THE MINISTER OF JUSTICE

Pursuant to the Government Decree No. 62/2003/NĐ-CP dated June 6, 2003, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to the Government Decree No. 08/2000/NĐ-CP dated March 10, 2000, on security interest registration;

Pursuant to the Government Decree No. 16/2001/NĐ-CP dated May 2, 2001, on the organization and operation of financial leasing companies;

Pursuant to the Decision No. 104/2001/QĐ-TTg dated July 10, 2001, of the Prime Minister on the establishment of the National Registry of Security Interests under the Ministry of Justice;

Pursuant to the Decision No. 171/QĐ-BTP dated March 24, 2005, of the Minister of Justice on approving the project for improving the organizational structure and personnel of the National Registry of Security Interests;

Considering the proposal of the Director of the National Registry of Security Interests and the Head of the Personnel Department, Ministry of Justice.

DECISION:

Article 1. Establish the Property Transaction Registration Center of the National Registry of Security Interests under the Ministry of Justice in Da Nang City (hereinafter referred to as Center No. 3), based on the Branch of Property Transaction Registration of the National Registry of Security Interests under the Ministry of Justice in Da Nang City.

The headquarters of Center No. 3 is located at No. 32B Phan Dinh Phung Street, Hai Chau Ward, Hai Chau District, Da Nang City.

Center No. 3 is a self-financing public service unit with legal personality, its own seal, and separate bank account.

Article 2. Center No. 3 has the following tasks and powers:

1. Registering security interests over various types of assets, except for security interests over aircraft, ships, land use rights, and immovable property attached to land;

2. Registering assets for financial leasing;

3. Registering and providing information on other transactions and assets as prescribed by law;

4. Providing information on registered transactions and assets and information stored in the national database of security interests;

5. Promoting and disseminating laws on transaction registration;

6. Performing other tasks assigned by the Director of the National Office for Secured Transactions.

Article 3. Center No. 3 shall carry out registration and provide information on the transactions and assets mentioned in Clauses 1, 2, 3, and 4 of Article 2 of this Decision upon request of individuals and organizations throughout the country.

Article 4. The organization and operation of Center No. 3 shall comply with relevant laws and regulations and the provisions of the Ministry of Justice.

The staffing of Center No. 3 includes the Director, Deputy Director, and specialized staff members, which shall be determined by the Director of the National Registry of Security Interests in coordination with the Head of the Personnel Department, to be submitted to the Minister of Justice for decision.

Article 5. The operating budget of Center No. 3 shall be allocated by the Minister of Justice within the annual budget of the National Registry of Security Interests.

Article 6. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

This Decision replaces Decision No. 257/2004/QĐ-BTP dated May 14, 2004, of the Minister of Justice on the establishment of the Branch of Property Transaction Registration of the National Registry of Security Interests in Da Nang City.

Article 7. The Chief of the Office, Heads of the Personnel Department, the National Registry of Security Interests, the Planning and Finance Department, and heads of related units under the Ministry are responsible for implementing this Decision./.
