DECREE

Regarding the implementation of the Ordinance on the title of honor "Heroic Mother Vietnam"

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Ordinance on the title of honor "Heroic Mother Vietnam" dated August 29, 1994;

At the proposal of the Minister of Labor, Invalids and Social Affairs, and the Minister of Defense;

 

DECREE:

Article 1

Mothers who are awarded or posthumously awarded the title "Heroic Mother Vietnam" under the Ordinance on the title of honor "Heroic Mother Vietnam" are those mothers who have made significant contributions and sacrifices for the national liberation cause, national defense, and international duty, falling into one of the following cases:

1- Having two children who are martyrs and having a husband or being herself a martyr;

2- Having two children, both of whom are martyrs, or only one child who is a martyr;

3- Having three or more children who are martyrs;

4- Having one child who is a martyr, a husband who is a martyr, and being herself a martyr.

The child who is a martyr includes the biological and adopted children recognized by law, and has been awarded the Certificate of Merit by the Government.

A mother who meets any of the four cases above and suffers from mental illness due to the loss of her children and/or husband still qualifies for the award of the title "Heroic Mother Vietnam."

The husband who is a martyr referred to in this Article is someone who has been awarded the Certificate of Merit "National Commendation" and whose wife receives the pension benefits for martyrs.

Article 2

Mothers awarded the title "Heroic Mother Vietnam" shall be granted the Certificate and Medal "Heroic Mother Vietnam," along with a one-time payment of three million dong, and shall enjoy preferential treatment as stipulated in the Ordinance on Preferential Treatment for Revolutionary Activists, Martyrs, and Their Families, War Invalids, Veterans, and Those Who Have Contributed to the Revolution.

Mothers posthumously awarded the title "Heroic Mother Vietnam" shall have their Certificate, Medal "Heroic Mother Vietnam," and a one-time payment of three million dong handed over to the relatives responsible for worshipping them. The Chairman of the People's Committee of the province or city where the relatives reside shall consider and decide on the awarding of these items.

Article 3

The authority and procedures for proposing the award or posthumous award of the title "Heroic Mother Vietnam" are as follows:

1- The Chairman of the People's Committee of the commune, ward shall prepare a list of mothers eligible for the award or posthumous award of the title "Heroic Mother Vietnam" and report it to the Chairman of the People's Committee of the district, town.

The Vietnam Fatherland Front, the Vietnam Women's Union, the Vietnam Veterans Association, and other organizations shall assist the Chairman of the People's Committee of the commune, ward in checking and verifying the list of proposed awards or posthumous awards of the title "Heroic Mother Vietnam" of their locality.

The Chairman of the People's Committee of the district, town shall review, verify, and compile the report to the Chairman of the People's Committee of the province, centrally-administered city.

2- The Chairman of the People's Committee of the province, centrally-administered city shall compile the list of proposed awards or posthumous awards of the title "Heroic Mother Vietnam" of their locality and submit it to the Prime Minister (through the National Awards and Honors Council); at the same time, send a copy to the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Defense.

3- The National Awards and Honors Council shall cooperate with the Ministry of Labor, Invalids and Social Affairs, the Ministry of Defense, and related agencies to assist the Prime Minister in reviewing and compiling the list of mothers proposed for the award or posthumous award of the title "Heroic Mother Vietnam" of the provinces and centrally-administered cities, to be submitted to the President for decision.

4- The dossier for proposing the award or posthumous award of the title "Heroic Mother Vietnam" of localities shall include:

a) The proposal letter of the Chairman of the People's Committee of the province, centrally-administered city, accompanied by a list of mothers proposed for the award or posthumous award of the title "Heroic Mother Vietnam," one copy sent to the National Awards and Honors Council, one copy sent to the Ministry of Labor, Invalids and Social Affairs, and one copy sent to the Ministry of Defense.

b) The registration form for each mother prepared by the People's Committee of the commune, ward, and the minutes of the verification meeting of the political and social organizations mentioned above.

Article 4

The National Awards and Honors Council shall ensure the quantity of Certificates and Medals "Heroic Mother Vietnam" according to the model approved by the Prime Minister.

The Minister of Labor, Invalids and Social Affairs, and the Minister of Defense shall be responsible for guiding and supervising the application of the cases specified in Article 1 of this Decree for the award of the title "Heroic Mother Vietnam."

The Minister of Finance shall be responsible for ensuring the funding for the production of Certificates, Medals, and the one-time monetary benefit for "Heroic Mother Vietnam."

The funding for organizing the ceremony to present the title "Heroic Mother Vietnam" in localities shall be guaranteed by the state budget; the Minister of Finance shall guide the centrally-administered provinces and cities to implement this.

Article 5

The Chairman of the People's Committee of the province, centrally-administered city shall be responsible for organizing the ceremony to present the title "Heroic Mother Vietnam" in their locality, ensuring solemnity and practicality.

Article 6

If mothers who have been awarded the title "Heroic Mother Vietnam" no longer deserve such a title, the Chairman of the People's Committee of the province, centrally-administered city shall carefully examine and thoroughly consult the opinions of the people at the grassroots level, then submit to the Prime Minister for consideration; the Prime Minister shall submit to the President for decision.

This Decree takes effect from December 1, 1994.

Localities shall proceed to prepare lists for the award or posthumous award of the title "Heroic Mother Vietnam" during the 50th anniversary of the founding of the Vietnam People's Army on December 22, 1994, and the 50th anniversary of the founding of the Socialist Republic of Vietnam on September 2, 1995; thereafter, they shall propose for examination annually on National Day, September 2.

Article 8

The Minister of Labor, Invalids and Social Affairs, the Minister of Defense, the Minister of Finance, the Director of the National Awards and Honors Council, and the Chairmen of the People's Committees of the centrally-administered provinces and cities shall be responsible for implementing this Decree./.
