Pursuant to the Press Law dated December 28, 1989 and the Law Amending and Supplementing Certain Provisions of the Press Law dated June 12, 1999;

Based on Decree No. 55/2005/NĐ-CP dated April 25, 2005 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Government Inspectorate;

Based on Decree No. 43/2006/NĐ-CP dated April 25, 2006 of the Government stipulating the autonomy and self-responsibility for performing tasks, organizational structure, staffing, and finance for public service units;

Considering the proposal of the Editor-in-Chief of the Inspection Newspaper and the Director of the Personnel Department;

Article 1. Issued herewith are the "Regulations on Functions, Tasks, Authorities, and Operation Organization of the Inspection Newspaper".

Article 2. This Decision takes effect from the date of signing and replaces Decision No. 345/QĐ-TTNN dated March 31, 1994 of the State Inspector General regarding the establishment of the Editorial Board and the Complaints Room, and Decision No. 882/QĐ-TTNN dated October 19, 1999 of the State Inspector General regarding the transformation of the Inspection Newspaper into a self-financing public service unit.

Article 3. The Heads of the Office, the Personnel Department, the Editor-in-Chief of the Inspection Newspaper, and the Heads of units under the Government Inspectorate are responsible for implementing this Decision.

REGULATIONS

FUNCTIONS, TASKS, AUTHORITIES AND ORGANIZATION OF THE INSPECTION NEWSPAPER

PART I

FUNCTIONS, TASKS, POWERS

Article 1. Position and Functions

The Inspection Newspaper is the press organ of the Government Inspectorate and the inspection sector, having the function of propagating the Party's guidelines and policies, the State’s policies and laws, especially those related to inspection, complaint resolution, and anti-corruption; providing truthful, objective, and timely information about the activities of the inspection sector according to the Law on Press and the Government Inspectorate.

The Inspection Newspaper is a self-financing public service unit that ensures its own operational costs, has its own seal, and can open separate accounts at banks and the National Treasury. The main office of the Inspection Newspaper is located in Hanoi City.

Article 2. Tasks and Authorities

1. Duties:

a- The Inspection Newspaper is responsible for operating in accordance with the objectives and purposes stated in the Publishing Permit, as prescribed by the Law on Press and the laws on inspection.

b- Organizing editing, publishing, and distributing the Inspection Newspaper and related publications in accordance with the press activity permit, relevant legal documents, and directives from the State Inspector General.

c- Timely informing and propagating the Party's guidelines and policies, the State’s policies and laws concerning inspection work, complaint resolution, and anti-corruption.

d- Providing timely information on political, economic, social conditions, and inspection activities of inspection agencies in ministries, sectors, and localities; international cooperation activities in state management conducted by the Government Inspectorate.

đ- Propagating and disseminating laws on inspection, complaint resolution, and anti-corruption in the Inspection Newspaper.

e- Promoting new factors, good people, and good deeds; participating in anti-corruption efforts; criticizing illegal acts.

f- Building and utilizing a team of contributors to fulfill the tasks of the Inspection Newspaper.

g- Managing staff members of the Inspection Newspaper in accordance with the law and the delegation of authority from the State Inspector General.

h- Managing and using assets and finances allocated in accordance with the law and regulations of the Government Inspectorate.

i- Fulfilling other tasks assigned by the State Inspector General.

2. Authorities:

a- The Inspection Newspaper shall exercise the rights and authorities stipulated in the Law on Press, guiding documents of the competent state management agency on press activities, and regulations of the State Inspector General.

b- The autonomy and self-responsibility of the Inspection Newspaper for performing tasks, organization, personnel, and finance shall be implemented in accordance with the law and the delegation of authority from the State Inspector General.

c- Being authorized to send reporters to attend meetings of the inspection sector.

d- Requesting leaders of subordinate units under the Government Inspectorate to provide information on areas they are responsible for; requesting inspection agencies at all levels and sectors to provide information on inspection work, complaint resolution, and anti-corruption.

đ- Signing information, propaganda, and special topic construction contracts with ministries, sectors, and localities in accordance with assigned functions and tasks.

Chapter II

ORGANIZATIONAL STRUCTURE OF THE INSPECTION NEWSPAPER

Article 3. Organizational Structure

1. Leadership of the Inspection Newspaper includes the Editor-in-Chief and Deputy Editors-in-Chief.

2. Functional units of the Newspaper include:

2.1- Readers' Room;

2.2- Complaints Room;

2.3- Economic Room;

2.4- Social Room;

2.5- Editorial Room;

2.6- Management Room;

2.7- Representative Office of the Inspection Newspaper in Ho Chi Minh City.

