DIRECTIVE
ON URGENT MEASURES TO IMPLEMENT THE PROVISIONAL AGREEMENT ON THE SETTLEMENT OF MATTERS IN THE VIETNAM-CHINA BORDER AREA
WORK IN THE VIETNAM-CHINA BORDER AREA
Implementing the Provisional Agreement on the Settlement of Matters in the Vietnam-China Border Area signed on November 7, 1991 has yielded some results, contributing to promoting the normalization and strengthening of friendly relations between the two countries, expanding economic, cultural exchanges, and neighborly relations.
During the implementation process, new issues have arisen in the relationship between the two countries due to various reasons, including many provisions in the Agreement not being fully implemented, with some provisions still unimplemented, causing disorder on the border, illegal trade and criminal activities developing seriously, adversely affecting the economic-security situation of our country.
To address the above situation, promptly rectify border management, the Prime Minister instructs:
1- Ministries, central agencies, and localities must strictly implement state regulations, manage the border in accordance with the provisions of the Provisional Agreement, and take appropriate measures to request China to satisfactorily resolve incidents that occur, paying attention to intrusion, settlement, and changes in the current actual border situation in accordance with the spirit of the Agreement.
2- Localities and the Ministry of Home Affairs should expedite the issuance of travel documents for crossing the border, and at the same time request China to adopt similar measures so that all citizens of both countries crossing the border must have valid documents as stipulated in the Agreement; stop the practice of crossing the border with invalid documents.
3- Localities and relevant sectors should actively prepare and agree with China to officially open two pairs of border gates by January 1, 1993:
+ Mong Cai - Dong Heng
+ Lao Cai - Ha Khau.
Prepare conditions to officially open other border gates specified in the Agreement, initially Ta Lung - Thu Hoa, Ma Lu Thang - Kim Thuy Ha, and Thanh Thuy - Tianbao in the first half of 1993. Other border gates will be opened as soon as they meet the necessary conditions.
4- The Ministry of Transport and the Railway Union must urgently contact and exchange with the Chinese railway sector regarding issues related to the rail connection area to find specific solutions based on maintaining the current actual railway status and not using flat roofs at the rail connection point.
Regarding communication along the Dong Dang - Bang Lang railway section as well as the construction of technical facilities, all railway operations in the rail connection area must be discussed and agreed upon between the two railway sectors to officially open the Dong Dang - Bang Lang border gate as soon as possible.
5- The Ministry of Trade and the State Bank should promptly contact relevant Chinese sectors to discuss and promote trade relations in accordance with the Vietnam-China Trade Agreement, which includes two forms: export-import trade under contracts signed between authorized companies of the two countries according to international practices and folk trade among residents in border areas.
Urgently sign agreements on currency and export-import payment, bringing the exchange of goods by border residents into order.
6- The Ministry of Home Affairs and the General Customs Department should promptly conduct meetings with relevant Chinese sectors to agree on specific measures to better manage security order in the border area, combat smuggling, crime, drug trafficking, arms trafficking, human trafficking...
7- The Ministry of Foreign Affairs is responsible for urging and guiding sectors and provinces sharing borders with China to implement this Directive./.
