Of the President of the Government of the Democratic Republic of Vietnam No. 177 dated September 10, 1946
The President of the Government of the Democratic Republic of Vietnam
Pursuant to Decree No. 60 dated May 6, 1946 organizing the Military Commission;
Pursuant to Decree No. 57 dated May 3, 1946 regulating the organization of ministries;
At the proposal of the Chairman of the Military Commission,
After deliberation by the Council of Ministers;
Enacts:
Article 1
Clause 3 of Decree No. 60 dated May 6, 1946 referred to above is hereby amended and supplemented as follows:
"The Military Commission is a supreme military body responsible for commanding the national army.
The Military Commission operates directly under the control of the Government and consists of a Chairman and a Vice-Chairman at the level of Minister or Deputy Minister.
The Military Commission has an Office to assist the Chairman or Vice-Chairman in political tasks. Regulations and rules related to ministries within the Vietnamese government may be applied to the Military Commission regarding administrative, financial, and personnel matters.
The Chairman of the Military Commission shall issue decrees to implement laws within the scope of the commission's responsibilities. However, for the appointment and transfer of officers from the rank of colonel and above, the Military Commission must consult with the Minister of National Defense."
Article 2
The Chairman of the Military Commission and the Minister of National Defense shall implement this Decree.
