CIRCULAR

Guidelines for ranking certain types of public service units under the Ministry of Labor, Invalids, and Social Affairs

Pursuant to Decision No. 181/2005/QĐ-TTg dated July 19, 2005, of the Government on classification and ranking of public service organizations and institutions;

After receiving comments from the Ministry of Home Affairs in Circular No. 3970/BNV-TCBC dated November 6, 2006, and the Ministry of Finance in Circular No. 12314/BTC-HCSN dated October 4, 2006, the Ministry of Labor, Invalids, and Social Affairs provides guidelines for ranking certain types of public service units under the Ministry of Labor, Invalids, and Social Affairs as follows.

I. GENERAL PROVISIONS

1. Scope of Regulation and Applicability

Public service units under the Ministry of Labor, Invalids, and Social Affairs that will be ranked according to this Circular include:

a. Inpatient and rotational convalescent units for war invalids, disabled veterans, and persons who have rendered meritorious services to the revolution (including units providing social welfare care);

b. Social welfare units (including units providing care for war invalids and disabled veterans);

c. Orthopedic and rehabilitation units;

d. Technical safety inspection units.

2. Purpose of Ranking

a. To improve functions, tasks, material infrastructure, staff; enhance the effectiveness and efficiency of operations of the unit;

b. To uniformly implement the system of position allowances for leaders and managers based on the unit's rank; to enhance roles and responsibilities, ensuring rights and obligations of each leadership position within the unit;

c. To implement分级管理权限。

3. Number of Ranks: The public service units specified in Clause 1, Section I shall be ranked into four categories: Category I, Category II, Category III, and Category IV.

4. Principles of Ranking:

a. The ranking of public service units is determined based on the principle of evaluating and scoring according to the following four criteria groups:

- Criteria Group I: Position, function, and mission;

- Criteria Group II: Effectiveness and quality of work;

- Criteria Group III: Infrastructure and equipment;

- Criteria Group IV: Professional qualifications and structure of the staff.

b. The category of a unit is determined based on the total score achieved across the four criteria groups.

c. All units, whether already ranked or not, must undergo ranking or re-ranking according to the provisions of this Circular.

d. After five years (sixty months) from the date of the official ranking decision, units may be reviewed and re-ranked.

In cases where a unit is invested in or permitted to invest in physical facilities by a competent state agency, resulting in additional tasks that change its ranking points, the unit may be reviewed and re-ranked two years (twenty-four months) after the ranking decision.

II. CRITERIA TABLE AND POINTS

The criteria table and points are stipulated in Appendix 2 attached to this Circular.

4. Method of calculating points

a) Calculating points according to specific criteria in the ranking criteria and point tables issued with this Circular, without applying intermediate points, and not calculating points when data is incomplete;

b) Considering the application file for ranking based on relevant documents and statistical data proving the criteria and actual inspections at the unit (using data from the two preceding years before the year of application and implementation plans for the application year, in case of natural disasters or epidemics, the provision of data is decided by the competent authority for ranking; evidence for scientific research topics uses data during the period the unit maintains its ranking).

V. AUTHORITY, DOCUMENTATION, AND PROCEDURES FOR RANKING

1. Authority for Ranking:

a. The Ministry of Labor, Invalids, and Social Affairs:

- Directing, guiding, and inspecting the application of ranking criteria for public service units stipulated in this Circular nationwide;

- Deciding on the ranking of public service units directly under the Ministry of Labor, Invalids, and Social Affairs.

b. Ministries and sectors decide on the ranking of public service units under their direct management and report back to the Ministry of Labor, Invalids, and Social Affairs.

c. Provincial People's Committees and Municipal People's Committees directly under the Central Government decide on the ranking of public service units under their direct management and report back to the Ministry of Labor, Invalids, and Social Affairs.

2. Documentation and Procedures for Requesting Ranking:

a. A letter requesting ranking from the unit.

b. An analysis, evaluation, and scoring table of criteria according to the model issued with this Circular (Appendix 1) and supporting documents and materials proving the points achieved (data from the two preceding years and the implementation plan for the year requested, which has been approved by the competent authority).

VI. EFFECTIVE DATE OF IMPLEMENTATION

1. This Circular takes effect fifteen days after its publication in the Official Gazette, replacing Circular No. 13/LĐTBXH-TT dated April 11, 1994, of the Minister of Labor, Invalids, and Social Affairs on Guidelines for Ranking and Position Allowances for Leadership Positions in Public Service Units under the Ministry of Labor, Invalids, and Social Affairs.

2. The level of position allowance for leadership positions stipulated in this Circular shall be calculated from the specific date when the unit receives the ranking decision corresponding to the national minimum wage.

During implementation, if there are any difficulties, please report them to the Ministry of Labor, Invalids, and Social Affairs for study and resolution./.
