Pursuant to the Law on Inspection dated June 15, 2004;

Pursuant to Decree No. 55/2005/NĐ-CP dated April 25, 2005 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Pursuant to Decree No. 43/2006/NĐ-CP dated April 25, 2006 of the Government stipulating the autonomy and responsibility for implementing tasks, organizational structure, staffing, and finance for public service units;

Considering the proposal of the Rector of the Inspection Cadres School and the Director of the Organization and Cadre Affairs Department,

Pursuant to …;

Article 1. The attached Decision hereby promulgates the "Regulations on the functions, tasks, powers, and organization of operation of the Inspection Cadres School."

Article 2. This Decision takes effect from the date of signature and replaces Decision No. 920/TNNN dated June 19, 2006 of the State Inspector General regarding the stipulation of the functions, tasks, powers, and organizational structure of the Inspection Cadres School and Decision No. 638/QĐ-TTNN dated June 27, 2002 of the State Inspector General regarding the establishment of the Teacher Department and the renaming of the Organization and Teaching Affairs Office of the Inspection Cadres School.

Article 3. The Chief of the Office, the Director of the Organization and Cadre Affairs Department, the Rector of the Inspection Cadres School, and the Heads of units under the Government Inspectorate shall be responsible for implementing this Decision.

REGULATIONS

FUNCTIONS, TASKS, POWERS AND ORGANIZATION OF OPERATION OF THE INSPECTION CADRES SCHOOL
(Issued together with Decision No.: 1797/2007/QĐ-TTCP dated August 27, 2007 of the State Inspector General)

Chapter I.

FUNCTIONS, TASKS, POWERS

Article 1. Position and Functions

1. The Inspection Cadres School is a unit under the Government Inspectorate, having the function of training and enhancing inspection skills and necessary knowledge related to inspection activities for the cadre force of the Inspection sector.

2. The training and enhancement programs of the Inspection Cadres School include:

a- Basic inspection training and enhancement program.

b- Advanced inspection training and enhancement program.

c- Senior inspection training and enhancement program.

d- Specialized topic training and enhancement program for updating knowledge to serve inspection work, handling complaints and grievances, and preventing corruption.

3. The Inspection Cadres School is a self-financing public service unit that partially ensures its regular operational funding, has its own seal, and is entitled to open separate accounts at banks and the State Treasury; its main office is located in Hanoi City.

Article 2. Tasks and Authorities

The Inspection Cadres School has the following tasks and powers:

1. To develop and submit to the State Inspector General for approval programs, plans, and projects within the scope of responsibilities of the School concerning training and enhancing inspection skills for cadres and civil servants in the Inspection sector.

2. To develop textbooks, compile teaching materials, and prepare lectures suitable for different training and enhancement targets related to inspection skills.

3. To organize, manage, and teach concentrated classes at the school; to coordinate with Inspectors of Ministries, sectors, provinces, and centrally-administered cities to organize regional classes to implement training and enhancement of inspection skills and related knowledge according to approved programs by the State Inspector General; to issue certificates to trainees who have completed inspection skill training courses in accordance with regulations.

4. To conduct scientific research on inspection skills, program contents, and teaching methods to support specialized training and enhancement for inspection cadres; to implement the application of scientific topics already accepted by the School, the Government Inspectorate, Inspectors of Ministries and sectors, and Inspectors of provinces and centrally-administered cities into the development of program contents, compilation of textbooks, and preparation of teaching materials.

5. To cooperate with the Organization and Cadre Affairs Department to assist the State Inspector General in organizing civil servant grade promotion exams in the Inspection sector.

6. To standardize the teaching staff and to train and enhance the teaching staff to always meet the requirements of the School's tasks; to build a part-time teaching staff based on the standards of senior lecturers and above both within and outside the sector.

7. To participate in the dissemination and education of laws on inspection, complaint resolution, and anti-corruption;

8. To manage the staff, assets, and funds of the School in accordance with the law and the delegation of the State Inspector General.

9. To perform other tasks assigned by the State Inspector General.

Chapter II.

ORGANIZATIONAL STRUCTURE, RESPONSIBILITIES, AND SCOPE OF WORK HANDLING

Article 3. Organizational structure and staffing

1. The leadership of the Inspection Cadres School consists of the Director and Deputy Directors (referred to as the School Management Board).

2. The functional units of the School include:

2.1- Training Department;

2.2- Teacher Department;

2.3- Administrative and Organization Department.

Specific duties and powers of the departments and faculties under the Inspection Cadres School shall be stipulated by the Director based on the functions and tasks assigned.

3. The staffing of the Inspection Cadres School is the public service staffing determined by the Chief Inspector based on the proposal of the Director of the Inspection Cadres School and the Director of the Personnel Department.

Article 4. Powers and responsibilities of the Director

The Director of the Inspection Cadres School has the following powers and responsibilities:

1. Directing and organizing the implementation of the School's tasks as prescribed in Article 2 of this Regulation; being responsible before the law and the Chief Inspector for the performance of assigned work.

