Investment project for constructing the Ho Chi Minh Road (Phase 1)

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Notification No. 271-TB/TW dated December 23, 1999 of the Central Committee of the Communist Party of Vietnam regarding the viewpoints of the Politburo on the policy of constructing the Ho Chi Minh Road;

Pursuant to Decision No. 789/TTg dated September 24, 1997 of the Prime Minister approving the overall planning of the North-South Expressway (now the Ho Chi Minh Road);

Considering the proposal of the Ministry of Transport (documents No. 202/VPTT-DAXLBN dated January 20, 1999 and No. 271/CV-BGTVT dated January 27, 2000), and the review opinions of the State Council for Investment Projects (documents No. 64/TĐNN dated May 19, 1999 and No. 07/TĐNN dated February 1, 2000).

DECISION:

Article 1. The investment project for constructing the Ho Chi Minh Road (Phase 1) includes the following main contents:

1. Project name: Ho Chi Minh Road (Phase 1).

2. Scope of the project:

- Starting point: at Hoa Lac - Ha Tay (the end point of the Lang - Hoa Lac road).

- Ending point: at the intersection of Binh Phuoc - Ho Chi Minh City (where National Highway 13 intersects with the Da Han Expressway).

The Ho Chi Minh Road follows the planned route through the following locations:

Hoa Lac đ Xuân Mai đ Ngọc Lạc đ Tân Kỳ đ Phố Châu đ Tân Ấp đ Khe Ve đ Khe Gát.

From Khe Gát, the Ho Chi Minh Road branches into two routes:

+ Branch 1, 364 km long, heading east and approximately 10 to 15 km away from National Highway 1A according to the approved North-South Expressway plan, passing through the following locations:

Khe Gát đ Bùng đ Cam Lộ đ Phà Tuần đ Hải Vân đ Hà Nha đ Thạnh Mỹ.

+ Branch 2, 514 km long, heading west through the following locations:

Khe Gát đ U Bò Pass đ Democratic Junction đ Khe Sanh along National Highway 9 to Dak Rong đ A Luoi đ Hiên đ Thạnh Mỹ.

From Thạnh Mỹ, following the approved North-South Expressway plan, it passes through: Ngọc Hồi đ Kon Tum đ Pleiku đ Buon Ma Thuot đ Dak Nong đ Chon Thanh đ Binh Phuoc Intersection.

To maximize the effectiveness of the investment capital, meet economic and social development needs, ensure national defense security, and guarantee continuous north-south traffic flow, Phase 1 focuses on constructing the sections: Xuân Mai đ Cam Lộ and Thạnh Mỹ đ Ngọc Hồi according to the planned route. Simultaneously, construct Branch 2 (including Khe Gát đ Khe Sanh and Dak Rong đ Thạnh Mỹ).

3. Scale and technical standards:

a) Road:

Sections with favorable terrain and high transportation volume are designed according to the geometric standards of expressways (TCVN 5729-97) in accordance with the approved planning; sections with difficult terrain are designed according to the standards of ordinary roads (TCVN 4054-85). The cross-section across the entire route has a scale of 2 lanes, ensuring durability, encouraging the construction of concrete pavement.

b) Bridges:

- Bridge width: equal to the width of the road base.

- Design load: H30-HK80 + pedestrian 300kg/m2.

c) Protective structures, auxiliary works, and traffic safety facilities are constructed according to the operational requirements of the road.

When designing these works, compare with the flood peak of 1999, ensuring uninterrupted traffic throughout the year.

4. Implementation schedule:

Commencement: beginning of 2000.

Completion: 2003.

5. Total investment and sources of funds:

a) Total investment for Phase 1: approximately 5.3 trillion VND

(Five thousand three hundred billion VND - calculated at the time of project preparation and corresponding to asphalt concrete road surface).

b) SOURCES OF FUNDS:

Budget funding, including ODA loans (if any).

6. Implementation organization and mobilization of forces to participate in construction:

- Delegating authority to the Minister of Transport:

+ Approve technical designs and budgets for individual projects.

