Regarding the affixing of stamps on domestically produced cigarettes

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

To strictly manage domestic cigarette production and circulation, to combat counterfeit goods, and to prevent tax revenue loss;

At the proposal of the Minister of Finance and the Minister of Industry;

DECISION:

Article 1. As of April 1, 2000, all domestically produced cigarette packs from legally established enterprises must be affixed with stamps according to regulations when they are dispatched from the factory and circulated in the market.

Article 2. The Ministry of Finance shall be responsible for issuing and uniformly managing cigarette stamps nationwide. Any cases of printing, distributing, and using stamps not in accordance with regulations will be handled according to current laws.

Article 3. It is strictly prohibited to trade in domestically produced cigarettes without affixed stamps. Violations will be subject to administrative penalties or criminal prosecution depending on their nature and severity, as stipulated by law.

Article 4. The Ministry of Health shall cooperate with the Ministry of Science and Technology and the Environment and relevant agencies to promulish before December 31, 1999, the Vietnamese standards for the quality of domestically produced cigarette products. Only products meeting Vietnamese standards and having been granted trademark registration certificates shall be allowed to be stamped and circulated in the market.

Article 5. The Ministers of Finance, Industry, and Trade are responsible for guiding and organizing inspections of the implementation of this Decision.

Article 6. The Chairmen of the People's Committees of provinces and centrally governed cities are responsible for directing local functional sectors to inspect, detect, and strictly handle organizations and individuals producing and trading in unstamped cigarettes.

Article 7. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision.