2. Deciding and organizing the implementation of the School's monthly, quarterly, and annual work plans and programs according to the directives of the Government Inspectorate leadership;

3. Cooperating with department heads and other unit chiefs under the Government Inspectorate and relevant ministries, sectors, and localities to handle issues related to inspection training and capacity building;

4. Fully implementing information and reporting systems as prescribed by the Government Inspectorate. Reporting to the Government Inspectorate leadership on training and capacity building results, other assigned work results, and timely recommendations for issues requiring resolution to support inspection training and capacity building.

5. Assigning tasks, coordinating activities, and supervising the execution of tasks by Deputy Directors, units, and staff members within the School;

6. Building and implementing personnel planning for the School; establishing labor standards suitable for the School's requirements based on consultations with the Trade Union organization;

7. Maintaining work discipline, managing, evaluating, and implementing commendation and reward activities for School staff members;

8. Deciding on the use and management of the School's funds, assets, and funds in accordance with the law;

9. Delegating authority to the Director of the Inspection Cadres School to have the power to:

9.1- Decide on the recruitment of staff and lecturers to work at the School through competitive examinations or selection, after reporting (through the Personnel Department) and obtaining permission from the Chief Inspector; setting salaries, appointing to civil servant ranks, and signing employment contracts with recruited individuals;

9.2- Decide on the appointment, reappointment, resignation, and removal of heads and deputy heads of subordinate units after reporting (through the Personnel Department) and obtaining approval from the Chief Inspector for appointment;

9.3- Signing labor contracts and job assignment contracts to implement tasks that do not require regular staffing;

9.4- Deciding on the arrangement and utilization of staff members in accordance with their capabilities and professional qualifications;

9.5- Deciding on salary grade increases within the same rank, early promotions within the same rank, and the acceptance and transfer of teaching positions and equivalent positions downward as prescribed by law;

9.6- Deciding on the transfer, secondment, retirement, termination of employment contracts, labor contracts, commendations, and disciplinary actions for staff members under management in accordance with the law;

9.7- Resolving complaints and reports in accordance with the law for staff members under management;

9.8- Deciding to invite domestic and foreign experts to work; sending School staff members for domestic and international assignments and studies to enhance their professional qualifications;

9.9- Being responsible for directing the School to implement financial autonomy mechanisms as prescribed in Decree No. 43/2006/NĐ-CP dated April 25, 2006 of the Government;

9.10- Managing and retaining the files of School staff members and contractual staff (excluding the files of the Director and Deputy Directors); compiling and reporting statistics on the staff under management to the Government Inspectorate as prescribed.

Article 5. Duties and Authorities of the Deputy Director

1. The Deputy Director is a leading cadre of the School, assisting the Director in managing and operating the School's affairs; directly managing certain areas of work assigned by the Director and being responsible to the Director for the tasks assigned.

2. Performing duties and authorities within the scope delegated and authorized by the Director.

3. Assisting the Director in supervising, urging, and inspecting the activities of departments and faculties within the assigned management scope.

Article 6. Duties and Authorities of Heads and Deputy Heads of Departments and Faculties

1. The Head of Department and Faculty is responsible for managing and directing the work of the department or faculty, and is accountable to the Board of Directors for the performance of their duties.

2. The Deputy Head of Department and Faculty assists the Head of Department and Faculty in managing and directing the work of the department or faculty, and is accountable to the Head of Department or Faculty for the tasks assigned.

3. Specific duties and authorities of Heads and Deputy Heads of Departments and Faculties shall be defined by the Director.

Article 7. Duties and Authorities of Cadres, Staff, and Employees of the School of Inspection Cadres

1. Adhering to labor discipline, regulations of the Government Inspectorate, and those of the School of Inspection Cadres.

2. Proactively performing assigned tasks, researching, and advising on specialized fields assigned; being accountable to the Board of Directors, Heads of Faculties, and Heads of Departments for the tasks assigned.

3. Lecturers working at the School of Inspection Cadres have rights and obligations as stipulated by the Education Law and current legal documents.

Chapter III.

WORKING REGIME

Article 8. Principles of Work

1. The School of Inspection Cadres operates under the head system, ensuring democratic centralism principles, emphasizing individual responsibility and discipline, and promoting initiative and creativity among all cadres, staff, and lecturers in the School.

2. Promoting cooperation in work, exchanging experiences and information in handling tasks and in all activities according to prescribed functions, duties, and authorities.

3. Lecturers of the School have the responsibility to fulfill teaching duties as regulated by lecturer management rules and other assignments made by the Director.

Article 9. Planning System

Based on programs, work plans, and key tasks of the Government Inspectorate, the Director decides on the School's work plan and guides, organizes inspections of its implementation.

