THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

Pursuant to the Press Law dated December 28, 1989 and the Law Amending and Supplementing Certain Provisions of the Press Law dated June 12, 1999;
Pursuant to Decree No. 48/2008/ND-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Considering the proposal of the Editor-in-Chief of the State Administration Magazine, the Director of the Cadre and Civil Servant Organization Department,

DECISION:

Article 1. Position and Functions

1. The State Administration Magazine is a press organ of the Ministry of Home Affairs, with the function of disseminating and promoting the Party's guidelines, state policies, and laws regarding the field of state organization as prescribed by the Press Law and the Minister of Home Affairs; it serves as a scientific forum for exchanging practical experiences, theories, and professional knowledge about the organization and operation of the administrative apparatus.

2. The State Administration Magazine is a public service unit with legal personality, having its own seal and separate account, which can open accounts at commercial banks and state treasuries.

3. The headquarters of the State Administration Magazine is located in Hanoi; it has representatives in localities as prescribed by the Press Law and the Ministry of Home Affairs;

Article 2. Tasks and Authorities

1. To develop and implement plans and development master plans of the Magazine after approval by the Minister.

2. To organize editing, publishing, and distributing the magazine according to the permit of the Ministry of Information and Communications, as prescribed by the Ministry of Home Affairs and the Press Law.

3. To organize editing, publishing, and distributing special issues and supplements serving the work requirements according to the functions and tasks of the Ministry of Home Affairs; to cooperate with departments and units under the Ministry to organize editing, publishing, and distributing professional literature, information, and books serving the work of state organization as prescribed by the Press Law and the Ministry of Home Affairs.

4. To participate and coordinate in organizing conferences, seminars, or major events of the sector and the Ministry of Home Affairs.

5. To conduct and participate in researching topics, scientific projects, and programs serving the work of the Magazine and the tasks of the Ministry of Home Affairs.

6. To build and utilize a network of contributors and informants nationwide to fulfill the Magazine's tasks as prescribed by the State and the Ministry of Home Affairs.

7. To perform international cooperation tasks as assigned and delegated by the Ministry of Home Affairs.

8. The State Administration Magazine shall have the right:

a) To attend meetings of the Ministry of Home Affairs, of departments and units under the Ministry; to be provided with information and documents by leaders of departments and units under the Ministry in their respective fields to fulfill the Magazine's functions and tasks;

b) To organize professional meetings, seminars, and roundtables to serve the Magazine's dissemination and publication work;

c) To attend meetings of ministries, ministerial-level agencies, government agencies, and centrally-administered provincial-level cities concerning state organization work to collect information for the Magazine's dissemination work;

d) To request the Organization and Cadre Departments of ministries, ministerial-level agencies, government agencies, and provincial-level People's Committees to provide information and situation reports to fulfill the Magazine's work tasks.

9. To coordinate with departments and units under the Ministry of Home Affairs according to the assigned functions and tasks during the implementation of the Ministry's activities, serving the Magazine's dissemination work.

10. To sign information dissemination and promotion contracts, and special issue construction contracts with ministries, sectors, and localities according to the assigned functions and tasks.

11. To manage and build a cadre and civil servant workforce, manage finances and assets of the Magazine according to the regulations of the State and the Ministry of Home Affairs.

Article 3. Organizational Structure and Operating Mechanism

1. The State Organization Magazine operates under a chief editor system, headed by the Chief Editor. The Chief Editor of the Magazine is appointed by the Minister of Home Affairs and is responsible to the Minister of Home Affairs and the law for all activities of the Magazine. Deputy Chief Editors assisting the Chief Editor are appointed by the Chief Editor and the Director of the Cadre and Civil Service Department upon recommendation by the Minister of Home Affairs. Staff members of the State Organization Magazine are classified and appointed to professional ranks according to current state regulations.

2. The organizational structure of the State Organization Magazine includes:

a) Editorial Room;

b) Editorial Secretary Room;

c) Management and Synthesis Room;

d) Distribution and Advertising Room;

e) Representative Office in Ho Chi Minh City.

3. The staffing of the State Organization Magazine is implemented in accordance with the Press Law and decided by the Minister of Home Affairs.

The State Organization Magazine may utilize contractual labor from public service units in accordance with state regulations and those of the Ministry of Home Affairs.

4. The Editorial Board is an advisory body assisting the Chief Editor on scientific content orientation and improving the quality of the Magazine, comprising some scientific and managerial staff both within and outside the Ministry of Home Affairs. The Editorial Board is established by the Chief Editor.

5. The State Organization Magazine receives operational funding from the Ministry of Home Affairs according to the State Budget Law, the Press Law, and other sources as stipulated by current state and Ministry of Home Affairs regulations.

6. The State Organization Magazine applies the mechanism of a revenue-generating public service unit as prescribed by the Government.

7. The Chief Editor is responsible for establishing the Operational Regulations of the Magazine and implementing them after approval by the Minister.

Article 4. This Decision takes effect from the date of signature and replaces Decision No. 40/2003/QĐ-BNV dated July 17, 2003 of the Minister of Home Affairs regarding the functions, tasks, authorities, and organizational structure of the State Organization Magazine.

Article 5. The Head of the Ministry's Office, the Chief Editor of the State Organization Magazine, the Director of the Cadre and Civil Service Department, and the heads of departments and units under the Ministry, as well as staff members of the State Organization Magazine, are responsible for implementing this Decision.
