the law; participates and provides opinions on the contents discussed collectively as stipulated in Clause 3 of this Article.

Article 10. Responsibilities of the Chairman of the People's Committee of the Ward

1. The Chairman of the People's Committee of the Ward is the head of the People's Committee of the Ward, responsible for leading, managing, and directing all activities of the People's Committee of the Ward in accordance with the Rules of Procedure of the People's Committee of the Ward, ensuring the principle of democratic centralism and complying with legal regulations.

2. Issuing the Rules of Procedure of the People's Committee of the Ward.

3. Bearing responsibility before the Chairman of the People's Committee of the District and before the law for the performance of tasks and powers of the People's Committee of the Ward.

4. Directly using and managing civil servants working in the ward in accordance with this Decree and the delegation and authorization of the People's Committee of the City, the Chairman of the People's Committee of the City, and the People's Committee of the District, the Chairman of the People's Committee of the District.

5. The Chairman of the People's Committee of the Ward authorizes the civil servant holding the title of Justice - Civil Status to perform certification and affix the seal of the People's Committee of the Ward for certifying copies from original documents issued or certified by competent authorities in Vietnam; certifying signatures on documents in accordance with the law. The authorized civil servant in Justice - Civil Status must have at least three years of experience working in the field of Justice - Civil Status.

6. Signing documents of the People's Committee of the Ward with the title of Chairman of the People's Committee of the Ward, the head of the administrative agency at the ward level, and bearing responsibility for the documents of the People's Committee of the Ward.

7. If the Chairman of the People's Committee of the Ward violates the responsibilities stipulated in this Article, he will be examined and dealt with in accordance with the Law on Cadres and Civil Servants and relevant legal provisions.

Article 11. Organizing meetings of the People's Committee of the Ward

1. The organization of meetings of the People's Committee of the Ward shall be carried out in accordance with the Working Regulations of the People's Committee of the Ward, convened by the Chairman of the People's Committee of the Ward to perform the assigned functions and tasks.

2. The Chairman of the People's Committee of the Ward shall invite the Secretary of the Party Committee of the Ward, the Chairman of the Vietnam Fatherland Front Committee of the Ward, the head of political-social organizations of the Ward, and representatives of specialized agencies under the People's Committee of the District related to the meeting when the agenda involves relevant issues.

3. Conclusions from meetings concerning residents must be publicized on the electronic portal of the People's Committee of the Ward (except for information classified as state secrets) in accordance with the law and the Working Regulations of the People's Committee of the Ward to promptly inform agencies, organizations, and the people.

Article 12. Organizing dialogue meetings between the Chairman of the People's Committee of the Ward and the People

1. Annually, at least 45 days before the regular session of the Municipal People's Council, the Chairman of the People's Committee of the Ward is responsible for organizing a dialogue meeting with the people in the ward regarding the operation of the People's Committee of the Ward and issues related to the rights and obligations of citizens in the locality. Based on the population size, the Chairman of the People's Committee of the Ward may organize dialogues with the people through neighborhood representatives. The People's Committee of the Ward must announce on mass media and notify the Neighborhood Heads about the time, location, and content of the dialogue meeting at least seven days prior to the meeting.

2. The results of the dialogue meeting between the Chairman of the People's Committee of the Ward and the people must be sent to the Standing Body of the Municipal People's Council, the Municipal People's Committee, the Chairman of the Municipal People's Committee, the Head of the Delegation of the Municipal People's Council in the district, the People's Committee of the District, the Chairman of the People's Committee of the District, and the Vietnam Fatherland Front Committee of the Ward.

Chapter IV
ELECTION, USE, AND MANAGEMENT OF STAFF WORKING IN THE WARD, COMMUNE
AND RECRUITMENT, USE, AND MANAGEMENT OF CIVIL SERVANTS WORKING AT
DISTRICT PEOPLE'S COMMITTEE, WARD PEOPLE'S COMMITTEE, COMMUNE

Article 13. Number of staff and civil servants working in the ward, commune

1. Staff and civil servants working in the ward, commune belong to the staffing of district and county-level staff and civil servants; they are managed and utilized by the District and County People's Committees.

