PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 05/2011/NĐ-CP dated January 14, 2011 of the Government on ethnic affairs;

Considering the proposal of the Minister, Chairman of the National Ethnic Minorities Committee,

DECISION:

Article 1. Scope of Regulation

This Decision stipulates policies for persons of influence among ethnic minority communities throughout the country.

1. The subjects entitled to enjoy the policies prescribed in this Decision are persons of influence among ethnic minority communities (hereinafter referred to as persons of influence), including the following conditions:

a) They are Vietnamese citizens with permanent residence registration in ethnic minority areas;

b) They are elected by the local residents as exemplary models in implementing the Party's guidelines, State policies, and local regulations;

c) They are recognized by the commune authorities as having made significant contributions to building and protecting their village (village, hamlet, tribe, commune, district, sector);

d) They are elected by the Village People's Council and inter-sectoral meeting (Village Party Committee, Village Chief, Chairman of the Village Mass Organization and other village associations); the Commune People's Committee approves the recognition.

2. Persons of influence are reviewed annually; each village may elect one person of influence.

Article 3. Principles of Implementation

1. Direct implementation of policies and benefits for persons of influence.

2. Ensuring democracy, transparency, fairness, correct target groups, and appropriate benefits.

3. In cases where a person of influence simultaneously enjoys support policies at different levels, they shall be entitled to the highest level of support.

1. Provision of Information

a) Persons of influence are periodically or ad hoc informed by the local Party committee and administrative authorities about new Party guidelines, State policies, laws; economic and social development situations and tasks, and national defense and security of the locality;

b) Persons of influence are provided with newspapers (free of charge, Ethnic Minorities and Development Newspaper, provincial newspaper where the person of influence resides);

c) Persons of influence are trained and educated on knowledge or experience in economic and social development and national defense and security as determined by the locality.

2. Material support and spiritual encouragement Persons of influence are provided by the local Party committee and administrative authorities:

a) Visits and gifts during Tet and ethnic minority festivals; the expenditure does not exceed 400,000 VND/person/year;

b) Visits and material support when persons of influence are ill; the expenditure does not exceed 400,000 VND/person/year;

3. Reward system Persons of influence who achieve outstanding results in production, economic and social development, and national security shall be eligible for rewards according to the Law on Competition and Awards and current regulations on competition and awards.

Article 5. Funding for implementation of the policy

1. The funding to implement the policy for persons of distinction among ethnic minority groups shall be guaranteed by the state budget.

2. The central budget shall guarantee activities related to directing, guiding, inspecting, supervising, and managing the implementation of the policy by central agencies.

3. The local budget shall ensure activities related to implementing the system and policies at the local level and shall be balanced within the annual budget estimates of provinces and cities according to the provisions of the State Budget Law; for localities with difficulties that cannot allocate funds to implement the policy for persons of distinction, the central budget shall consider providing support for implementation.

4. The preparation, execution, and settlement of the funding for implementing the policy as stipulated in this Decision shall be carried out in accordance with the provisions of the State Budget Law and related guiding documents.

Article 6. Implementation Organization

2. The Ministry of Finance: - Guide the management and use of funding for implementing the policy as stipulated in this Decision; - Take the lead and coordinate with the Committee for Ethnic Affairs to develop the annual budget plan and submit it for approval.

Article 7. Effective Date

This Decision shall take effect from May 16, 2011.

Article 8. Responsibility for Implementation

THE MINISTERS, HEADS OF GOVERNMENT-LEVEL MINISTRIES, HEADS OF GOVERNMENT-LEVEL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
