DECISION

Announcing the maritime areas of ports within the jurisdiction of Khanh Hoa Province and Ninh Thuan Province and the management area of the Ha Tien Port Authority

and the management area of the Nha Trang Maritime Port Office

BASED ON THE VIETNAM MARITIME CODE dated June 14, 2005;

Pursuant to the Government Decree No. 34/2003/NĐ-CP dated April 4, 2003 on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 71/2006/NĐ-CP dated July 25, 2006 of the Government on port management and shipping channels;

Based on the opinions of the People's Committee of Khanh Hoa Province in Document No. 6681/UBND dated November 3, 2006;

Based on the opinions of the People's Committee of Ninh Thuan Province in Document No. 3506/UBND-KT dated October 27, 2006;

At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration.

DECISION:

Article 1.

1. Now announcing the maritime areas of ports within the jurisdiction of Khanh Hoa Province and Ninh Thuan Province, including:

a) The maritime areas before port bridges and wharfs of the following ports:

- Ports within the jurisdiction of Khanh Hoa Province: Van Phong Bay Port (Dam Mon Wharf, Hon Khoi Wharf, Hyundai-Vinashin Shipyard Wharf, Van Phong Oil Transfer Area); Nha Trang Port (Nha Trang Wharf, Nha Trang Oil Wharf), and Ba Ngoi Port.

- Ports within the jurisdiction of Ninh Thuan Province: Ca Na Port.

b) The maritime area of the port channel, branch channels, pilot reception areas, quarantine zones, anchorage areas, transshipment areas, and storm shelters of the ports specified in point a of this clause.

2. The maritime areas before port bridges and wharfs, anchorage areas, typhoon shelters, and other transfer zones are announced in accordance with the provisions of the law.

12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentThe scope of the maritime areas of ports within the jurisdiction of Khanh Hoa Province and Ninh Thuan Province is calculated based on the highest tidal level, specifically defined as follows:

1. The scope of the maritime areas of ports within the jurisdiction of Khanh Hoa Province:

a) Nha Trang Port: bounded by straight lines connecting points NT1, NT2, NT3, and NT4, with the following coordinates:

NT1: 12°14'11.3"N, 109°15'39.0"E (Ba Co Cape - Northern tip of Hon Tre Island);°14'09"N, 109°15'44"E (Ba Co Cape - North Hon Tre);

NT2: 12°16'00"N, 109°13'23"E;

NT3: 12°16'00"N, 109°12'48"E;

NT4: 12°12'48"N, 109°12'30"E (Truong Tay, Vinh Nguyen Ward).

From point NT4 running along the coastline southward to point NT5 with the following coordinates: 12°09'12"N, 109°13'05"E;

From point NT5 by straight lines connecting points NT6 and NT7, with the following coordinates:

NT6: 12°09'12"N, 109°16'32"E;

NT7: 12°10'58"N, 109°16'32"E.

From point NT7 running along the western coast of Hon Tre Island northward, through Nam Cape, to Lang Cape and connecting with point NT1.

b) Ba Ngoi Port:

- Seaward boundary: bounded by straight lines connecting points BN1, BN2, BN3, and BN4, with the following coordinates:

BN1: 11°55'00"N, 109°10'00"E;

BN2: 11°52'30"N, 109°11'42"E;

BN3: 11°48'00"N, 109°13'30"E;

BN4: 11°46'54"N, 109°11'42"E.

- Landward boundary: from point BN4 running along the coastline northward through Bai Tien Cape and Sup Cape, along the coastline of Cam Ranh Bay southward through Ong Ding Cape, and northward of the bay to connect with point BN1.

c) Van Phong Bay Port Area:

- Seaward boundary: bounded by straight lines connecting points VP1, VP2, and VP3, with the following coordinates:

VP1: 12°33'44.3"N, 109°25'37.0"E (Ganh Cape - Southern tip of Hon Gom Peninsula);°33'42"N, 109°25'42"E (Ganh Cape - southern tip of Hon Gom Peninsula);

VP2: 12°28'00"N, 109°25'42"E

VP3: 12°24'00"N, 109°20'18"E (Bàn Thang Cape).

- Landward boundary: from point VP1 (Ganh Cape) running along the western coastline of Hon Gom Peninsula northward through Co Co Cape, Da Son Cape, and along the coastline to the northernmost point of Ben Goi Cove, then along the coastline of communes in Van Ninh District through Hon Giang Cape, Hon Khoi Cape to point VP3 (Bàn Thang Cape).

2. The scope of the maritime area of Ca Na Port within the jurisdiction of Ninh Thuan Province:

a) Seaward boundary: bounded by straight lines connecting points CN1, CN2, CN3, and CN4, with the following coordinates:

CN1: 11°18'24"N, 108°54'52"E (Sung Trau Cape);

CN2: 11°17'20"N, 108°54'45"E;

CN3: 11°16'45"N, 108°51'58"E (Cau Cu Lao Shoal);

CN4: 11°19'54"N, 108o50'45"E (Da Chut Mountain).

b) Landward boundary: from point CN4 running along the coastline northward to point CN1.