2. The number of staff and civil servants working in the ward, commune shall be implemented in accordance with the Government's regulations on the number of grassroots-level staff and civil servants.

3. Decision-making and allocation of the number of staff and civil servants working in the ward, commune

a) Annually, the Municipal People's Committee shall submit to the Municipal People's Council for a decision on the number of staff and civil servants working in the ward, commune for each district and county within the city, within the total number of staff and civil servants allocated to the District and County People's Committees, but ensuring that the total number of staff and civil servants working in the wards and communes across all districts and counties does not exceed the total number of staff and civil servants working in the wards and communes for the entire city as prescribed by law;

b) Based on the number of staff and civil servants working in the ward, commune for each district and county decided by the Municipal People's Council according to point a of this clause, the District and County People's Committees shall decide on the specific number of staff and civil servants working in each ward and commune and allocate the number of civil servants for each civil servant position working in the ward and commune within their management scope in accordance with the requirements and tasks of each ward and commune. The number of staff and civil servants in each ward and commune may be lower than the level of type III wards and communes or higher than the level of type I wards and communes as prescribed by law, but must ensure that it does not exceed the total number of staff and civil servants working in the wards and communes of the entire district and county allocated by the Municipal People's Council.

Article 14. Election, appointment, and management of cadres working at wards and communes

1. The election, appointment, management, removal, dismissal, and resignation from positions of cadres working at wards and communes in the city shall be carried out in accordance with the provisions of the Civil Servants Law, the Local Administration Organization Law, the National Assembly Deputies and People's Council Deputies Election Law, and other relevant laws, party regulations, and political-social organization regulations at the central level.

2. After the competent authority approves the election results or appoints the position of cadres working at wards and communes, the Chairman of the People's Committee of the city shall base on the professional standards of the civil servant rank to issue a decision appointing to the civil servant rank and determining salary for commune-level cadres. This decision has the same effect as a recruitment decision for those who are not yet civil servants to consider job assignment and division of work according to the provisions of Clause 4 of this Article.

3. The leadership position allowance for cadres working at wards and communes in the city shall be implemented in accordance with the Government's regulations on managing commune-level civil servants.

4. Depending on work requirements, tasks, or when ceasing to hold a position, cadres working at wards and communes shall be assigned, divided, transferred to work as civil servants at wards and communes or civil servants at district level or higher if they meet the new job position standards and conditions. The appointment to the civil servant rank and determination of salary at the new job position shall be carried out in accordance with the legal provisions on civil servant management.

Article 15. Recruitment, appointment, and management of civil servants working at District People's Committees and Ward People's Committees

1. The People's Committee of the city, the Chairman of the People's Committee of the city shall implement or delegate authority to specialized agencies under the City People's Committee in the internal affairs sector, District People's Committees, County People's Committees, Chairmen of District People's Committees, and County People's Committees to carry out the recruitment, appointment, and management of civil servants working at District People's Committees and Ward People's Committees.

2. The recruitment, appointment, and management of civil servants working at District People's Committees and Ward People's Committees shall be carried out in accordance with the provisions of the Civil Servants Law, the Government's regulations on recruitment, appointment, and management of civil servants, and the provisions of this Decree.

For the position of Chief of the Militia Self-Defense Force Ward, the appointment shall be carried out in accordance with point d, Clause 1, Article 23 of the Militia Self-Defense Law. The appointment decision is also a recruitment decision for those who are not yet civil servants.

Article 16. Procedures and formalities for appointment, reappointment, dismissal, transfer, rotation, detail, commendation, disciplinary action, temporary suspension of duty, resignation, and resignation from leadership and management positions of District and Ward People's Committees

1. The procedures and formalities for the appointment, reappointment, dismissal, transfer, rotation, detail, commendation, disciplinary action, temporary suspension of duty, resignation, and resignation of the Chairmen, Deputy Chairmen of District and Ward People's Committees, and other leadership and management positions of District and Ward People's Committees shall be carried out in accordance with the provisions of the Civil Servants Law, Party regulations on cadre work, and the Government's regulations on recruitment, appointment, and management of civil servants.

