Pursuant to Decree 96/CP dated December 7, 1993 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;

Pursuant to Decree No. 152/1999/NĐ-CP dated September 20, 1999 of the Government on the regulations concerning Vietnamese workers and experts going to work abroad for a limited period;

Pursuant to Decision No. 1635/1999/QĐ-BLĐTBXH dated December 13, 1999 of the Minister of Labor, War Invalids and Social Affairs on the issuance of the Regulation on training and orientation education for Vietnamese workers going to work abroad for a limited period;

Based on the proposal of the Director of the Department of Overseas Labor Management.

Article 1. This Decision promulgates the interim regulation on the issuance and management of Training and Orientation Education Certificates for workers going to work abroad for a limited period.

Article 2.This decision shall take effect fifteen days from the date of signature.

Article 3.The Director of the Department of Overseas Labor Management, the Director of the Labor and Social Publishing House, the Directors of Provincial Departments of Labor, War Invalids and Social Affairs, the Directors and Principals of training and orientation education institutions for workers going to work abroad for a limited period, and the Heads of relevant agencies and units shall be responsible for implementing this Decision.

REGULATIONS

INTERIM REGULATION ON THE ISSUANCE AND MANAGEMENT OF TRAINING AND ORIENTATION EDUCATION CERTIFICATES

for workers going to work abroad for a limited period
(PROMULGATED BY DECISION NO. 179/2000/QĐ-BLĐTBXH DATED FEBRUARY 22, 2000 OF THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS)

PART I

GENERAL PROVISIONS

Article 1. The Training and Orientation Education Certificate for workers going to work abroad for a limited period (hereinafter referred to as the Training and Orientation Education Certificate) mentioned in this Regulation is the Training and Orientation Education Certificate issued pursuant to Decision No. 1635/1999/QĐ-BLĐTBXH dated December 13, 1999 of the Minister of Labor, War Invalids and Social Affairs on the issuance of the Regulation on training and orientation education for Vietnamese workers going to work abroad for a limited period.

Article 2. The training institution for workers going to work abroad for a limited period (hereinafter referred to as the training institution) mentioned in this regulation is the organization with legal personality as prescribed in Article 3 of the Regulation on training and orientation education for Vietnamese workers going to work abroad for a limited period of the Ministry of Labor, War Invalids and Social Affairs promulgated on December 13, 1999.

Chapter II

MANAGEMENT OF TRAINING AND ORIENTATION EDUCATION CERTIFICATES

Article 3. The Department of Overseas Labor Management shall coordinate with the Labor and Social Publishing House to uniformly print, manage, and distribute Training and Orientation Education Certificates nationwide.

The Training and Orientation Education Certificate shall bear a raised stamp of the Department of Overseas Labor Management on the cover (page 1) and shall be numbered in sequence.

Article 4. The training institution shall receive Training and Orientation Education Certificates from the Department of Overseas Labor Management to issue to workers according to the annual registered quantity and report the number issued quarterly and annually to the Department of Overseas Labor Management.

Article 5. The Department of Foreign Labor Management and training institutions must establish a record to monitor and issue Training and Orientation Education Certificates; in cases where the Training and Orientation Education Certificate is lost, the training institution, in addition to reporting to the police agency for investigation, must immediately report to the Department of Foreign Labor Management for review and resolution.

Article 6. Training institutions shall perform the following tasks: affixing the student's photograph who has been issued a Certificate, stamping the training institution's seal on the photograph (bottom right corner), and filling out all contents in the Certificate; the contents recorded in the Certificate (pages 2 and 3) shall be written in black ink; handwriting must be clear; the student's name who has been issued the Certificate shall be written in capital letters.

Article 7. The Department of Foreign Labor Management shall guide the recovery of the original and issuance of a new Certificate in cases where the Training and Orientation Education Certificate is damaged.

Chapter III

ISSUING TRAINING AND ORIENTATION EDUCATION CERTIFICATE

Article 8. The authority to issue the Training and Orientation Education Certificate is the Rector or Director of the training institution as stipulated in this regulation.

Article 9. Training institutions shall organize the issuance of the Training and Orientation Education Certificate to students who have completed the course within no more than five days from the end date of the course, based on the examination decision.

Article 10. Students who complete the training and orientation education course and pass the examination requirements will be issued a certificate. If a student who has received a Certificate loses it and provides confirmation from an authorized agency, they may be considered for reissuance. The reissuance of the Certificate shall be regulated by the Department of Foreign Labor Management.

Article 11. Students have the right to lodge complaints about the issuance of the Training and Orientation Education Certificate by the training institution according to the law with the Department of Foreign Labor Management. Within fifteen days from the date of receipt of the complaint, the Department of Foreign Labor Management must respond according to its authority.

Chapter IV

IMPLEMENTATION

Article 12. Any organization or individual violating the printing, issuance, management, and distribution of the Training and Orientation Education Certificate shall be subject to disciplinary action, administrative handling, or criminal liability depending on the severity of the violation.

Article 13. The Department of Foreign Labor Management shall be responsible for guiding training institutions on the issuance and management of the Training and Orientation Education Certificate; regularly organizing inspections and reporting on the implementation of this Regulation.