Article 3. The pilot reception and delivery zone, quarantine zone, anchorage zone, transfer zone, and typhoon shelter for vessels entering and leaving ports within the jurisdiction of Khanh Hoa Province and Ninh Thuan Province are defined as follows:

1. Pilot Station and Quarantine Area:

a) Nha Trang Port:

- For vessels entering and leaving the port from the north: the maritime area is limited by a circle with a radius of 01 nautical mile, centered at the position with the following coordinates:

12°14'30"N; 109°13'42"E.

- For vessels entering and leaving the port from the south: the maritime area is limited by a circle with a radius of 01 nautical mile, centered at the position with the following coordinates:

12°10'12"N; 109°15'30"E.

b) Ba Ngoi Port: the maritime area is limited by a circle with a radius of 0.7 nautical miles, centered at the position with the following coordinates:

11°48'30"N; 109°12'30"E.

c) Van Phong Bay Port Area: the maritime area is limited by a circle with a radius of 01 nautical mile, centered at the position with the following coordinates:

12°30'42"N; 109°23'18"E.

d) Ca Na Port: the maritime area is limited by a circle with a radius of 0.5 nautical mile, centered at the position with the following coordinates:

11°17'42"N; 108°53'56"E.

2. Anchorage zones for vessels, except those specified in Clause 4 of this Article:

a) Nha Trang Port:

- Zone A: for vessels with a deadweight tonnage of 1,000 DWT or more, bounded by straight lines connecting points A1, A2, A3, and A4, with the following coordinates:

A1: 12°12'40"N, 109°13'10"E;

A2: 12°13'00"N, 109°13'50"E;

A3: 12°13'30"N, 109°13'10"E;

A4: 12°13'20"N, 109°13'50"E.

- Zone B: for vessels with a deadweight tonnage of 1,000 DWT or more, bounded by straight lines connecting points B1, B2, B3, and B4, with the following coordinates:

B1: 12°12'44"N, 109°14'15"E;

B2: 12°12'12"N, 109°13'42"E;

B3: 12°12'18"N, 109°14'48"E;

B4: 12°12'00"N, 109°14'30"E.

- Zone C: for vessels with a deadweight tonnage under 1,000 DWT, bounded by straight lines connecting points C1, C2, and C3, with the following coordinates:

C1: 12°11'58"N, 109°12'52"E;

C2: 12°11'54"N, 109°13'06"E;

C3: 12°11'42"N, 109°12'52"E.

b) Ba Ngoi Port:

- Zone D: bounded by a circle with a radius of 0.7 nautical miles, centered at position N1 with the following coordinates: 11°52'00"N, 109°09'30"E.

- Zone E: bounded by a circle with a radius of 0.3 nautical miles, centered at position N2 with the following coordinates: 11°53'30"N, 109°08'10"E.

c) Van Phong Bay Port Area:

- Zone G: for vessels entering and leaving Hon Khoi Wharf, bounded by a circle with a radius of 0.7 nautical miles, centered at position N3 with the following coordinates: 12°36'12"N, 109°13'00"E.

- Zone H: for vessels entering and leaving Dam Mon Wharf, bounded by straight lines connecting points with the following coordinates:

DM1: 12°39'48"N, 109°22'12"E;

DM2: 12°39'48"N, 109°22'48"E;

DM3: 12°39'12"N, 109°22'48"E;

DM4: 12°39'12"N, 109°22'12"E.

- Zone I: for vessels entering and leaving the bridge of the Hyundai-Vinashin Shipyard, bounded by a circle with a radius of 0.6 nautical miles, centered at position N4 with the following coordinates: 12°30'06"N, 109°16'36"E.

d) Ca Na Port:

Zone K: bounded by straight lines connecting points with the following coordinates:

CN5: 11°18'48"N, 108°54'18"E;

CN6: 11°17'48"N, 108°52'26"E;

CN7: 11°19'28"N, 108°51'48"E.

3. Cargo Transfer Areas:

a) Van Phong Bay Port Area:

- Oil transfer area: located at positions VP4 and VP5, with the following coordinates:

VP4: 12°34'00"N, 109°19'12"E;

VP5: 12°32'30"N, 109°21'48"E.

- Area for loading and unloading other goods:

+ For vessels with a deadweight tonnage from 1,000 DWT to 4,000 DWT: at position N5, with coordinates: 12°36'36"N, 109°13'45"E.