2. Term of office for leadership and management positions at the district and ward levels

a) The term of office for the Chairman and Deputy Chairman of District and Ward People's Committees for each appointment is five years, calculated from the date the appointment decision takes effect;

b) The Chairman of District and Ward People's Committees shall not hold the position continuously for more than ten years in the same administrative unit;

c) When the term of office for the Chairman and Deputy Chairman of District and Ward People's Committees expires, the competent authority must conduct a review process for reappointment or extension of the term of office, except in cases where the law provides otherwise.

Chapter V
ESTABLISHING BUDGET PROPOSALS, IMPLEMENTATION, AND SETTLEMENT
DISTRICT AND WARD BUDGETS

Article 17. Preparation of the District and Ward Budget Estimates

1. The People's Committee of the district is the level I budget entity assigned by the People's Committee of the city to prepare the revenue and expenditure budget estimates, including the budget estimates for revenue and expenditure of subordinate agencies and units, and the budget estimates for revenue and expenditure of the People's Committees of wards and districts performing the duties and powers of budget entities directly under the People's Committee of the city; the People's Committee of the ward performs the duties and powers of budget entities directly under the People's Committee of the district according to Article 32 of the State Budget Law and guiding documents.

2. Annually, the People's Committee of the ward prepares the revenue and expenditure budget estimates and sends them to the specialized agency under the People's Committee of the district in the field of finance for review and consolidation together with the district budget estimates to be submitted to the People's Committee of the district. The People's Committee of the district prepares detailed revenue and expenditure budget estimates, including detailed development investment expenditures and regular expenditures by each sector, each agency, and each unit using the budget directly under the district and each ward, and sends them to the specialized agency under the People's Committee of the city in the field of finance for review and consolidation to report to the People's Committee of the city for submission to the People's Council of the city for decision.

Within the latest five working days from the date the People's Council of the city decides on the budget estimates, the People's Committee of the city assigns the next year's budget estimates to the People's Committee of the district. Before December 31 of each year, the People's Committee of the district must complete the assignment of the next year's budget estimates to each ward and each direct subordinate budget entity.

Article 18. Implementation of the District and Ward Budgets

1. Based on the Resolution of the People's Council of the city and the decision on budget allocation by the People's Committee of the city, the People's Committee of the district implements the allocation and assignment of budget estimates to each agency and unit using the budget directly under the district and each ward within the district, sending it to the specialized agency under the People's Committee of the city in the field of finance, while also sending it to the State Treasury where transactions take place for implementation. The allocation and assignment of budget estimates must ensure the deadlines and requirements stipulated in Articles 49 and 50 of the State Budget Law and guiding documents.

2. The People's Committee of the district and the People's Committee of the ward organize the implementation of the assigned revenue and expenditure budget estimates; submit all amounts due to the state budget in full and on time as prescribed by law; spend according to regulations, policies, purposes, objects, progress, and within the scope of the assigned budget estimates.

3. The Chairman of the People's Committee of the district and the Chairman of the People's Committee of the ward are responsible for managing and using the budget according to the assigned budget estimates, evaluating the results of tasks performed, ensuring efficiency, economy, compliance with policies, regulations, standards, and budget expenditure quotas; periodically reporting the evaluation of the results of implementing the assigned budget estimates to the immediate superior management agency.

4. Adjustments to the district and ward budget estimates during the implementation of the budget are carried out according to the provisions of Article 53 of the State Budget Law and guiding documents.

Article 19. Settlement of the State Budget

1. Annually, the People's Committee of the district directs the specialized agency under the People's Committee of the district in the field of finance to cooperate with tax agencies, the State Treasury, and related departments to examine and approve the settlement of budget revenues and expenditures of subordinate agencies and units, and to consolidate the settlement of the district budget.

