DECISION

Regarding reduction of load capacity during flood season

for inland waterway transport vessels

THE MINISTER OF TRANSPORTATION

Pursuant to the Government Decree No. 22/CP dated March 22, 1994 on tasks, powers and responsibilities of state management and organizational structure of the Ministry of Transportation;

Pursuant to the Government Decree No. 40/CP dated July 5, 1996 on ensuring traffic order and safety for inland waterways and the Government Decree No. 77/1998/CP-NĐ amending and supplementing certain provisions of the Government Decree No. 40/CP;

Pursuant to Decision No. 581-TTg dated July 25, 1997 of the Prime Minister promulgating the Storm and Flood Warning Regulations;

Considering the proposals by the Heads of the Legal Department of the Transport Service Bureau and the Director General of Vietnam Inland Waterways Administration.

DECIDES:

Article 1.

1. All types of inland waterway transport vessels operating on inland waterways must reduce their load capacity by 10% during the flood season in each region as follows:

a) On rivers in Northern Vietnam: from June 15 to October 15;

b) On rivers from Thanh Hoá to Hà Tĩnh: from July 15 to November 15;

c) On rivers from Quảng Bình to Bình Thuận: from September 1 to November 30;

d) On rivers in Southern Vietnam and the Central Highlands: from June 15 to November 30.

2. Vessels operating on the following areas are exempted from reducing load capacity under this Decision: lakes, bays, coastal waters, routes to islands, inter-island connections, downstream river sections not affected by floods.

Article 2. This Decision takes effect fifteen days after its date of issuance and replaces Decision No. 2049 QĐ/PC issued on August 6, 1996 by the Minister of Transportation.

Article 3. The Heads of the Ministry’s Office, Legal Department, Vietnam Inland Waterways Administration, Directors of Provincial Departments of Transport and Public Works, General Managers of Northern and Southern Inland Waterway Corporations, and relevant organizations and individuals are responsible for implementing this Decision./.
