Pursuant to the Government Organization Law on February 18, 2025;
Pursuant to the Law on Information Technology dated June 29, 2006;
||| Pursuant to the Cybersecurity Law dated November 19, 2015;
||| Pursuant to the Cyber Security Law dated June 12, 2018;
||| Based on the proposal of the Minister of Home Affairs;
||| The Government issues this Decree stipulating the level of support for persons engaged in full-time work related to digital transformation, cybersecurity, and cyber security.
Article 1. Scope of Regulation
||| This Decree stipulates the level of support for persons engaged in full-time work related to digital transformation, cybersecurity, and cyber security within Party organizations of the Communist Party of Vietnam, State agencies, and the Vietnam Fatherland Front (including political-social organizations) from central to commune levels, and armed forces (military, police, cryptographic services).
Article 2. Applicability
||| Persons engaged in full-time work related to digital transformation, cybersecurity, and cyber security as stipulated in Article 1 of this Decree (hereinafter referred to collectively as persons engaged in full-time work related to digital transformation) include:
1\. Civil servants, public officials, and employees holding positions responsible for managing information technology or information technology (including: information technology industry or digital technology industry, digital technology, application of information technology, digital transformation); cybersecurity or information security, cyber security; electronic transactions, and other positions related to digital transformation as prescribed by competent authorities.
2\. Police officers, non-commissioned officers, technical specialists, and police workers in the People's Public Security Force; military officers, professional soldiers, defense workers in the People's Army, and personnel working in cryptographic organizations receiving state budget salaries engaged in full-time work related to digital transformation, cybersecurity, cyber security, ensuring national sovereignty in cyberspace, and other subjects related to digital transformation according to the authority of the Ministry of National Defense and the Ministry of Public Security.
Article 3. Level of Support
1\. Persons stipulated in Article 2 of this Decree shall receive a monthly support amount of VND 5,000,000.
2\. The support level stipulated in Clause 1 of this Article shall be paid together with the monthly salary and shall not be used to calculate contributions or benefits under social insurance and health insurance laws.
3\. The support level stipulated in this Article shall apply until the implementation of salary policy reforms according to the directives of the competent authority.
Article 4. Periods Not Eligible for Support
1\. Continuous periods of absence without pay of one month or more.
2\. Periods of leave during which social insurance benefits are received as prescribed by social insurance laws.
3\. Periods of detention, arrest, temporary suspension of duties, or suspension of duties.
4\. Continuous periods during which the person does not hold a position as specified in Article 2 of this Decree for one month or more.
Article 5. Funding Implementation
The funding for implementing the support level stipulated in this Decree shall be implemented as follows:
1\. For civil servants, public officials, and members of the armed forces: To be guaranteed by the state budget according to current budget decentralization regulations stipulated in the State Budget Law and other legitimate sources of funding.
2\. For public officials in public service units
a\. Public service units that self-fund their regular expenses and investment costs: Funding for the support payment shall come from the unit's operational revenue and other legitimate sources of income;
b\. Public service units that self-fund their regular expenses: Funding for the support payment shall come from the unit's operational revenue and other legitimate sources of income;
c\. For public service units that partially self-fund their regular expenses: Funding for the support payment shall come from the unit's operational revenue, state budget allocation, and other legitimate sources of income. The state budget will allocate funds based on the number of persons engaged in full-time work related to digital transformation receiving state budget salaries assigned by the competent authority (if applicable);
d\. For public service units fully funded by the state budget: To be allocated by the state budget.
Article 6. Responsibilities for Implementation
1. The Ministry of Science and Technology shall be responsible for guiding the determination of positions eligible for the support level specified in this Decree within its state management functions.
2. The Ministry of National Defense and the Ministry of Public Security shall be responsible for guiding the determination of individuals engaged in specialized work on cybersecurity, information security, cyber security, ensuring national sovereignty in cyberspace, and those related to digital transformation who are eligible for the support level as prescribed in this Decree within their state management functions and those under their authority.
3. The Ministry of Finance shall be responsible for submitting to the competent authority the budget allocation to implement the support level as stipulated in this Decree.
4. The head of the agency managing civil servants, public officials, and armed forces (military, police, cryptographic services) shall be responsible for:
a) Directing and guiding the heads of agencies, organizations, and units under their jurisdiction to compile lists of individuals eligible for the support level specified in this Decree; preparing budget estimates for implementation, submitting them to the competent authority for review and decision in accordance with the State Budget Law;
b) Directing the personnel organization agency and financial agency to verify the lists, individuals, and funds for implementing the support level; deciding on the individuals eligible for the support level and organizing the implementation of the support level for those engaged in specialized work on digital transformation within their jurisdiction in accordance with the regulations;
c) Annually, based on the implementation of policies, directing the financial agency to prepare budget estimates for implementing the support level as stipulated in this Decree for consolidation and submission to the competent authority for allocation and assignment of the budget estimate in the state budget of the following year.
Article 7. Effective Date
This Decree takes effect from August 15, 2025.
Article 8. Responsibility for Implementation
The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairpersons of People's Committees of provinces and centrally governed cities, and relevant agencies, organizations, units, and individuals shall be responsible for enforcing this Decree.