The People's Committee of the ward prepares the annual report on the settlement of budget revenues and expenditures of the ward, reports it to the specialized agency under the People's Committee of the district in the field of finance for examination and approval, and consolidates the report on the settlement of the district budget to report to the People's Committee of the district, which then submits it to the specialized agency under the People's Committee of the city in the field of finance for verification and consolidation of the settlement of the state budget, to be reported to the People's Committee of the city for submission to the People's Council of the city for approval.

2. The People's Committee of the district and the People's Committee of the ward send the reports on the settlement of budget revenues and expenditures to relevant agencies, ensuring the time and forms as prescribed by the State Budget Law and guiding documents.

Chapter VI

IMPLEMENTING PROVISIONS

Article 20. Effective Date

1. This Decree takes effect from January 1, 2025.

2. Decree No. 34/2021/NĐ-CP dated March 29, 2021 of the Government detailing and providing implementation measures for Resolution No. 119/2020/QH14 dated June 19, 2020 of the National Assembly on piloting urban administrative models and some special mechanisms and policies for the development of Da Nang City ceases to be effective from the date this Decree takes effect.

Article 21. Transitional Provisions

1. From the date this Decree takes effect, village cadres and workers and ward cadres who meet the prescribed criteria may be transferred to become county-level or higher cadres and workers working at wards and villages. In cases where they are transferred to new positions, cadres and workers must meet the conditions and criteria suitable for those positions.

The specialized agency under the People's Committee of the county in the field of personnel reviews the files of village cadres and workers and ward cadres to report to the Chairman of the People's Committee of the county and send it to the specialized agency under the People's Committee of the city in the field of personnel for verification, and to submit to the Chairman of the People's Committee of the city to issue a decision transferring ward and village cadres and workers to become cadres and workers under the county-level or higher establishment working at wards and villages.

2. Chairmen and Deputy Chairmen of the People's Committee of the district; Chairmen and Deputy Chairmen of the People's Committee of the ward appointed before January 1, 2025 continue to perform their duties and powers as prescribed. The term of office is calculated based on the appointment decision.

3. Civil servants working at the People's Committee of the ward recruited and appointed to civil service ranks before January 1, 2025 continue to be managed and utilized according to the provisions of this Decree.

4. Officials and civil servants at the commune level and officials at the ward level who have not yet met the standards prescribed in Clause 1 of this Article must meet such standards within three years from the date this Decree takes effect; during this period, they continue to enjoy the systems and policies currently in place according to the Government's regulations on commune-level officials and civil servants and non-professional staff at the commune level; if they fail to meet the required standards by the end of the three-year period, they will be subject to retirement benefits (if eligible) or reduction in personnel according to the Government's regulations.

5. The People's Committee of the city shall be responsible for developing training and capacity-building plans for commune-level officials and ward-level officials to meet the standards for officials and civil servants and job requirements.

6. The time spent holding positions in Party organizations, People's Councils, People's Committees, Vietnam Fatherland Front Committees, and other political and social organizations at the ward and commune levels before the effective date of this Decree shall be counted towards the time spent holding positions as prescribed.

Article 22. Responsibility for enforcement

1. The Ministry of Home Affairs shall be responsible for guiding, inspecting, and auditing the implementation of urban administrative organization in cities as stipulated in Resolution No. 136/2024/QH15 and this Decree.

2. The People's Councils and People's Committees of cities shall be responsible for implementing this Decree.

3. The People's Committee of the city shall be responsible for:

a) Issuing a model regulation on the operation of the People's Committee of the district and ward;

b) Issuing regulations on the classification of management of civil servants working at the district People's Committee and officials and civil servants working at the ward and commune levels;

c) Guiding the People's Committee of the district and ward in implementing financial and budgetary regulations when implementing urban administrative organization.

4. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of the People's Committee of the city, and related agencies, organizations, and individuals shall be responsible for enforcing this Decree.
