Article 1. The functions, tasks, powers, and organizational structure of the General Department of Population and Family Planning under the Ministry of Health are hereby regulated.

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government on the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 188/2007/NĐ-CP dated December 27, 2007 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Health;

Considering the proposal of the Minister of Health and the Minister of Home Affairs.

DECISION:

Article 1. Position and Functions

1. The General Department of Population and Family Planning is an organization under the Ministry of Health, performing the function of advising the Minister of Health to manage state affairs related to population and family planning, including areas such as population size, population structure, and population quality; directing specialized activities on population and family planning throughout the country in accordance with the law.

2. The General Department of Population and Family Planning has legal personality, bears the seal of the national emblem, is a budgetary unit at level II, and maintains a separate account at the State Treasury.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The General Department of Population and Family Planning performs the following tasks and powers:

1. Drafting laws, ordinances; proposals for resolutions, decrees of the Government, decisions, directives of the Prime Minister regarding population and family planning according to the division of labor assigned by the Minister of Health for submission to the Minister of Health for approval by competent authorities.

2. Developing strategies, plans, long-term, five-year, and annual plans, national target programs, action programs, and important projects on population and family planning for submission to the Prime Minister for approval.

3. Submitting to the Minister of Health for issuance decisions, directives, circulars; national technical standards; professional procedures, systems of indicators and indices within the field of population and family planning.

4. The Minister of Health directs, guides, supervises, evaluates, and is responsible for organizing the implementation of regulatory documents, policies, strategies, plans, national target programs, population and family planning projects after they have been approved.

5. Issuing guidance documents on professional matters related to population and family planning within its authority.

6. Regarding population size and family planning:

a) Managing fluctuations in population increase and decrease, proposing solutions to adjust birth rates and population growth rates nationwide;

b) Building population forecasts to serve economic and social development plans;

c) Guiding and inspecting the implementation of legal provisions concerning family planning counseling services and management of contraceptive methods;

d) Building, guiding, and inspecting the implementation of models for adjusting population size and family planning.

7. Regarding population structure:

a) Managing population structure by gender and age;

b) Guiding and inspecting the implementation of legal provisions to ensure gender balance according to natural reproductive laws;

c) Building and guiding the implementation of adjustment models for population structure.

8. Regarding population quality:

a) Leading and coordinating with relevant agencies to build a set of indicators and indices on population quality and proposing solutions for their implementation;

b) Managing population quality to meet human resource needs;

c) Leading and coordinating with relevant agencies to build and guide the implementation of models to improve population quality.

9. Participating in the review of national socio-economic development programs and projects in terms of population and family planning policies to ensure rational population distribution among economic regions and administrative units.

10. Organizing communication, mobilization, education, and provision of counseling services in the fields of population, family planning, sexual health, adolescent and youth reproductive health.

11. Organizing scientific research and application of advanced science and technology in the field of population and family planning.

12. Building a management information system for population and family planning, organizing statistical work, information dissemination, and reporting on population and family planning.

13. Guiding, inspecting, creating conditions, and supporting the activities of public service organizations and socialization in the field of population and family planning.

14. Implementing international cooperation in the field of population and family planning according to the division of labor assigned by the Minister of Health.

15. Managing and implementing investment projects in the field of population and family planning according to the division of labor assigned by the Minister of Health.

16. Managing organizational structure, staffing; finance, assets allocated; managing affiliated organizations under the General Department according to the division of labor assigned by the Minister of Health; implementing salary systems and incentive, reward, disciplinary, training, and professional development policies for staff under the General Department's management in accordance with the law and the division of labor management by the Ministry of Health.

17. Implementing administrative reform in the field of population and family planning according to the Ministry of Health's reform plan.

18. Inspecting, investigating, resolving complaints and grievances, and handling violations in the field of population and family planning within its jurisdiction.

19. Performing other tasks assigned by the Minister of Health.

Article 3. Organizational Structure

1. Population and Family Planning Department.

2. Communication and Education Department.

3. Planning and Finance Department;

4. Cadres and Civil Servants Organization Department.

5. Office.

6. Inspectorate.

7. Institute of Population Research and Development.

8. Population Information and Documentation Center.

9. Family and Society Newspaper.

The Departments of Population and Family Planning, Planning and Finance, Cadre and Civil Service Organization, Office, and Inspectorate shall be organized into divisions.

The General Department Director stipulates the functions, tasks, powers, and appoints, dismisses, and removes from office the heads and deputies of the units under the General Department.

Article 4. Leadership of the General Department

1. The General Department of Population and Family Planning has a Director and not more than three Deputy Directors.

2. The Director and Deputy Directors shall be appointed and relieved from their positions by the Minister of Health in accordance with the provisions of the law.

3. The Director of the General Department of Population and Family Planning is responsible to the Minister of Health for all activities of the Department. The Deputy Directors are responsible to the Director for the areas of work assigned to them.

Article 5. Effective Date

1. This Decision takes effect fifteen days after its publication in the Official Gazette.

2. The Ministers, Heads of Ministries at the equivalent level, Heads of government agencies, Chairpersons of provincial People's Committees under the central government, the Director of the General Department of Population and Family Planning, relevant agencies, organizations, and individuals are responsible for implementing this Decision./.
