Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 90/2002/ND-CP dated November 11, 2002 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

Article 1. The Personnel Department is an advisory body assisting the Minister in exercising state management functions over personnel work, organization, training, human resource development, labor, and wages in the postal, telecommunications, information technology, electronics, Internet, broadcasting, radio frequency, and information infrastructure sectors (hereinafter referred to collectively as postal, telecommunications, and information technology); internal political security protection in accordance with the law.
Article 2. The Personnel Department has the following tasks and powers:
1. To take the lead in drafting and guiding the implementation of regulatory legal documents on personnel work, organization, training, human resource development, labor, and wages in the postal, telecommunications, and information technology sectors.
2. To organize research and develop plans, projects, and planning for personnel work; to uniformly manage the construction of the organizational structure of the Ministry.
3. To draft regulations on the functions, tasks, powers, organizational structure, and operations of units and guide subordinate units of the Ministry in their implementation; regulations on the delegation of management powers over organizations and personnel for subordinate units of the Ministry.
4. To study or coordinate in studying and implementing policies, measures, and related issues concerning the construction and development of personnel work and organization.
5. To participate in performing specific tasks and powers within the scope of representing state ownership in enterprises with state capital in the postal, telecommunications, and information technology sectors.
6. To draft and organize the implementation of plans to implement the administrative reform program of the Ministry according to the goals and content of administrative reform approved by the Prime Minister.
7. To take the lead in implementing reforms in the restructuring of postal, telecommunications, and information technology enterprises.
8. To study and build specific measures and guide the implementation of operational mechanisms for public service organizations in the postal, telecommunications, and information technology sectors in accordance with the law; to manage and direct the activities of affiliated public institutions.
9. To organize the drafting, implementation, inspection, and guidance in implementing regulations and procedures for personnel management, recruitment of civil servants in accordance with the law and the delegation of the Minister.
10. To carry out procedures for appointment, removal, transfer, salary grading, promotion, and examination for promotion of civil servants under the Ministry's management; to provide professional guidance, supervise civil servants.
11. To submit to the Minister for approval decisions on dispatching officials for domestic and foreign assignments.
12. To draft and guide the implementation of staffing levels, wage funds, labor standards, and vocational qualifications for postal, telecommunications, and information technology civil servant grades; to define technical and vocational qualification ranks for postal, telecommunications, and information technology positions and submit them to the Minister; to allocate quotas and manage the staffing of the Ministry; to review wage rates within the authority granted.
13. To organize statistics on civil servant grades under the Ministry. To manage the personnel files of civil servants under the Ministry in accordance with current regulations. To implement reward and disciplinary policies for civil servants, employees, and officials under the Ministry's jurisdiction.
14. To organize examinations, training, and upgrading of officials, civil servants, and employees in the postal, telecommunications, and information technology sectors; to issue training certificates in accordance with government regulations.
15. To organize the drafting and submission to the Minister for approval of strategies, planning for cadres, training and human resource development plans, and improvements in professional expertise; to guide units in their implementation.
16. To advise the Minister on managing the Ministry’s press activities.
17. To participate in managing the activities of associations and non-governmental organizations in the postal, telecommunications, and information technology sectors.
18. To perform duties assisting the Party Cadre Affairs Committee and internal political security protection work.
19. To manage the reserve, mobilization, and self-defense militia work of the Ministry.
20. To participate in researching and providing comments on draft regulatory legal documents from other ministries and sectors regarding organization, personnel, civil servants, employees, labor, wages, and social policies.
21. To manage the organization, personnel, civil servants, employees, assets, and documents of the Department in accordance with the law and the delegation of the Minister.
22. To perform other tasks assigned by the Minister.
Article 3. The Personnel Department is headed by a Director, assisted by Deputy Directors and specialized civil servants.
The Director is responsible to the Minister for the results of performing the functions, tasks, and powers set forth in Article 1 and Article 2 of this Decision.
Deputy Directors are responsible for assisting the Director in directing and managing all aspects of the Department's work and are accountable to the Director for the tasks assigned.
The tasks and powers of specialized civil servants in the Department are defined by the Director.
Article 4. This Decision takes effect from the date of signature. All previous provisions contrary to this Decision are abolished.
Article 5. The Head of the Office, the Director of the Personnel Department, and the Heads of affiliated agencies and units of the Ministry are responsible for enforcing this Decision.
