Issuing the professional standards for technical safety labor inspection ranks

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies; Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;
Pursuant to Decree No. 116/2003/NĐ-CP dated October 10, 2003 of the Government on recruitment, utilization, and management of cadres and civil servants in state-owned units; Decree No. 121/2006/NĐ-CP dated October 23, 2006 of the Government amending certain Articles of Decree No. 116/2003/NĐ-CP;
Pursuant to Circular No. 05/2009/TT-BNV dated May 11, 2009 of the Ministry of Home Affairs issuing the job titles and code numbers of technical safety labor inspection ranks and Official Letter No. 1357/BNV-CCVC dated May 11, 2009 of the Ministry of Home Affairs regarding the review of the professional standards of technical safety labor inspection ranks;
The Ministry of Labor, Invalids and Social Affairs hereby stipulates the professional standards for technical safety labor inspection ranks as follows:
Article 1. Scope and Applicability
This Circular stipulates the professional standards for technical safety labor inspection ranks.
The professional standards for technical safety labor inspection ranks serve as the basis for implementing recruitment, utilization, and management of staff working in the field of technical safety labor inspection at state-owned units performing the task of inspecting various types of machines, equipment, and materials with strict requirements for labor safety according to the list issued by the Ministry of Labor, Invalids and Social Affairs.
Article 2. Professional Standards for Technical Safety Labor Inspection Ranks
1. Senior Technical Safety Labor Inspector
a) Responsibilities
A senior technical safety labor inspector is a technical specialist responsible for conducting technical safety labor inspections, assisting leadership in organizing, directing, and implementing technical safety inspections of various types of machines, equipment, and materials with high and ultra-high technical parameters or high levels of danger and toxicity according to technical safety standards and regulations.
b) Duties
- Drafting and implementing inspection plans within the assigned authority;
- Organizing and directly conducting technical safety inspections of machines, equipment, and materials with strict labor safety requirements, bearing personal responsibility for the inspection results;
- Collecting data, analyzing, and forecasting the situation of technical safety inspections within the assigned scope. Evaluating practical activities, proposing measures to ensure safety to prevent accidents caused by inspected objects;
- Leading the summary, evaluation, and drawing of lessons from technical safety inspection work within the assigned tasks, thereby proposing and supplementing issues that need to be revised in the inspection procedures, technical safety standards, and regulations to improve national regulations;
- Conducting accident investigation and cause analysis when required;
- Leading or participating in scientific research projects related to technical safety inspections within the assigned field;
- Participating in drafting, compiling, and providing comments on technical safety standards and regulations as required by competent authorities, developing technical safety and occupational health measures when required;
- Leading or participating in compiling content, programs, and textbooks to train managers on technical management principles, operational procedures, and technical incident handling measures, and preventive measures for inspected objects according to current technical safety standards and regulations;
- Participating in compiling training materials for technical safety labor inspection and participating in training technical safety labor inspectors when assigned;
c) Competence Standards
- Effectively organizing and implementing technical safety inspection activities;
- Having the ability to effectively coordinate with relevant agencies during the implementation of technical safety inspection tasks;
- Having the ability to synthesize and generalize activities related to professional expertise in the inspection field to propose solutions to enhance the effectiveness of inspection activities;
- Having the ability to guide professional activities in the technical safety inspection field consistent with the trained specialty;
- Leading or participating in scientific research projects related to the technical safety labor inspection field.
d) Qualification Standards
- Graduated from a university or higher in a relevant technical field suitable for technical safety labor inspection tasks;
- Proficient in a commonly used foreign language at level B in professional activities;
- Skilled in using computers and information technology applications to support professional work;
- Having at least nine years of experience in the technical safety labor inspector rank or equivalent;
- Having a research project or scientific work related to technical safety labor inspection recognized by the Scientific Council and effectively applied;
- Holding a certificate of training in the professional rank of Senior Technical Safety Labor Inspector according to the program issued by the Ministry of Labor, Invalids and Social Affairs;
2. Technical Safety Labor Inspector
a) Responsibilities:
A technical safety inspector for labor is a specialized technical staff member responsible for conducting technical safety inspections of machinery, equipment, and materials with strict labor safety requirements that have high or medium technical parameters and low or medium levels of danger and toxicity according to labor safety technical standards and regulations.
b) Tasks:
- Develop or participate in developing inspection plans for specific inspection objects within their assigned field of expertise.
- Directly carry out inspections and provide technical advice to production facilities using machinery, equipment, and materials with strict labor safety requirements within the specific scope assigned.
- Participate in scientific research topics related to technical safety inspection work as assigned.
- Participate in compiling training manuals on labor safety and hygiene, and train management personnel, workers, and operators of objects with strict labor safety requirements in accordance with their trained specialty.
c) Competence criteria:
- Possess the ability to independently and proficiently perform inspection tasks within the assigned scope in accordance with their trained specialty.
- Have the ability to grasp and apply advanced methods and technologies during the execution of assigned technical safety inspection tasks in accordance with their trained specialty.
- Be capable of leading and coordinating with organizations and individuals during the execution of assigned technical safety inspection tasks in accordance with their trained specialty, and be personally responsible for the results of their inspections.
- Possess the ability to guide operations, disseminate experience, and participate in scientific research to serve technical safety inspection work.
- Be able to identify risks and establish preventive measures against incidents while performing inspection tasks.
- Proficiently use technical equipment and tools serving technical safety inspection work.
d) Qualification criteria:
- Graduated from a university or higher in a relevant technical field suitable for technical safety inspection tasks (fulfilling the probationary period requirements).
- Knowledge of a commonly used foreign language at level A in professional activities.
- Proficient use of computers to meet professional task requirements.
- Hold a certificate for technical safety inspector training course issued by the Ministry of Labor, War Invalids and Social Affairs.
3. Technical inspection assistant for labor safety
a) Responsibilities:
A technical inspection assistant for labor safety is a specialized technical staff member responsible for carrying out specific steps in the inspection process of machinery, equipment, and materials with strict labor safety requirements that have low technical parameters and low levels of danger and toxicity according to current labor safety technical standards and regulations, as assigned by a technical safety inspector.
b) Tasks:
- Perform inspection tasks on gas cylinders according to a specific process on a complete inspection line, ensuring the required technical safety standards.
- Follow certain steps in the inspection process to detect technical errors in machinery, equipment, and materials with strict labor safety requirements during the inspection process.
- Propose measures to improve the quality of inspections.
- Timely identify malfunctions of technical equipment used for inspection work, propose corrective measures to ensure inspection quality.
- Personally responsible for conclusions at specific inspection steps as assigned.
c) Competence criteria:
- Possess the ability to work independently and proactively, proficiently using technical equipment and tools serving technical safety inspection work.
- Understand the principles and structure of systems used for inspection, inspection procedures, and related labor safety technical standards and regulations for assigned inspection objects; regulations on safe electrical, mechanical, pressure vessel usage, and fire prevention and explosion protection.
- Possess the ability to work in teams during the execution of assigned technical safety inspection tasks.
d) Qualification criteria:
- Graduated from a technical college in a relevant engineering specialty (fulfilling the probationary period requirements).
- Proficient use of computers to meet professional task requirements.
- Hold a certificate for technical inspection assistant training course issued by the Ministry of Labor, War Invalids and Social Affairs.
Article 3. Implementation Provisions
1. The Minister, head of a ministerial-level agency, head of a government-affiliated agency; People's Committees of provinces and centrally governed cities are responsible for implementing this Circular.
2. This Circular takes effect 45 days from the date of issuance.