+ Assign tasks directly to domestic consulting units under the Ministry of Transport and the Ministry of Defense:

. Surveying, preparing technical design documents and budgets.

. Supervising construction (independently or in collaboration with Cuban consultants).

- Permitting the Ministry of Transport to invite Cuban consultants to participate in construction supervision tasks. The Ministry of Transport will discuss with the partner and report to the Prime Minister for consideration and decision.

- Assigning the Ministry of Transport to coordinate with the Ministry of Construction to unify consultancy fees suitable to the actual conditions of the project, to be reported to the Prime Minister in the first quarter of 2000.

- Assigning the Ministry of Transport to allocate tasks to central professional construction units (for professional construction units under the Ministry of Defense and the Ministry of Construction, based on proposals from the two ministries) and local units, and report to the Prime Minister for consideration and decision.

Professional units assigned construction tasks:

+ Are responsible for utilizing maximum idle labor force and local labor force along the route, shall not transfer contracts; comply with regulations on social order and environmental protection.

+ Can advance up to 20% of the contract value and have the obligation to save 5% of the approved construction budget.

Article 2.

- Project sponsor: Ministry of Transport.

- Project sponsor representative: Management Board for the Ho Chi Minh Road Project.

Article 3. Task allocation:

1. The Ministry of Transport is responsible for:

- Organizing the marking of planning road boundaries in priority order and handing over management to local authorities, primarily those sections passing through densely populated areas.

- Coordinating with provinces, cities, and related sectors to direct compensation and land clearance to ensure the construction schedule.

2. The Ministry of Planning and Investment, the Ministry of Finance, and the State Bank of Vietnam:

Cooperate to implement measures to mobilize and ensure adequate funding consistent with the project timeline.

3. Ministry of National Defense: organize the mobilization of subordinate forces to use existing equipment to carry out mine clearance tasks according to the project schedule, ensuring safety and economy. Proactively coordinate with the Ministry of Transport to identify defense works related to the route.

4. Ministry of Agriculture and Rural Development: plan reservoirs, dams for irrigation, national parks, industrial raw material areas; allocate within the program of planting five million hectares of forest to plant forests along the route.

5. Ministry of Construction: cooperate with localities to plan resettlement areas, cities, new industrial zones, service points... along the route.

6. Ministry of Science, Technology and Environment: stipulate environmental protection work during construction and operation thereafter.

7. Ministry of Health: coordinate with the Ministry of Transport to direct disease prevention and treatment work during construction.

8. Ministry of Culture and Information: stipulate the protection of cultural works and historical relic areas during construction.

9. Ministry of Labor, Invalids and Social Affairs: examine and stipulate issues related to the mobilization of idle labor and incentive policies for forces participating in construction according to the proposal of the Ministry of Transport.

10. General Department of Tourism: plan tourist spots and routes linked to the Ho Chi Minh Road.

11. Central Committee of the Ho Chi Minh Communist Youth Union organizes the mobilization of young forces to participate in construction according to the project program. Coordinate with the Ministry of Agriculture and Rural Development to undertake the task of planting forests along the route.

12. People's Committees of provinces and centrally governed cities through which the route passes:

- Take the lead and bear primary responsibility for organizing land clearance work according to the construction schedule, arranging land for resettlement. While waiting for the Prime Minister to issue decisions on land recovery and allocation for construction projects, localities temporarily transfer land to investors for implementation.

- Prioritize solving material supply mines for construction projects. The Government allows exemption from resource taxes for materials supplied for construction projects.

- Create favorable conditions for construction site layout.

- Strictly manage the planning boundary markers handed over by the Ministry of Transport.

- Organize the mobilization of idle labor according to plans and based on contracts with construction units.

- Organize social order and security maintenance work during construction and protect completed works within their jurisdiction.

Article 4. Ministers of Ministries, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial and centrally governed city People's Committees related to this Decision shall be responsible for its implementation.
