CIRCULAR

REGARDING THE ISSUANCE AND IMPLEMENTATION OF

"NATIONAL TECHNICAL REGULATION ON CHILDREN'S TOY SAFETY"

BASED ON THE STANDARDS AND TECHNICAL REGULATIONS LAW ON JUNE 29, 2006 AND DECREE NO. 127/2007/NĐ-CP OF AUGUST 1, 2007 BY THE GOVERNMENT PROVIDING GUIDELINES FOR THE IMPLEMENTATION OF CERTAIN PROVISIONS OF THE STANDARDS AND TECHNICAL REGULATIONS LAW;

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Considering the proposal of the General Director of the Standardization, Metrology and Quality Control Department;

THE MINISTER OF SCIENCE AND TECHNOLOGY ADOPTS:

Article 1. ATTACHES HERETO WITH THIS CIRCULAR "NATIONAL TECHNICAL REGULATION ON CHILDREN'S TOY SAFETY".

Article 2. THIS CIRCULAR SHALL TAKE EFFECT 45 DAYS FROM THE DATE OF ISSUE.

Article 3. AS OF APRIL 15, 2010, CHILDREN'S TOYS PRODUCED DOMESTICALLY OR IMPORTED INTO THE COUNTRY SHALL ONLY BE PERMITTED TO CIRCULATE IN THE MARKET AFTER THEY HAVE BEEN CERTIFIED AS COMPLIANT, ANNOUNCED AS COMPLIANT, AND MARKED WITH A COMPLIANCE MARK IN ACCORDANCE WITH THE NATIONAL TECHNICAL REGULATION ON CHILDREN'S TOY SAFETY ATTACHED TO THIS CIRCULAR.

Article 4. FROM THE DATE THIS CIRCULAR TAKES EFFECT UNTIL APRIL 15, 2010, THE PRODUCTION AND IMPORT OF CHILDREN'S TOYS SHALL CONTINUE TO BE CONDUCTED IN ACCORDANCE WITH CURRENT REGULATIONS OR IN ACCORDANCE WITH THE NATIONAL TECHNICAL REGULATION ON CHILDREN'S TOY SAFETY ATTACHED TO THIS CIRCULAR.

Article 5. THE DIRECTOR OF THE STANDARDIZATION, MEASUREMENT, AND QUALITY CONTROL AGENCY, HEADS OF RELEVANT AUTHORITIES, ORGANIZATIONS, AND INDIVIDUALS ARE RESPONSIBLE FOR ENFORCING THIS CIRCULAR.

DURING THE IMPLEMENTATION, IF THERE ARE ANY DIFFICULTIES, ORGANIZATIONS, ORGANIZATIONS, AND INDIVIDUALS SHOULD PROMPTLY REPORT TO THE MINISTRY OF SCIENCE AND TECHNOLOGY FOR STUDY AND AMENDMENT./.
