THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

 

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 131/2006/NĐ-CP dated November 9, 2006 of the Government promulgating the Regulation on management and use of official development assistance funds.

Considering the proposal of the Director of the Forest Project Management Board and the Director of the Personnel Department,

Article 1. The Forest Project Management Board is a public service unit under the Ministry of Agriculture and Rural Development, authorized by the Minister to act as the Program Manager for programs and projects in the forestry and rural development sectors funded by official development assistance (ODA) that have been signed between the Government of Vietnam and international donors.

The Forest Project Management Board has legal personality, its own seal, and is entitled to open bank accounts at State Treasury banks in accordance with regulations. International transaction name: Management Board for Forestry Projects, abbreviated as MBFP. The headquarters of the Forest Project Management Board is located in Hanoi City.

Article 2. Tasks of the Forest Project Management Board

1. Depending on the scale, nature, and complexity of each program or project, the Minister of Agriculture and Rural Development acts as the Managing Authority for ODA programs or projects or the Minister of Agriculture and Rural Development is authorized

2. To serve as the point of contact with international donors to resolve procedures for implementing programs and projects assigned by the Ministry according to specific international agreements on ODA that have been signed, in compliance with current regulations.

3. To implement specific programs and projects in the field of official development assistance for forestry and rural development assigned by the Ministry in accordance with current regulations and rules of the Ministry.

4. To organize the development of management regulations suitable for each program or project to submit to the Ministry for approval and implementation.

5. To direct, implement, monitor, and urge the execution of activities within programs and projects to achieve high efficiency.

6. To supervise and inspect programs and projects to ensure they are carried out on schedule and meet quality standards.

7. To organize the selection of international and domestic consulting experts in accordance with regulations.

8. To guide and inspect the management and implementation of projects in accordance with current state regulations and signed agreements.

9. To report regularly to the Minister of Agriculture and Rural Development and relevant Departments and Bureaus on the situation and results of project activities.

10. To participate with Departments and Bureaus under the Ministry, localities, and related units in developing new investment and development programs and projects in forestry and rural development.

11. To participate in training, capacity building for staff implementing programs and projects according to specific ODA agreements signed and current regulations.

12. To provide advisory services for programs and projects on investment and development in forestry and rural development.

13. To perform other tasks assigned by the Minister.

Article 3. Organizational Structure

1. The leadership of the Forestry Project Management Board consists of the Director and Deputy Directors appointed and relieved from duty by the Minister of Agriculture and Rural Development according to regulations. The Director leads, directs, manages, and oversees the activities of the Board, being responsible before the Minister of Agriculture and Rural Development and the law regarding the activities of the Board as assigned. The Deputy Directors assist the Director, being responsible before the Director and the law for performing tasks delegated by the Director.

2. Management structure

a) Organization and Administrative Department

b) Planning and Technical Department

c) Finance and Accounting Department

d) Advisory and Program and Project Development Department. The Departments listed in Clause 2 of this Article may establish working groups decided by the Director of the Forestry Project Management Board. 3. Project Management Board Each Project has a Director, Deputy Director, Coordinator, Accountant, and project staff. The Project Director and Deputy Director are assigned tasks by the Minister of Agriculture and Rural Development.

Article 4. The Director of the Forestry Project Management Board submits the Operational Regulations of the Board for approval by the Ministry.

Article 5. The staffing of the Board is approved by the Minister of Agriculture and Rural Development. The Board can enter into labor contracts or accept staff dispatched by the Ministry according to the requirements of the project.

The salaries and operational expenses of the Board are funded from state budget sources, matching funds, and support funds from Programs and Projects according to signed agreements.

Article 6. This Decision takes effect fifteen days after its publication in the Official Gazette. Articles 2, 3, 4, 5, 6, 7, and 8 of Decision No. 101/1999/QĐ-BNN-TCCB dated July 3, 1999, of the Minister of Agriculture and Rural Development on restructuring the Forestry Aid Project Management Board and renaming it the Forestry Project Management Board are hereby repealed.

Article 7. The Head of the Office, Heads of the Cadre and Civil Servants Department, Heads of relevant agencies and units under the Ministry, and the Director of the Forestry Project Management Board are responsible for implementing this Decision./.
