Circular No. 172/2018/TT-BQP Amending and Supplementing Certain Provisions of Circular No. 102/2016/TT-BQP dated June 29, 2016, of the Minister of National Defense on Registration, Management, and Use of Motor Vehicles within the Ministry of National Defense

Provincial People's Committees set specific pricesTo amend and supplement some articles of Circular No. 102/2016/TT-BQP dated June 29, 2016, issued by the Minister of National Defense, on registration, management, and use of motor vehicles within the Ministry of National Defense.

BASED ON THE LAW ON TRAFFIC ON ROADS 2008;

Based on Decree No. 164/2017/NĐ-CP dated December 30, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Director of the General Department of Technology;

The Minister of National Defense issues this Circular to amend and supplement some articles of Circular No. 102/2016/TT-BQP dated June 29, 2016, issued by the Minister of National Defense, on registration, management, and use of motor vehicles within the Ministry of National Defense (hereinafter referred to as Circular No. 102/2016/TT-BQP).

Article 1. Amend and supplement some articles of Circular No. 102/2016/TT-BQP.

1. Amend and supplement Clause 2, Article 5 as follows:

“2. Registration license plate signature: Shall be specified separately for each agency and unit under the Ministry of National Defense according to the provisions at Appendix II of this Circular. In case of newly established agencies and units under the Ministry of National Defense, the General Staff shall direct relevant agencies to register supplementary according to regulations, ensuring uniformity and standardization.”

2. Supplement Article 18a as follows:

"Article 18a. Documents for registering additional military vehicle license plates, for vehicles serving Party and State leaders; vehicles of Sector II and the Military Security Bureau that have registered civilian license plates."

1. Decision of the Chief of General Staff regarding the registration and issuance of military vehicle license plates.

2. Vehicle registration form according to Form No. 01 in Appendix I of this Circular.

3. Certified copy of the original vehicle registration and file.”

3. Amend and supplement Clause 2, Article 19 as follows:

“2. Cases of issuing temporary license plates with limited routes according to Form No. 03 in Appendix I of Circular No. 102/2016/TT-BQP include:

a) Imported cars, domestically produced or assembled cars during transportation, emergency tasks, or special missions;

b) Cars for surveying or testing projects under programs of the Ministry of National Defense;

c) Cars given, donated, imported non-commercially, or as gifts that are movable assets.”

4. Supplement Clause 3, Article 19 as follows:

“3. In addition to the provisions of Clause 1 and Clause 2 of Article 19 of Circular No. 102/2016/TT-BQP, when assigned urgent or special tasks by the State, the Minister of National Defense decides to issue temporary license plates according to the requirements of the mission.”

5. Amend and supplement Point b, Clause 2, Article 21 as follows:

“b) Vehicle registration form according to Form No. 01 in Appendix I of this Circular (not applicable for reissuing license plates).”

6. Amend and supplement Clause 2, Article 23 as follows:

“2. Drivers of military vehicles must have a valid military driving license (drivers of vehicles carrying military license plates for Party and State leaders may use civilian driving licenses); they must strictly comply with traffic laws and regulations set by the Ministry of National Defense to ensure absolute safety when participating in traffic.”

7. Amend and supplement Article 24 as follows:

"Article 24. Conditions for military vehicles when operating"

1. When participating in traffic, they must meet all the following requirements:

a) Registration number plate;

b) Registration certificate;

c) Valid inspection sticker affixed to the windshield;

d) Auxiliary number system;

đ) Work permit for the vehicle;

e) For cargo transport vehicles, there must be cargo documents. Special cases shall be handled according to the law;

g) Logbook of vehicle activities.

2. When performing training driving tasks, in addition to the provisions of Clause 1 of this Article, the following must be present:

a) Driving practice permit;

b) Practice vehicle sign.

3. In cases of trial operation, the following must be present:

a) Repair orders or test run plans approved by competent authorities;

b) Warning signs "test run" made of red acrylic with white letters (size 297 mm x 210 mm) hung at the front and rear of the vehicle.

4. Vehicles serving Party and State leaders:

a) Registration number plate;

b) Registration certificate according to Form No. 02 in Appendix I of this Circular;

c) Other documents as required by law.”

8. Amend and supplement Appendices I and III issued along with Circular No. 102/2016/TT-BQP as follows:

“a) Amend and supplement Form No. 01 in Appendix I regarding the Vehicle Registration Form (the amended and supplemented contents are stipulated in Form No. 01 in Appendix I of this Circular);

b) Add Form No. 02 in Appendix I regarding the Registration Certificate for vehicles serving Party and State leaders as stipulated in Appendix I of this Circular;

c) Amend and supplement Appendix III regarding the license plate symbols of agencies and units (the amended and supplemented contents are stipulated in Appendix II of this Circular).”

Article 2. Effectiveness and responsibility for implementation

1. This Circular takes effect from February 10, 2019.

2. Within six months from the date this Circular takes effect, agencies and units (with changes in license plate symbols and registration certificates) must complete the issuance of new license plates and registration certificates for military vehicles according to the provisions of this Circular.

3. The Director of the Technical Service Department, heads of agencies, units, organizations, and related individuals are responsible for implementing this Circular.

4. The Director of the Motor Vehicle Department is responsible for guiding and organizing the implementation of this Circular.
