Regarding the establishment of the Industrial Zone Management Board of Kon Tum Province
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 36/CP dated April 24, 1997 of the Government promulgating the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones;
At the request of the Chairman of the People's Committee of Kon Tum Province and the Minister of Home Affairs,
DECISION:
Article 1. The Industrial Zone Management Board of Kon Tum Province is established under the People's Committee of Kon Tum Province to manage industrial zones within the territory of Kon Tum Province.
The Industrial Zone Management Board of Kon Tum Province has legal personality, has its own bank account, office premises, and seal with the national emblem; it serves as the focal point for planning and budgeting of the People's Committee of Kon Tum Province, and is allocated separate construction capital from the state budget. The staffing and operating expenses of the Management Board are included in the staffing and state budget allocated to Kon Tum Province.
Article 2. Tasks and Powers
The Industrial Zone Management Board of Kon Tum Province is responsible for performing tasks and exercising powers related to managing industrial zones as stipulated in Article 27 of the Regulation on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government.
Article 3. Organizational Structure and Staffing
1. Organizational Structure:
a) The Industrial Zone Management Board of Kon Tum Province shall have a Director appointed by the Prime Minister; several Deputy Directors and some members shall be appointed by the Chairman of the People's Committee of Kon Tum Province upon the recommendation of the Director.
b) The Industrial Zone Management Board of Kon Tum Province shall have an administrative apparatus as specified in Article 28 of the Regulation on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government, specifically including:
- Office;
- Inspectorate;
- Specialized departments.
Depending on the requirements for developing industrial zones in Kon Tum Province at each specific stage, the Director of the Industrial Zone Management Board of Kon Tum Province shall submit proposals on organizational structure for the Chairman of the People's Committee of Kon Tum Province to decide within his authority.
2. Staffing:
The staffing of the Industrial Zone Management Board of Kon Tum Province includes the Director, specialized Deputy Directors, and the staffing of the Office, Inspectorate, and specialized departments, which are civil service positions.
The staffing of the Industrial Zone Management Board of Kon Tum Province shall be determined by the Chairman of the People's Committee of Kon Tum Province in accordance with Decree No. 71/2003/NĐ-CP dated June 19, 2003 of the Government on decentralizing management of administrative and public service staffing, and Decree No. 112/2004/NĐ-CP dated April 8, 2004 of the Government on mechanisms for managing staffing for state-owned public institutions.
Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.
Article 5. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, the Chairman of the People's Committee of Kon Tum Province, and the Director of the Industrial Zone Management Board of Kon Tum Province are responsible for implementing this Decision./.
