Regarding the List of State Secrets of Confidential Level in the Agriculture and Rural Development Sector
THE MINISTER OF PUBLIC SECURITY
Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;
Pursuant to Decree No. 136/2003/ND-CP dated November 14, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;
After reaching consensus with the Minister of Agriculture and Rural Development.
DECISION:
Article 1. The List of State Secrets of Confidential Level in the Agriculture and Rural Development Sector includes information within the following scope:
1. Absolute data from basic surveys in the Agriculture and Rural Development sector that have not been published;
2. List of plant, animal, and microbial agricultural and forestry gene sources prohibited for international exchange, restricted in international exchange, and exchanged internationally only under special circumstances as prescribed by the Minister of Agriculture and Rural Development;
3. List of gene and seed sources, livestock breeds, and microbial organisms transferred from foreign organizations to Vietnam or collected by Vietnamese organizations from other sources that have not been published;
4. Research-stage technological processes, initial materials for breeding animal, plant, and microbial species, inventions, and utility models protected by state patents;
5. Information and data about harmful organisms and microorganisms affecting plant and animal resources, animal and plant products, and microbial regions with outbreaks that have not been published (in cases where international treaties to which Vietnam is a party provide otherwise, such provisions shall apply); chemicals and formulations for protecting agricultural and forest products and their environmental impact during the research stage that have not been published;
6. Information and data about dam reservoir accidents, dike incidents, floods, typhoons related to national security and defense, and other key economic and social sectors of the industry, data on resource losses that have not been published;
7. Development plans, investment construction plans, annual and long-term budget allocation plans for the sector, strategic policies at the research and review stages, and implementation solutions to achieve sectoral development goals that have not been published;
8. Negotiation proposals, regulations, and procedures for implementing the Mekong River International Agreement; studies recommending measures to mitigate adverse impacts from the upper reaches of the Mekong River;
9. Tender package contents from preparation to opening bids and evaluation documents during the tender process for basic construction projects managed by the Ministry of Agriculture and Rural Development that have not been published;
10. Contents of meetings of the Ministry's leadership or the Party Cadre Committee related to organizational cadre work; lists of cadres in planning, leadership cadre files at the department level and above of the Ministry that have not been published;
11. Statistical and accounting data specific to the sector currently being processed and compiled but not yet published;
12. Inspection, supervision, and investigation data according to functions and results of inspections, supervisions, investigations, and complaints resolution currently in the verification and draft stages that have not been published;
13. Recruitment examination questions, rank promotion examination questions, and accompanying answers of the sector that have not been published;
14. Information network technical documentation and design, confidentiality, security, and internal computer network protection regulations of the sector.
Article 2. This Decision takes effect fifteen days after its publication in the Official Gazette. Competent agencies of the Ministry of Agriculture and Rural Development and the Ministry of Public Security are responsible for inspecting the implementation of this Decision.
Article 3. Ministries; ministerial-level agencies; government agencies; People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision./.