3. Specific tasks and authorities of subordinate units of the Inspection Newspaper shall be defined by the Editor-in-Chief based on assigned functions and tasks.

Article 4. Duties and Authorities of the Editor-in-Chief

The Editor-in-Chief of the Inspection Newspaper shall have the following duties and authorities:

1. Proactively organize the implementation of the tasks of the Newspaper as stipulated in Article 2 of this Regulation; bear legal responsibility and be accountable to the Chief Inspector for the results of the assigned work.

2. Direct the development and organization of the implementation of the work plan of the Inspection Newspaper.

3. Implement the information reporting system according to the laws and regulations of the Government Inspectorate.

4. Assign tasks, coordinate activities, and monitor the performance of tasks by Deputy Editors-in-Chief, subordinate units, and staff members of the Newspaper.

5. Maintain work discipline, manage, evaluate, and implement commendation and reward activities for staff members of the Newspaper; develop and implement cadre planning and training plans for the Newspaper.

6. Develop scientific labor norms suitable for the requirements of the Newspaper based on consulting with the Trade Union organization.

7. Decide on the use and management of the Newspaper's budget and assets according to the current financial regulations of the State.

8. Coordinate with Department Heads and Heads of units under the Government Inspectorate to handle issues related to the functions and tasks of the Newspaper and perform the common tasks of the agency as prescribed in the Working Regulations of the Government Inspectorate.

9. The Editor-in-Chief of the Inspection Newspaper has the authority to:

9.1- Determine the total number of positions annually for the Newspaper based on the need for cadres and the financial capacity of the unit.

9.2- Decide on the recruitment of cadres and civil servants to work at the Newspaper through competitive examinations or selection, after reporting (through the Cadre and Civil Servant Organization Department) and obtaining permission from the Chief Inspector; set salaries, appoint to civil servant ranks, and sign employment contracts with those recruited.

9.3- Sign labor contracts and task contracts to carry out tasks that do not require regular staffing.

9.4- Decide on the arrangement and utilization of cadres and civil servants in accordance with their capabilities and professional qualifications.

9.5- Decide on the appointment, reappointment, resignation, and removal of heads and deputy heads of subordinate departments after reporting (through the Cadre and Civil Servant Organization Department) and obtaining permission from the Chief Inspector.

9.6- Decide on timely salary increases, early salary increases within the same rank, and the acceptance and transfer of ranks for specialist positions and below according to the conditions and standards prescribed by law.

9.7- Decide on the transfer, assignment, retirement, termination of employment, labor contracts, commendations, and disciplinary actions for cadres and civil servants under management according to the law.

9.8- Resolve complaints and denunciations according to the law regarding cadres and civil servants, contractual cadres under management.

9.9- Decide on inviting domestic and foreign experts to work; send staff members of the Newspaper to work and study domestically and abroad to improve their expertise.

9.10- Manage and retain the files of cadres and civil servants, contractual cadres of the Inspection Newspaper (excluding the files of the Editor-in-Chief and Deputy Editors-in-Chief); compile statistics and report on the cadre strength under management to the Government Inspectorate as prescribed.

Article 5. Duties and Authorities of Deputy Chief Editors

1. Deputy Chief Editors are leading cadres of the Newspaper, assisting the Chief Editor in managing and directing the Newspaper's operations; directly managing certain areas of work as assigned by the Chief Editor and being responsible to the Chief Editor for the tasks entrusted.

2. Deputy Chief Editors perform the duties and authorities of the Chief Editor within the scope authorized by the Chief Editor.

Article 6. Duties and Authorities of Heads of Departments, Deputy Heads, and Equivalent Positions (referred to as Department Heads and Deputy Department Heads) of the Newspaper

1. The Head of a Department is responsible for managing and directing the work of the Department and is accountable to the Chief Editor for the implementation of assigned tasks.

2. The Deputy Head of a Department assists the Head of the Department in managing and directing the work of the Department and is accountable to the Head of the Department for the implementation of assigned tasks.

3. Specific duties and authorities of Department Heads and Deputy Department Heads shall be stipulated by the Chief Editor.

Article 7. Duties and Authorities of Cadres and Staff Members of the Inspection Newspaper

Cadres, staff members, and workers of the Inspection Newspaper are subject to the general management of the Chief Editor and have rights and obligations as prescribed by laws on cadres and civil servants and labor laws.

