Regarding the establishment of the Management Board for Industrial Zones of Binh Dinh Province

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 36/CP dated April 24, 1997 of the Government promulgating the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones;

At the request of the Chairman of the People's Committee of Binh Dinh Province and the Minister of Home Affairs,

DECISION:

Article 1. The Management Board for Industrial Zones of Binh Dinh Province is established under the People's Committee of Binh Dinh Province to manage industrial zones within the territory of Binh Dinh Province.

The Management Board for Industrial Zones of Binh Dinh Province has legal personality, has its own bank account, office premises, and seal with the national emblem; it serves as the budget planning focal point of the People's Committee of Binh Dinh Province, and is allocated construction capital from the state budget separately. The staffing and operating expenses of the Management Board are included in the staffing and state budget allocated to Binh Dinh Province.

Article 2. Tasks and Powers

The Management Board for Industrial Zones of Binh Dinh Province is responsible for performing tasks and exercising powers related to managing industrial zones as stipulated in Article 27 of the Regulation on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government.

Article 3. Organizational Structure and Staffing

1. Organizational Structure:

a) The Management Board for Industrial Zones of Binh Dinh Province shall have a Director appointed by the Prime Minister; several Deputy Directors and some members appointed by the Chairman of the People's Committee of Binh Dinh Province upon the recommendation of the Director.

b) The Management Board for Industrial Zones of Binh Dinh Province shall have an organizational structure as specified in Article 28 of the Regulation on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government, specifically including:

- Office;

- Inspectorate; 

- Specialized departments.

Depending on the specific development requirements of industrial zones in Binh Dinh Province at different stages, the Director of the Management Board for Industrial Zones of Binh Dinh Province shall submit proposals on organizational structures to the Chairman of the People's Committee of Binh Dinh Province for decision within their authority.

2. Staffing:

The staffing of the Management Board for Industrial Zones of Binh Dinh Province includes the Director, specialized Deputy Directors, and the staffing of the office, inspectorate, and specialized departments, which are civil service management staff.

The staffing of the Management Board for Industrial Zones of Binh Dinh Province is determined by the Chairman of the People's Committee of Binh Dinh Province in accordance with Decree No. 71/2003/NĐ-CP dated June 19, 2003 of the Government on decentralization of administrative and public service staffing management, and Decree No. 112/2004/NĐ-CP dated April 8, 2004 of the Government on mechanisms for managing staffing for state-owned units.

Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 5. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, the Chairman of the People's Committee of Binh Dinh Province, and the Director of the Management Board for Industrial Zones of Binh Dinh Province are responsible for implementing this Decision./.
