DECISION OF THE PRIME MINISTER

Regulations on functions, tasks, powers, and organizational structure

of the National Archives and Records Administration

 

PRIME MINISTER 

Pursuant to the Law on Organization of the Government dated December 25, 2001;

BASED ON the National Archives Law dated April 4, 2001;

Pursuant to Decree No. 86/2002/ND-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

At the request of the Minister of Home Affairs,

 

DECISION:

Article 1. Position and Functions

1. The National Archives and Records Administration is an agency under the Ministry of Home Affairs, performing state management functions in the fields of records, archives, and national archival document management within the State of Vietnam Archive according to the provisions of the law.

2. The National Archives and Records Administration has a seal with the National Emblem.

Article 2. Tasks and Powers

1. Drafting and submitting to the Minister of Home Affairs normative legal documents on records and archives;

2. Submitting to the Minister of Home Affairs strategies, planning for development, five-year plans, annual plans on records and archives;

3. Issuing guidance documents on records and archives business procedures according to the regulations of the Minister of Home Affairs;

4. Organizing the implementation and guiding, inspecting the implementation of state regulations on records and archives;

5. Managing documents belonging to the State of Vietnam Archive, including:

a) Directing and guiding the selection, supplementation, preservation, and organization of use of documents at National Archives Centers, other historical archives, current archives of state agencies, social organizations, social-professional organizations, economic organizations, and people's armed forces units;

b) Guiding individuals, families, clans in collecting, supplementing, preserving, and protecting personal, family, and clan archival documents that have the value of national archival documents according to the provisions of the law.

6. Implementing state statistics on archives;

7. Organizing and implementing scientific research plans, applying scientific and technological progress in records and archives work;

8. Implementing international cooperation on records and archives according to the division of labor by the Minister of Home Affairs;

9. Deciding and directing the implementation of administrative reform programs for subordinate organizations according to the division of labor by the Minister of Home Affairs;

10. Inspecting, checking, resolving complaints and denunciations, and handling violations of laws on records and archives;

11. Managing staffing; implementing salary systems and various incentive policies, rewards, disciplinary measures, training, and professional development for officers and civil servants under its management; appointing, relieving from duty, and dismissing leadership positions in organizations under the National Archives and Records Administration according to the provisions of the Minister of Home Affairs regarding the delegation of management authority;

12. Managing financial resources and assets assigned, and organizing the implementation of the budget allocated according to the provisions of the law.

Article 3. Organizational structure of the National Archives and Records Administration

a) The National Archives and Records Administration has a Director and Deputy Directors. The Director and Deputy Directors are appointed by the Minister of Home Affairs.

b) Organizations assisting the Director in state management:

1. Central Records and Archives Business Procedures Department;

2. Local Records and Archives Business Procedures Department;

3. National Archives and Records Administration Inspectorate;

4. Cadre Organization Department;

5. Planning and Finance Department;

6. Office.

c) Affiliated organizations:

1. National Archives Center I;

2. National Archives Center II;

3. National Archives Center III;

4. National Document Preservation Center;

5. National Document Restoration and Replication Center;

6. Scientific Research Center;

7. Information Technology Center;

8. Vietnam Records and Archives Magazine.

d) Other affiliated organizations:

1. Central Records and Archives Secondary School I;

2. Central Records and Archives Secondary School II.

Article 4. Effectiveness

This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 5. Responsibility for Implementation

The Minister of Home Affairs, ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, chairpersons of provincial and centrally-administered city People's Committees, and the Director of the National Archives and Records Administration are responsible for enforcing this Decision./.