+ For vessels with a deadweight tonnage from 4,000 DWT to 10,000 DWT: at position N6, with coordinates: 12°36'47"N, 109°14'54"E.

b) Ca Na Seaport: within the water area defined in point d, Clause 2 of this Article.

4. Anchorage area for vessels carrying dangerous goods, oil-carrying vessels, and vessels with diseases:

a) Nha Trang Port:

- Anchorage area for vessels carrying dangerous goods: limited by straight lines connecting points E1, E2, D2, and D1, with the following coordinates:

E1: 12°11'48"N, 109°15'42"E;

E2: 12°11'18"N, 109°15'12"E;

D2: 12°11'38"N, 109°14'52"E;

D1: 12°12'00"N, 109°15'14"E.

- Anchorage area for oil-carrying vessels: limited by straight lines connecting points D1, D2, B3, and B4, with the following coordinates:

D1: 12°12'00"N, 109°15'14"E;

D2: 12°11'38"N, 109°14'52"E;

B3: 12°12'18"N, 109°14'48"E;

B4: 12°12'00"N, 109°14'30"E.

- Anchorage area for vessels with diseases: limited by straight lines connecting points E1, E2, F2, and F1, with the following coordinates:

E1: 12°11'48"N, 109°15'42"E;

E2: 12°11'18"N, 109°15'12"E;

F2: 12°11'00"N, 109°15'54"E;

F1: 12°11'48"N, 109°15'54"E.

b) Ba Ngoi Port:

Anchorage area for vessels carrying dangerous goods and oil-carrying vessels: limited by straight lines connecting points H1, H2, I2, and I1, with the following coordinates:

H1: 11°52'06"N, 109°10'30"E;

H2: 11°52'24"N, 109°10'12"E;

I2: 11°51'36"N, 109°09'06"E;

I1: 11°51'12"N, 109°09'24"E.

- Anchorage area for vessels with diseases: limited by straight lines connecting points G1, G2, H2, and H1, with the following coordinates:

G1: 11°52'30"N, 109°11'00"N, 109

G2: 11°52'48"N, 109°10'42"E;

H2: 11°52'24"N, 109°10'12"E;

H1: 11°52'06"N, 109°10'30"E.

c) Van Phong Bay Port Area:

- Anchorage area for vessels carrying dangerous goods and oil-carrying vessels: limited by straight lines connecting points L1, L2, K2, and K1, with the following coordinates:

L1: 12°36'12"N, 109°18'42"E;

L2: 12°35'12"N, 109°18'00"E;

K2: 12°34'18"N, 109°19'12"E;

K1: 12°35'24"N, 109°20'00"E.

- Anchorage area for vessels with diseases: limited by straight lines connecting points J1, J2, K2, and K1, with the following coordinates:

J1: 12°33'36"N, 109°22'54"E;

J2: 12°32'18"N, 109°22'00"E;

K2: 12°34'18"N, 109°19'12"E;

K1: 12°35'24"N, 109°20'00"E.

- Anchorage area for oil-carrying vessels to repair at Hyundai-Vinashin Shipyard: at positions S1 and S2, with the following coordinates:

S1: 12°31'30"N, 109°15'30"E;

S2: 12°32'30"N, 109°16'30"E.

5. Shelter area: within the water area defined in Clause 2 and Clause 4 of this Article.

Article 4. The Nha Trang Maritime Port Authority shall be responsible for:

1. Performing its duties and powers as prescribed by the Vietnam Maritime Code and relevant laws concerning maritime activities in the waters of seaports within the jurisdiction of Khanh Hoa Province and Ninh Thuan Province.

2. Based on actual conditions regarding weather, waves, drafts, and the deadweight tonnage of vessels, designating specific locations for vessels to pick up and drop off pilots, quarantine, anchor, load/unload cargo, and seek shelter in the waters defined in Article 3 of this Decision, ensuring maritime safety, maritime security, and prevention of environmental pollution.

Article 5. Outside the waters defined in Article 2 and Article 3 of this Decision, the Nha Trang Maritime Port Authority shall also be responsible for state management of maritime safety and maritime security in the territorial waters under the jurisdiction of Khanh Hoa Province and Ninh Thuan Province.

Article 6. This Decision shall take effect 15 days after publication in the Official Gazette and revoke Decision No. 3395/2003/QĐ-BGTVT dated November 13, 2003 of the Minister of Transport on the waters of seaports within the jurisdiction of Khanh Hoa Province and the responsibility area of the Nha Trang Port Authority, Decision No. 115/1999/QĐ-BGTVT dated January 13, 1999 of the Minister of Transport on the waters of Ca Na Seaport in Ninh Thuan Province, and previous regulations that conflict with this Decision.

Article 7. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments under the Ministry, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterways Administration, the Directors of the Transportation Departments of Khanh Hoa Province and Ninh Thuan Province, the Director of the Nha Trang Maritime Port Authority, Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Decision./.
