Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, authorities, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Health;

Article 1. Position and Function.
The Department of Health Defense is an organization under the Planning and Finance Department, Ministry of Health, with the function of assisting the Director of the Planning and Finance Department in advising the Minister of Health on implementing defense work within the health sector.
Article 2. Tasks and Authorities:
1. Advising the leadership of the Ministry and directing the organization of nationwide defense education propaganda and the implementation of comprehensive defense education for cadres, civil servants, employees, and workers in subordinate agencies and units of the Ministry of Health; coordinating with the Ministry of National Defense to implement training on defense knowledge for cadres, civil servants, and employees according to the provisions of the law.
2. Advising the leadership of the Ministry to develop plans for wartime mobilization; allocating targets for the construction of reserve forces and mobilizing resources from the health sector to be ready to meet the requirements of national defense in all situations. Organizing the construction, management, and mobilization of reserve forces in the health sector; developing plans for training reserve officers in medical and pharmaceutical universities; managing the reserve military medical and pharmaceutical officer corps in subordinate agencies and units of the Ministry of Health;
3. Advising the leadership of the Ministry and directing subordinate agencies and units of the Ministry of Health to closely coordinate with local military authorities to implement organizational, training, and operational activities of self-defense forces; organizing monitoring, urging, and supervising the implementation of the Law on Military Service in the health sector.
4. Cooperating with the Ministry of National Defense and localities to build a people's defense posture, a comprehensive people's defense posture, and strong agencies and units contributing to building a solid defense area in the locality.
5. Participating in drafting and providing comments on regulatory documents related to health defense, advising the leadership of the Ministry on implementing state regulations on budget guarantees for the defense cause, building armed forces; implementing military rear support policies and other policies related to defense work.
6. Cooperating with functional agencies of the Ministry of National Defense, annually and during each period, conducting inspections, mid-term reviews, and the implementation of defense tasks and the combined military-civilian medical program of the Ministry of Health.
7. Serving as the Standing Committee of the Combined Military-Civilian Medical Program Management Board, assisting the Program Management Board in implementing the activities of the Program according to the plan approved by the leadership of the Ministry.
8. Performing other tasks assigned by the leadership of the Ministry and the leadership of the Planning and Finance Department.
Article 3. On Organizational Structure and Staffing
1. The Department shall have a Head and Deputy Heads appointed and relieved from office by the Minister of Health upon the proposal of the Director of the Planning and Finance Department and the Director of the Organization and Cadre Affairs Department.
The Head shall be subject to management and direction by the Director of the Planning and Finance Department in organizing and implementing tasks, and shall be responsible before the Minister of Health and the law for all activities of the Department. The Deputy Heads shall assist the Head and shall be responsible to the Head for the assigned tasks.
2. Personnel of the Military Health Department include military officers seconded to work on defense matters at the Ministry of Health and other staff recruited in accordance with the law and regulations of the Ministry of Health.
Civil servants in the Department shall perform tasks assigned by the Head and shall be responsible to the Head for the performance of those tasks.
3. The staffing of the Military Health Department shall be within the administrative staffing of the Planning and Finance Department, decided by the Minister of Health.
Article 4. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 5. The Heads of the Office, the Directors of the Organization and Cadre Affairs Department, the Planning and Finance Department, the Inspectorate of the Ministry of Health, and the Heads of related agencies and units shall be responsible for implementing this Decision.