Article 10. Reporting and Information System

1. Periodic and ad hoc reporting of the School's work is carried out in accordance with the Working Regulations of the Government Inspectorate.

Plans and reports of units under the School shall be regulated by the Director.

2. The School has the responsibility to inform cadres and staff about the following information:

- Policies and guidelines of the Party, State, and Government Inspectorate related to the School's functions and tasks and the industry;

- Internal regulations and working rules of the Government Inspectorate and the School;

- Programs of work of the Government Inspectorate and the School;

- Annual financial income and expenditure activities of the School;

- Recruitment, study abroad, commendation, disciplinary actions, salary increments, rank promotions, appointments, and dismissals of cadres and staff of the School;

- Conclusions on the resolution of complaints and denunciations related to cadres and staff of the School;

- Other information as directed by the Chief Inspector.

3. The exchange and provision of information by cadres, staff, and lecturers of the School must comply with legal provisions, regulations of the inspection sector, and directives from the Government Inspectorate.

Article 11. Meeting System

1. The School shall maintain a monthly full staff meeting once a month (except for objective reasons) to evaluate the results of the month and deploy work for the following month.

In case of necessity, the Rector may convene an extraordinary full staff meeting.

2. The Rector shall maintain a weekly briefing and consultation meeting with the School's leadership, heads of departments, and faculties. When necessary, the Rector may invite the Party committee and leaders of mass organizations to attend meetings related to their content.

Article 12. Financial System of the School of Inspectors

The collection, expenditure, use, and management of funds and finances of the School of Inspectors shall be carried out in accordance with Decree No. 43/2006/NĐ-CP dated April 25, 2006 of the Government and guiding documents on financial management systems for public institutions, regulations of the General Inspectorate, and other relevant laws.

Chapter IV.

RELATIONSHIPS IN WORK OF THE SCHOOL OF INSPECTORS

Article 13. Relationships with the Leadership of the Government Inspectorate

1. The School of Inspectors shall be directly and comprehensively led and directed by the General Inspector and the Deputy General Inspector responsible for training and development work.

2. The Rector shall have the responsibility to regularly and periodically report to the leadership of the Government Inspectorate on the organization, personnel, and activities of the school; implement tasks according to responsibilities assigned by the leadership of the Government Inspectorate.

3. The Rector shall study and propose to the leadership of the Government Inspectorate about projects, directions, and tasks of the school's activities during each period for the leadership of the Government Inspectorate to decide or approve.

Article 14. Relationships with Units under the Government Inspectorate

1. The School of Inspectors shall be responsible for coordinating with the Personnel Department in personnel management, staff, and establishment; planning and allocating training and development quotas for inspectors of the Inspection sector annually.

2. The School of Inspectors shall be responsible for coordinating with the Office of the Government Inspectorate in implementing property management systems, assets, and equipment according to legal provisions.

3. The School of Inspectors shall take the lead and coordinate with the Institute of Inspection Science in researching and applying approved scientific research topics into teaching.

4. The School of Inspectors shall be responsible for coordinating with the Departments and units of the Government Inspectorate in teaching; building a part-time faculty team at the Departments and units of the Government Inspectorate.

Article 15. With Inspectors of Ministries, Sectors, and Localities

The School of Inspectors shall be responsible for coordinating with Inspectors of Ministries, Sectors, and Localities in organizing training and development courses; building a part-time faculty team.

Article 16. Relationships between School Leadership and the Party Committee and Mass Organizations

1. School leadership shall create conditions for the Party organization and mass organizations to operate according to their charters, purposes, and objectives; coordinate with the Party committee and mass organizations to provide conditions for party members, staff, and faculty of the school to enhance political and professional qualifications, work effectively; ensure the implementation of democratic regulations within the school's operations, build a cultural and disciplinary environment.

2. School leadership shall have the responsibility to provide timely and complete information about the school's activities and the rights of staff and faculty to the Party committee; seek opinions from the Party committee and mass organizations before deciding on issues regarding methods of leading ideological education, internal protection, consolidating unity, and caring for the lives of staff and faculty in the school; regarding organizational and personnel work of the school.

Chapter V.

IMPLEMENTATION

Article 17. Responsibility for Implementation

1. The School Management Board, Heads and Deputy Heads of Departments and Faculties, and all staff and faculty members of the school shall be responsible for implementing this regulation. The Rector shall be responsible for disseminating this regulation to all staff and faculty members of the school to organize its implementation.

2. Other contents related to the functions, tasks, powers, and organization of the school that are not reflected in this regulation shall be implemented in accordance with the Working Regulations of the Government Inspectorate, other regulations of the school, and current legal documents on training and development of cadres.

3. The Rector of the School of Inspectors, the Head of the Personnel Department, and the Director of the Office shall be responsible for monitoring, inspecting, and urging the implementation of this regulation; collecting feedback, studying, and promptly proposing supplements and amendments to the regulation in line with the requirements of the school and the Government Inspectorate. /
