DECISION NO. 171/2000/QĐ-BTC OF THE MINISTER OF FINANCE ON OCTOBER 27, 2000 ISSUING FEES FOR APPROVING SCREENPLAYS AND FILMS AND GRANTING PERMITS FOR AUDIOVISUAL ACTIVITIES

THE MINISTER OF FINANCE

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities of ministries and ministerial-level agencies in managing their respective sectors;
Pursuant to the Prime Minister's Decision No. 853/1997/CT-TTg dated October 11, 1997 on combating smuggling under new circumstances;
Pursuant to Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the State budget;
Pursuant to Decree No. 48/CP dated July 17, 1995 of the Government on organization and operation of cinema; Decree No. 87/CP dated December 12, 1996 of the Government on strengthening management of cultural activities and cultural services and intensifying eradication of serious social evils;
After reaching consensus with the Ministry of Culture and Information and upon the proposal of the Director General of the Tax General Department,

DECISION:

Article 1.-

Organizations and individuals who have their film screenplays, films approved and permits for audiovisual activities granted by state management agencies authorized to manage such matters must pay fees according to the rates prescribed in this Decision.

Article 2.-

The rates for fees for approving film screenplays, films and granting permits for audiovisual activities are stipulated as follows:

1. Approving film screenplays, including those of film production companies, commissioned films, sponsored films, co-productions with foreign countries, and film-making services with foreign countries:

a) Feature film screenplays:

- Up to 100 minutes (one episode): 1,200,000 (one million two hundred thousand) VND per episode.

- From 101 to 150 minutes (1.5 episodes): 1,800,000 (one million eight hundred thousand) VND per film.

- From 151 to 200 minutes counted as two episodes.

b) Short film screenplays, including documentary films, scientific films, animated films:

- Up to 60 minutes: 500,000 (five hundred thousand) VND per episode.

- From 61 minutes onwards charged as feature films.

c) Screenplays produced from cooperative activities, film-making services with foreign countries:

c1- Feature films:

- Up to 100 minutes (one episode): 2,000,000 (two million) VND per episode.

- From 101 to 150 minutes (1.5 episodes): 3,000,000 (three million) VND per film.

- From 151 to 200 minutes counted as two episodes.

c2- Short films:

- Up to 60 minutes: 800,000 (eight hundred thousand) VND per episode.

- From 61 minutes onwards charged as feature films.

2. Approving films:

a) Feature films:

- Up to 100 minutes (one episode): 600,000 (six hundred thousand) VND per episode.

- From 101 to 150 minutes (1.5 episodes): 900,000 (nine hundred thousand) VND per film.

- From 151 to 200 minutes counted as two episodes.

b) Short films (documentary, scientific, animated...):

- Up to 60 minutes: 350,000 (three hundred fifty thousand) VND per episode.

- From 61 minutes onwards charged as feature films.

3. Granting permits for audiovisual activities (including review of applications):

- Permit for film production activities (for three years): 100,000 (one hundred thousand) VND.

- Temporary permit for film production (for one film): 200,000 (two hundred thousand) VND.

- Permit for audiovisual professions (director, cinematographer...): 50,000 (fifty thousand) VND.

The above rates apply for each registration and permit issuance. In cases where screenplays, audiovisual works... have complex issues requiring corrections and resubmission for approval, subsequent submissions will be charged at 50% (fifty percent) of the corresponding rates above. For screenplays, audiovisual works that fail to meet the required conditions and thus are not granted production or audiovisual activity permits, the paid fees will not be refunded.

Article 3.-

The fee collection agency is entitled to retain 90% (ninety percent) of the collected fees before remitting them to the State budget for expenses related to screenplay and film approvals, application reviews, and fee collection organization; the remaining 10% of the collected fees must be remitted to the State budget. The fee collection agency is responsible for collecting, remitting to the budget, and managing the use of collected fees in accordance with Circular No.

54/1999/TT-BTC dated May 10, 1999 of the Ministry of Finance guiding the implementation of Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the State budget.

Article 4.-

Local tax authorities where the fee collection agency is located are responsible for guiding and inspecting the implementation of fee collection in accordance with this Decision and Circular No.

54/1999/TT-BTC dated May 10, 1999 of the Ministry of Finance guiding the implementation of Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the state budget.

Article 5.-

This Decision shall take effect fifteen days from the date of signature. All provisions regarding fees for approving film screenplays, films and granting permits for audiovisual activities contrary to this Decision are hereby abolished.

Article 6.-

The subjects paying fees for approving film screenplays, films and granting permits for audiovisual activities, the agencies assigned the task of organizing fee collection, and relevant agencies are responsible for implementing this Decision.