Reporters, Editors, and Journalists working at the Inspection Newspaper have rights and obligations as prescribed by laws on press.

Chapter III

WORKING REGIME

Article 8. Principles of Work

The Inspection Newspaper operates under the head system, ensuring the principle of centralized democracy, emphasizing individual responsibility and discipline, and promoting initiative and creativity in the work of all cadres and staff members of the Newspaper.

Article 9. Planning System

Based on the program, plan of work, and key tasks of the Government Inspectorate, the Chief Editor decides on the work plan of the Newspaper and guides and organizes the inspection of the implementation of these plans.

Article 10. Reporting and Information System

1. Periodic and ad hoc reporting of the Newspaper's work is carried out according to the Working Regulations of the Government Inspectorate.

Plans and reports on the work of units under the Newspaper are stipulated by the Chief Editor of the Newspaper.

2. The Newspaper has the responsibility to inform cadres and staff members of the following information:

- Policies and guidelines of the Party, State, and Government Inspectorate related to the functions and tasks of the Newspaper and the industry;

- Internal regulations and working regulations of the Government Inspectorate and the Newspaper;

- Programs of work of the Government Inspectorate and the Newspaper;

- Annual financial income and expenditure activities;

- Recruitment, study abroad, commendation, disciplinary action, salary increase, rank promotion, appointment, and removal of cadres and staff members of the Newspaper;

- Conclusions on the resolution of complaints and petitions related to cadres and staff members of the Newspaper;

- Other information as directed by the Chief Inspector.

3. The exchange and provision of information by cadres and staff members of the Newspaper must be conducted in accordance with the provisions of the law, the industry of the Inspectorate, and the Government Inspectorate.

Article 11. Financial System of the Newspaper

The collection, expenditure, use, and management of funds and finances of the Inspection Newspaper are carried out in accordance with Decree No. 43/2006/NĐ-CP dated April 25, 2006, of the Government and other guiding documents on financial management systems for public institutions, regulations of the Chief Inspector, and other relevant laws.

Chapter IV

WORK RELATIONSHIPS

Article 12. Implementation of the directives of the Government Inspectorate Leadership

The Inspectorate Newspaper shall be under the leadership and direct guidance of the Chief Inspector, the Deputy Chief Inspector responsible for press work, and shall have the responsibility to:

1. Strictly implement all directives.

2. Report fully and promptly on the results of implementing the directives.

Article 13. Work relations with departments and units under the Government Inspectorate

1. Relations between the Inspectorate Newspaper and departments and units under the Government Inspectorate are cooperative, exchange, and mutual support relations to complete tasks.

2. Cooperation with other Departments and units in performing tasks shall be carried out in accordance with Article 9 of the Working Regulations of the Government Inspectorate, issued pursuant to Decision No. 1963/QĐ-TTCP dated October 20, 2006 of the Chief Inspector.

Article 14. Relations between newspaper leadership and party committees and other leaderships of mass organizations

1. Newspaper leadership shall create conditions for the Party organization and mass organizations to operate according to their charters, purposes, and objectives; cooperate with the Party committee and leadership of mass organizations to create conditions for Party members and staff of the newspaper to study and improve political and professional qualifications, work effectively; ensure democratic regulations at the grassroots level in the newspaper's activities, build a culture in the educational and disciplinary environment of the agency.

2. Newspaper leadership shall have the responsibility to provide full and timely information about the newspaper's operational activities and the rights of its staff to the Party committee and leadership of mass organizations; seek opinions from the Party committee and leadership of mass organizations before deciding issues related to measures for leading ideological education, internal protection, consolidating unity, caring for the lives of staff in the newspaper; about organizational and personnel work of the newspaper.

Chapter V

IMPLEMENTATION

Article 15. Responsibility for Implementation

1. The Editor-in-Chief, Deputy Editors-in-Chief, and all staff of the Inspectorate Newspaper shall be responsible for implementing this Regulation. The Editor-in-Chief shall be responsible for disseminating this Regulation to all staff of the newspaper to organize implementation.

2. Other contents related to the functions, duties, powers, and organization of the newspaper that are not covered in this Regulation shall be implemented in accordance with the Working Regulations of the Government Inspectorate and current legal documents.

3. The Editor-in-Chief of the Inspectorate Newspaper, the Director of the Organization and Cadre Department, and the Head of the Office shall be responsible for monitoring, inspecting, and urging the implementation of this Regulation; compiling comments, researching, and promptly proposing supplements and amendments to the Regulation in line with the requirements of the Inspectorate Newspaper and the Government Inspectorate./.
