THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

CONSIDERING THE PROPOSAL OF THE DIRECTOR GENERAL OF VIETNAM TELEVISION AND THE MINISTER OF HOME AFFAIRS,

DECREE:

Article 1. Position and Functions

Article 1. Vietnam Television is the national television station, an agency under the Government, performing the function of providing information and propaganda on the Party's guidelines and State policies, supplying public services; contributing to education, raising people's knowledge, and serving their spiritual life through television programs.

Article 2. Vietnam Television is abbreviated in Vietnamese as VTV; its international trading name in English is Vietnam Television, abbreviated as VTV.

Article 3. Vietnam Television is subject to state management by the Ministry of Information and Communications regarding press activities and broadcasting frequencies.

Article 2. Tasks and Authorities

Vietnam Television shall perform the following tasks and powers:

Clause 1. Proposing to the Government for regulations, amendments, and supplements to the functions, tasks, and organizational structure of Vietnam Television; proposing to the Prime Minister for decisions on establishment, merger, dissolution, and renaming of organizations under the authority of the Prime Minister.

Clause 2. Proposing to the Government and the Prime Minister strategies, plans, long-term, five-year, annual plans, and other important projects of Vietnam Television within the authority of the Government and the Prime Minister; organizing the implementation of these strategies, plans after approval.

Clause 3. Drafting plans, building, submitting to the Ministry of Science and Technology for examination and promulgating national standards according to Clause 1, Article 17 of the Law on Standards and Technical Regulations; drafting and promulgating basic standards according to Article 20 of the Law on Standards and Technical Regulations; drafting plans, building, and submitting to the Minister of Science and Technology for examination and issuance of national technical standards according to Clause 4, Article 9 of Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations.

Clause 4. Participating in building development strategies and plans for the Vietnamese television system.

Clause 5. Taking the lead and coordinating with local radio and television stations on production plans for programs broadcast on national television.

Clause 6. Deciding and being responsible for the content, programs and daily broadcasting time of Vietnam Television.

Clause 7. Directly managing the specialized technical systems of Vietnam Television for program production, signal transmission, and broadcasting of national television programs domestically and internationally.

Clause 8. Managing investment and construction projects within the authority prescribed by law, participating in examining important projects assigned by the Prime Minister within the professional and business scope.

Clause 9. Taking the lead and coordinating with relevant agencies to build a financial mechanism for Vietnam Television in accordance with its functions, tasks, powers, state budget laws, and other related laws, proposing the Minister of Finance to issue it.

Clause 10. Implementing a financial mechanism, labor, and salary system like state-owned enterprises.

Clause 11. Operating independently and bearing responsibility for implementing tasks, organizational structures, staffing, and finance according to the law.

Clause 12. Deciding to use state capital managed by Vietnam Television for investment and establishment of enterprises after obtaining permission from the Prime Minister.

Clause 13. Vietnam Television is the owner of enterprises established by the decision of Vietnam Television and the owner of the share capital at enterprises under Vietnam Television according to the law.

Clause 14. Deciding and directing the implementation of administrative reform programs of Vietnam Television according to the goals and contents of the administrative reform program of the State already approved by the Prime Minister.

Clause 15. Guiding local radio and television stations on Vietnamese abbreviations, English names, and English abbreviations of local radio and television stations and on television techniques and operations.

Clause 16. Training and enhancing professional skills in accordance with the law.

Clause 17. Organizing scientific research and applying advanced science and technology in television.

Clause 18. Implementing international cooperation with regional and world television stations according to the law.

Clause 19. Managing organizational structures, staffing, directing the implementation of salary systems and incentive, reward, and disciplinary policies for cadres, civil servants, and employees under the management of Vietnam Television according to current laws.

Clause 20. Resolving complaints and denunciations within the authority; preventing corruption, waste, bureaucracy, arrogance, and favoritism among subordinate units.

Clause 21. Implementing reporting systems to the Government, the Prime Minister, and competent agencies of the Party and State, and performing other tasks and powers as prescribed by law.

Section 16. Television Film Production Center.

Section 17. Archive Center.

Section 18. Vietnam Television Center in Ho Chi Minh City.

Section 19. Vietnam Television Center in Hue City.

Section 20. Vietnam Television Center in Da Nang City.

Section 21. Vietnam Television Center in Phu Yen Province.

Section 22. Vietnam Television Center in Can Tho City.

23. Program Production Technical Center.

24. Transmission and Broadcasting Technical Center.

Section 25. Permanent representative offices of Vietnam Television abroad decided to establish by the Director General of Vietnam Television after obtaining permission from the Prime Minister.

Section 26. Research and Application Center for Television Science and Technology.

Section 27. Training and Professional Development Center for Television.

Section 28. Advertising and Television Service Center.

Section 29. Computer and Measurement Center.

Section 30. Television Magazine.

Organizations specified in Clauses 1 to 6 of this Article are assisting organizations for the Director General. Organizations specified in Clauses 7 to 25 are production and broadcasting organizations. Organizations specified in Clauses 26 to 30 are other public service organizations.

The General Director of Vietnam Television is permitted to dissolve, establish, and reorganize the remaining units under their authority in accordance with the provisions of the law.

Each Department and equivalent units under Vietnam Television shall have a Head (and equivalent); the Head may have up to three Deputy Heads to assist them.

The organizational structure of each Department and equivalent units includes rooms and working groups.

Article 4. Leader

1. Vietnam Television has a General Director and not more than four Deputy General Directors.

2. The General Director and Deputy General Directors are appointed and relieved from their positions by the Prime Minister in accordance with the provisions of the law.

3. The General Director is responsible before the Government, the Prime Minister, and the law for all activities of Vietnam Television; Deputy General Directors assist the General Director and are responsible before the General Director and the law for the areas assigned to them.

4. The General Director defines the functions, tasks, authorities, and organizational structures of subordinate units.

5. The General Director appoints, removes from office, and dismisses the heads and deputy heads of subordinate units.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decree takes effect fifteen days after its publication in the Official Gazette and replaces Decree No. 96/2003/NĐ-CP dated August 20, 2003 of the Government on the functions, tasks, authorities, and organizational structure of Vietnam Television.

Article 2. Abolish previous provisions that conflict with this Decree.

3. The General Director of Vietnam Television, Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and Chairpersons of provincial People's Committees directly under the Central Government are responsible for implementing this Decree./.
