MINISTER OF CULTURE, SPORTS AND TOURISM
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
Pursuant to Decision No. 188/QĐ-BVHTTDL dated January 16, 2008 of the Minister of Culture, Sports and Tourism establishing the Cadre and Civil Servant Organization Department;
Considering the proposal of the Director of the Department of Personnel Organization,
DECISION:
Article 1. Position and Functions
The Cadre and Civil Servant Organization Department is an advisory body assisting the Minister of Culture, Sports and Tourism in managing state administration regarding organizational structures, staffing, cadres, and policy systems in the fields of culture, family, sports, and tourism as prescribed by law.
Article 2. Tasks and Powers
1. Submit to the Minister draft projects, programs, and draft normative legal documents concerning organizational structures, civil servants, public officials, employees, and policies within the specialized fields managed by the Ministry of Culture, Sports and Tourism;
2. Submit to the Minister plans for the organization of the Ministry and its sector; cadre planning for administrative agencies, public institutions, state-owned enterprises under the Ministry, and implement them after approval;
3. Implement and direct, guide, and inspect the implementation of the Cadre and Civil Servant Law; policies and regulations of the Party and State on organizational and cadre work within the scope of management of the Ministry of Culture, Sports and Tourism as prescribed by law;
4. Regarding organizational structures and staffing
a) Submit to the Minister proposals for the establishment, restructuring, merger, dissolution of administrative agencies, public institutions, and state-owned enterprises under the Ministry; planning the network of public institutions and public services; conditions and criteria for establishment, ranking, and self-management mechanisms for public institutions in the cultural, family, sports, and tourism sectors as prescribed by law;
b) Submit to the Minister decisions on the establishment of departments, subordinate organizations of the Department, Inspection, Office, and Bureaus;
c) Submit to the Minister regulations on the functions, tasks, powers, and organizational structures of administrative agencies and public institutions directly under the Ministry; regulations on the autonomy and responsibility of public institutions under the Ministry; charters of operation and activities of state-owned enterprises managed by the Ministry according to the provisions of law;
d) Submit to the Minister matters concerning decentralization of state management to local authorities; allocation and decentralization of tasks and responsibilities among agencies, organizations, and units under the Ministry regarding organizational and cadre work;
đ) Submit to the Minister annual staffing plans of the Ministry and approve staffing plans, allocate staff quotas, and salary funds annually for units under the Ministry according to the provisions of law;
e) Direct, guide, and inspect the implementation of normative legal documents concerning functions, tasks, powers, organizational structures, and staffing within the authority and decentralization of the Minister;
g) Review and submit to the Minister decisions recognizing formation committees for associations and non-governmental organizations within the scope of national management of the sector;
h) Submit to the Minister rankings of public institutions and state-owned enterprises under the Ministry; agree on rankings of cultural, sports, and tourism public institutions according to the provisions of law;
5. Regarding cadres, civil servants, public officials, and employees
a) Submit to the Minister plans for training, retraining, and further training of cadres, civil servants, and public officials;
b) Develop and submit to the Minister professional standards for civil service ranks and public official positions in the cultural, sports, and tourism sectors;
c) Submit to the Minister professional standards for the positions of Director and Deputy Director of Provincial Departments of Culture, Sports and Tourism;
d) Submit to the Minister contents, forms, and procedures for recruitment examinations, rank promotion examinations, selection, and rank promotion for public officials in cultural, sports, tourism, and family-related specialties nationwide; organize implementation, guide, and inspect the implementation according to the provisions of law and the decentralization of the Minister;
Organize recruitment examinations, selections, rank promotion examinations, and rank promotions for other professional ranks in administrative agencies and public institutions under the Ministry according to the provisions of law and the decentralization of the Minister.
đ) Implement appointment, reappointment, dismissal, and removal procedures for heads and deputy heads of organizations under the Ministry, including general bureaus and equivalent bodies, bureaus, departments, inspection offices, representative offices of the Ministry at localities, public institutions under the Ministry, and Heads and Deputy Heads of Departments, Office of the Ministry, Inspection Office of the Ministry, and Representative Office of the Ministry in Ho Chi Minh City, Chairmen and Members of Management Councils, General Directors of State-Owned Corporations, Directors and Deputy Directors of State-Owned Enterprises directly under the Ministry;
e) Inspect and supervise the procedures for appointment, dismissal, disciplinary actions, and evaluation of cadres, civil servants, and public officials according to the provisions of law and the decentralization of management by the Minister;
g) Decide on appointments of cadres according to the decentralization of the Minister;
h) Implement procedures and formalities for disciplinary actions against cadres under the Ministry's management;
i) Implement procedures and decisions on recruitment, absorption of cadres, civil servants, and public officials according to the provisions of law and the decentralization of the Minister;
j) Process procedures for cadres, civil servants, public officials, and employees to work, study, cooperate in labor, and personal matters abroad according to the provisions of law;
k) Manage and update files of cadres, civil servants, and public officials; manage internal affairs files and guide inspections of file management by administrative agencies and public institutions directly under the Ministry according to the provisions. Statistics on cadres, civil servants, and public officials under the Ministry's management.
6. Regarding policies and systems:
a) Implement, guide, and inspect the implementation of policies and systems for cadres, civil servants, public officials, and employees of administrative agencies, public institutions, and state-owned enterprises directly under the Ministry and the cultural, sports, and tourism sectors;
b) Submit to the Minister for approval unit prices of salaries for enterprises under the Ministry according to the provisions.
7. Regarding internal political protection work:
a) Propose policies and measures to implement political internal security work for the Ministry of Culture, Sports and Tourism;
b) Review and verify files of cadres under the management of the Ministry;
c) Disseminate and guide the content and measures regarding political internal security work for cadres, civil servants, and public officials;
d) Inspect the implementation of regulations of the Party, State, and the Ministry of Culture, Sports and Tourism concerning political internal security work.
8. Guide and inspect professional matters, planning, organizational staff work plans of administrative agencies, public institutions, and state-owned enterprises directly under the Ministry; implement anti-corruption measures in organizational staff work;
9. Serve as the permanent body of the State-Owned Enterprise Reform and Development Board under the Ministry of Culture, Sports and Tourism;
10. Manage the engraving and use of seals for administrative agencies, public institutions, and state-owned enterprises directly under the Ministry;
11. Implement administrative reform; manage staffing, implement policies and benefits for civil servants in the Department; manage assigned assets according to the law;
12. Perform other tasks assigned by the Minister.
Article 3. Organizational Structure
1. The Director and Deputy Directors of the Department;
2. Professional and technical divisions:
a) Division of Organizational Structure,
b) Cadre Work Division,
c) Policy Division,
d) Political Internal Security Protection Team
The Director of the Department of Organization and Cadres is responsible for arranging civil servants according to the job title structure and professional standards; establish and promulgate the organizational rules and operational procedures of the Department.
Article 4. Effectiveness
This Decision takes effect fifteen days from the date of publication in the Official Gazette and replaces Decision No. 54/2004/QĐ-BVHTT dated July 8, 2004, of the Minister of Culture and Information on the functions, tasks, authorities, and organization of the Department of Organization and Cadres, and Decision No. 378/2004/QĐ-UBTDTT dated March 17, 2004, of the Minister and Chairman of the Sports Management Committee on the functions, tasks, authorities, and organizational structure of the Department of Organization and Cadres.
Article 5. Responsibility for Implementation
The Head of the Office, the Director of the Department of Organization and Cadres, the Heads of organizations and units under the Ministry, and the Heads of related agencies and units are responsible for implementing this Decision./.
